52.212-2 Evaluation — Commercial Products and Commercial Services (Nov 2021) (DEVIATION Mar 2026)
(a) Evaluation factors: The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
(i) Price;
(ii) Technical Capability;
(iii) Past Performance;
SEE AWARD SELECTION PROCESS section below
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
AWARD SELECTION PROCESS
Award will be made in accordance with FAR Part 12 to the Offeror that provides the best value to the government based on price, technical, and past performance. Per FAR 12.203(c)(2) evaluation will be conducted by comparative evaluation of offerors. This solicitation is not stating nor required to state the importance assigned to each evaluation factor and/or sub factor (FAR 12.203(c)(2)). The government reserves the right to select other than the lowest priced quote if it is determined to be the best value to the government.
1. Price: A price evaluation will be performed to determine the reasonableness of the proposed price.
Reasonableness will be determined considering other competitive prices received and comparison to the independent government estimate. If multiple contract line items are included in the price schedule, prices will also be evaluated to determine whether any line items are unbalanced.
Offerors are cautioned to distribute costs appropriately. The government may select other than the lowest price quote if it is determined to be the best value to the government.
2. Technical Capability: Submit a concise, two (2) page statement detailing your capabilities for vault toilet pumping services. Include an equipment list for all tools and vehicles you will use on this contract, specifying make, model, tank volume, intended use, quantity, and age. Only list equipment that will be used onsite for these services.
3. Past Performance: The government will perform a past performance review using the vendor’s UEI number. The UEI number shall be provided in subsection (c) Contractor Core Data located https://www.napex.us/
140P1326Q0030 WHSA Vault Toilet Pumping Services Page 10 of 12 within the ADDENDUM TO 52.212-1 INSTRUCTIONS TO OFFERORS - COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (Sep 2023) (DEVIATION Mar 2026) above. The government will conduct a CPARS review, review exclusions, if any, and will use any other method deemed beneficial by the contracting officer.
Quotes will receive a preliminary review to determine whether the quote contains sufficient information, as required by the solicitation, to allow the government to perform a meaningful evaluation. If the results of this preliminary review indicate that the quote lacks sufficient information to allow a meaningful evaluation to be conducted, the Contract Specialist/Contracting Officer may eliminate the quote from further evaluation and consideration for an award.
The government will evaluate quotes in groups of three (3), starting with the lowest priced quotes, proceeding upward, incrementally in price, until an awardee is selected. At that point, the evaluation process stops, and award will be made to the selected Offeror.
52.237-1 Site Visit (Apr 1984)
Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.
(End of provision)
Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP) (Feb 2021)
