The Limited Sources Justification seeks approval for IRS IT to award a firm fixed price contract with Deloitte Consulting to immediately and rapidly analyze, plan, report on the work needed to implement COVID-19 American Rescue Plan (ARP) Act legislation. The passage of ARP represents a mission-critical, urgent need for IRS IT and an immediate expansion of existing legislative implementation support for Enterprise Program Management Office (EPMO). The EPMO’s Emerging Programs & Initiatives (EP&I) office needs immediate support to meet these demands to avoid the risk of noncompliance with the legislation, and/or inability to meet related Treasury-issued requirements. Deloitte has been delivering support to the stand-up and operations of the Emerging Programs & Initiative (EP&I) office and is best positioned to scale and deliver immediate support for the American Rescue Plan and other expected legislation, while continuing to mature EP&I’s programmatic and analytical functions.

The need date for this support is June 1, 2021.

4.a Identification of the authority being used (Check the appropriate box that applies).

FAR 8.405-6(a)(1)(i)(A) – An urgent and compelling need exists, and following the procedures would result in unacceptable delays.

FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

FAR 8.405-6(a)(1)(i)(C) – In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order or BPA provided that the original order or BPA was placed in accordance with FSS procedures in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

FAR 8.405-6(b) – Items peculiar to one manufacturer.

4.b Supporting Rationale:

This URGENT procurement action is in response to the world-wide exposure of the highly contagious virus known as Coronavirus (COVID) and the immediate actions that will be required for all Federal Agencies as this virus continues to reach out across the whole world and into the United States and our citizens. In an urgent and immediate need to continue supporting the IRS and avoid a break in service due to a national emergency, this is the support required to assist the Treasury/Internal Revenue Service (IRS) in immediately identifying and reporting on the implementation provisions/legislation of American Rescue Plan Act. The IRS is seeking a sole source award under the Information Technology Enterprise Program Management Support Services Blanket Purchase Agreements (IT-EPMSS BPAs). Competing requirements with all nine BPA holders is preferred, however, it is urgent that these services need to continue to avoid a break in service not later than June 1, 2021 and that the contractor selected is able to immediately begin working with no learning curve. With the passage of the American Rescue Plan (ARP) Act, multiple legislation enactments and delivery of key milestones are expected in July, vendor transition or break-in-service will be a significant risk on the IRS’ ability to deliver on legislation requirements. Deloitte has knowledge delivering agency’s key milestones on ARP legislation and conducting on-going analysis and implementation planning for legislation priorities. Deloitte currently provided critical integration support across IT organizations, including risk tracking/mitigation and

Under task order 2032H5-21-F-00043, Deloitte has provided Legislative Sensing and accelerated analysis of the American Rescue Plan to enable IT to prepare for the anticipated legislation changes. The support provided under the current work request will end on May 31, 2021 and it is critical that these services continue without interruption to achieve the ARP July milestones. Given the short time-line and Deloitte’s previous support of ARP, they are uniquely positioned to provide this support and ensure that the IRS meets the upcoming critical deadlines for the implementation of this vital COVID-19 legislation.

5. A determination by the ordering activity Contracting Officer that the order or BPA represents the best value consistent with FAR 8.404(d):

The Contracting Officer has determined that this order represents the best value consistent with FAR 8.404(d). The order will be against a BPA that was awarded under the contractor’s GSA Schedule.

6. A description of the market research conducted among schedule holders and the results or a statement why market research was not conducted:

Due to the urgent nature of acquisition, the Government’s market research consisted of contacting knowledgeable individuals in IRS IT and reviewing the prior acquisition history for similar requirements.

7.a Any other facts supporting this justification:

N/A 7.b Attachments: Yes No

8. A statement of the actions, if any, the Requiring Activity and Contracting Activity may take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for the supplies and services is made:

Given the urgent and compelling nature of this requirement due to the national emergency, no other source has the familiarity with the swift implementation of this legislation necessary to perform or provide the requirements given the time constraints. This action will fulfill the current, critical requirements and enable IRS IT to competitively procure sustained support for implementation of the American Rescue Plan, and continued support for EP&I in the future.
