About this file

This informational webinar slide deck is presented by the Oregon Health Authority's Public Health Division, Environmental Public Health, in conjunction with the Oregon Department of Human Services Office of Contracts & Procurement, regarding a Request for Application (RFA) for remediation of lead-based paint hazards in target housing and child-occupied facilities under OregonBuys solicitation S-44300-00005742. The webinar, held on November 6, 2023, provides guidance to potential suppliers on the application process, regulatory requirements, and technical standards for lead-based paint remediation work. Key topics covered include the definition of abatement versus interim controls, dust and soil sampling procedures for risk assessments, clearance requirements, and signage protocols. All applications must be submitted through the OregonBuys platform at oregonbuys.gov, and potential applicants are directed to register in the system prior to submission. Technical support for OregonBuys registration and submission is available through support.oregonbuys@oregon.gov or 1-855-800-5046, with contract-specific questions directed to Suzanne Christman at Suzanne.Christman@odhsoha.oregon.gov or 971-283-4505.

The webinar addresses regulatory compliance under Oregon Revised Statute 431A and Oregon Administrative Rules 333-067, which govern lead-based paint activities and establish standards more stringent than EPA requirements in certain areas, including dust wipe sampling procedures, composite sampling restrictions, and lead hazard thresholds. Oregon's standards require that risk assessment reports and clearance reports be submitted to the Oregon Health Authority within 10 days of completion, that clearance be performed by an independent party, and that warning signs remain posted at work sites until clearance is achieved. The presentation also notes upcoming changes to EPA hazard standards and a potential reconsideration of lead-based paint definitions, though specific pricing terms, contract duration, funding amounts, and award dates are not detailed in this webinar material.

Regulatory Background

Statutory Authority (ORS 431A)

Oregon Administrative Rule (OAR 333-067)

(2) The authority may contract with a third party to obtain a lead-based paint risk assessment or to abate or control lead-based paint hazards that are identified by a risk assessment.

431A.355 Power of Oregon Health Authority to regulate lead-based paint activities and renovation; fees.

333-067-0110 Required Remediation of Lead-Based Paint Hazards; Identification of a Third Party; Stop-Work Order

(4) If a person described in section (1) of this rule fails to comply with an order described in section (2) of this rule within the timeframe set in the order, the Authority may contract with a certified firm to obtain a lead-based paint risk assessment and abate or control any lead-based paint hazards that are identified by the risk assessment.

Remediation of Lead-Based Paint Hazards OAR 333-067

OAR 333-067

Requirements under this rule that are more stringent than EPA rules include:

• Dust wipe samples must be taken in accordance with the Clearance section of the 2012 HUD Guidelines

• Composite dust-wipe sampling is not allowed

• Paint chips in excess of 1 mg/cm² or 0.5% lead are an LBP hazard

• Inconclusive XRF results are positive. Paint chip sampling is not allowed.

• Risk assessment reports under this rule must be provided to OHA within 10 days

• All abatement or hazard controls require clearance (not cleaning verification)

• Soil abatement requires soil sampling for clearance

• Clearance must be performed by a person independent of property owner or responsible party

• Clearance reports must be provided to OHA within 10 days

Risk Assessment: Dust Sampling to Identify LBP Hazards

At least one composite soil sample taken from within the dripline of each building face subject or subjected to exterior paint-disturbing work, with a second composite soil sample collected from the nearest play area

Risk Assessment: Soil Sampling to Identify LBP Hazards

“Abatement” under Lead-Based Paint Activities (LBPA)

Abatement means any measure or set of measures designed to permanently eliminate lead-based paint hazards in paint, soil and dust.

Abatement includes:

• The removal of paint and dust

• Permanent enclosure or encapsulation of lead-based paint

• Replacement of painted surfaces or fixtures

• Removal or permanent covering of soil

• Preparation, cleanup, disposal, and post-abatement clearance testing

Interim Controls

1) Dust removal and control: cleaning surfaces to reduce levels of dust containing lead to acceptable levels

2) Covering or eliminating access to bare soil containing excessive levels of lead by planting, or using mulch, gravel, or other means

Measures designed to temporarily reduce human exposure or likely exposure to lead-based paint hazards:

Signage Upon issuance of the order of this rule and until clearance is achieved, warning signs must remain posted at each entry to a work area; or, at each main and secondary entryway to the residence or child-occupied facility; or, for exterior work, where it is easily read 20 feet from the edge of the worksite

Clearance The combined visual and quantitative environmental evaluation procedures used to determine that no lead-based paint hazards remain in the area being cleared after lead hazard controls or paint-disturbing renovation or maintenance have been done.

• Visual assessment

• Dust sampling

• Soil sampling (if soil abatement was performed)

Eric Fischer

Exterior Clearance

Upcoming Changes from the EPA

• EPA’s current hazard standards are 10 micrograms µg/ft² for floors and 100 µg/ft² for windowsills.

• EPA’s current clearance levels are 10 µg/ft² for floors, 100 µg/ft² for windowsills and 400 µg/ft² for window troughs.
