About this file
This document is a Section M - Evaluation Factors for Award from a federal solicitation using a Lowest Price Technically Acceptable (LPTA) procurement methodology. The evaluation will focus on two primary factors: Technical Capability and Price. Contractors must demonstrate their ability to fully meet the Statement of Work requirements, particularly environmental requirements, with detailed evidence beyond a simple statement of compliance. Teaming arrangements and subcontractor documentation must be submitted with the quote.
For the Price factor, offerors will be evaluated based on pricing for the first 11 Contract Line Item Numbers (CLINs) covering the base and option years. The solicitation also includes a cybersecurity compliance requirement effective 30 November 2020, mandating that Department of Defense contractors implement NIST SP 800-171 cybersecurity standards and document their assessment results in the Supplier Performance Risk System (SPRS). The Contracting Officer reserves the right to reject proposals that are unresponsive, from unresponsible vendors, or deemed unreasonable in terms of price, program commitments, or contract terms.

SECTION M – EVALUATION FACTORS FOR AWARD
M-1 BASIS FOR AWARD
M-1.1 The Government will utilize FAR 13.106-2 Evaluation of quotations or offers for this solicitation. The Contracting Officer has broad discretion in fashioning suitable evaluation procedures. The procedures in FAR part 15 are not mandatory.
However, the Contracting Officer may decide to conduct discussions at their discretion.
M-1.3 Rejection of Unreasonable Offers: The Government may reject any proposal from an unresponsive offeror, an unresponsible offeror, or a proposal that is evaluated to be unreasonable in terms of price, program commitments, contract terms and conditions, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program.
M-1.4 Contractor Responsibility: In accordance with FAR 9.1, the Contracting Officer shall award contracts only to responsible vendors. No purchase or award shall be made unless the Contracting Officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must:
Have adequate financial resources to perform the contract, or the ability to obtain them (FAR 9.104-3(a);
Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments; Have a satisfactory performance record (FAR 9.104-3(b) and FAR subpart 42.15). A prospective contractor shall not be determined responsible or nonresponsible solely on the basis of a lack of relevant performance history, except as provided in FAR 9.104-2;
Have a satisfactory record of integrity and business ethics (for example, see FAR subpart 42.15);
Have the necessary technical equipment and facilities, or the ability to obtain them (FAR 9.104-3(a)); and Be otherwise qualified and eligible to receive an award under applicable laws and regulations (see also inverted domestic corporation prohibition at FAR 9.108).
In regard to resources, the contractor must be prepared to present acceptable evidence of subcontracts, commitments or explicit arrangements that will be in existence at the time of contract award, to rent, purchase or otherwise acquire the needed facilities, equipment, services, materials, other resources or personnel. The Contractor shall show they have the required resources (including but not limited to facilities and personnel) to perform these services. If the Contractor does not provide this information, they will be required to submit this information within 24 hours of request from the Contracting Officer. Failure to respond or submit this information may result in an offeror being deemed unresponsive and ineligible for award.
Pursuant to FAR 9.104-4, the Contracting Officer reserves the right to request adequate evidence of responsibility on the part of any prospective subcontractor(s).
In the absence of information clearly indicating that the prospective contractor is responsible, the contracting officer shall make a determination of non-responsibility.
Effective 30 November 2020, the Defense Federal Acquisition Regulation Clause 252.204-7012 requires all Department of Defense contractors and subcontractors to implement cybersecurity requirements in National Institute of Standards and Technology (NIST) Special Publication (SP) 800-171, Protecting Controlled Unclassified Information in Nonfederal Systems and Organizations. Your NIST assessment results must be documented in the Supplier Performance Risk System (SPRS) at https://www.sprs.csd.disa.mil/. We would suggest you go to the SPRS homepage and use the vendor quick reference guides to help you complete the process. There is also an SPRS support number on the bottom of the homepage that you can call for assistance with getting directions on how to complete the process.
M-2 FACTORS AND RELATIVE IMPORTANCE
M-2.1 Factors: A detailed and complete analysis of each offeror’s quote shall be performed. The Government’s evaluation shall be based on the following factors (Lowest Price Technically Acceptable):
Factor 1: Technical Capability. The contractor shall demonstrate their ability to fully meet the requirements of the Statement of Work (SoW), and in particular, all the required Environmental requirements of the SoW. Otherwise, they may be rejected at the discretion of the Contracting Officer. Submitting a quote and stating “We can fully meet the requirements of the SoW” is not sufficient. The Contractor shall demonstrate how they are capable of meeting the requirements of the SoW. If they have Teaming Arrangements in place, or subcontractors, they shall submit this documentation with their quote.
Factor 2: Price. Offeror will be evaluated based on pricing provided in the first 11 CLINs (ex. 0001-0011) of the contract for the base and each option year. Please note: the remaining CLINs are solely to provide a scope on pricing for any potential individual items.
