About this file

This is Executive Order 2019-12D issued by the Governor of Ohio governing the expenditure of public funds for offshore services. The order prohibits any State Cabinet Agency, Board or Commission from entering into contracts that use funds to purchase services provided outside the United States, applying to both direct purchases and subcontracted services. The order requires agency procurement officers to include standard language in contracts prohibiting offshore services and mandates that service providers disclose all locations where services will be performed, where state data will be handled, any shifts in service locations, and principal business locations for contractors and subcontractors.

The order includes three specific exemptions: services necessary to attract jobs and business to Ohio; academic, instructional, educational, research or other services supporting international missions of Ohio's public colleges and universities; and situations where the Director of Administrative Services determines an emergency or necessity exists to waive requirements. The order was signed on March 4, 2019 in Columbus, Ohio and will expire ten days after the governor's last day in office unless rescinded before then. The Department of Administrative Services' Chief Procurement Officer is responsible for maintaining procedures to ensure compliance through proper contract language, proposal requirements, procurement manuals, and training of agency procurement officers.
