Section L - Instructions, Conditions and Notices to Bidders
ASBESTOS ABATEMENT SOURCE SELECTION 15 December 2020
PROPOSAL PREPARATION INSTRUCTIONS
A. The Government anticipates awarding a single Firm Fixed Price (FFP) contract for the Asbestos Abatement program. However, the Government reserves the right to award no contract if the Source Selection Authority (SSA) determines it is in the Government's best interest. The SSA will consider the Government's expected volume of work, available funding, adequate competition, and the availability of best value proposals. If the Government determines to not award a contract, the Government will not be liable for costs incurred by Offeror(s) in connection with any response to this Request for Proposal (RFP). The Government intends and reserves the right to award a contract without discussions;
therefore, it is imperative Offerors submit their best pricing and proposal terms initially.
However, if during the evaluation period it is determined to be in the best interest of the Government to hold discussions, Offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. The basic contract will cover a five year period of performance and task orders will be awarded for each specific job.
B. Funding will be obligated on each task order awarded under the basic contract.
C. To assure timely and equitable evaluation of proposals offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. Proposal shall be submitted in electronic copy (1). Electronic copies must be submitted in Adobe PDF, Microsoft Word, Microsoft Excel, or Microsoft Power Point format. Electronic formats shall be compatible with a Microsoft operating system.
D. A Task Order project will also be awarded with the basic IDIQ contract and a separate and specified bid for that project will need to be turned in. The details of that specific project are found as attachments to this solicitation. The three documents pertaining to the task order are “Seed TO Bldg 100 Bay H SOW”, “RFP - Asbestos Abatement” and “Solicitation Amendment – FA820121R00050001”. In the Solicitation Amendment – FA820121R0050001 SF 1449, Blocks 14-20c of Section A will need to be filled out and submitted. A price sheet pertaining specifically to the task order with costs included will also need to be submitted.
These submittals will be evaluated following the same procedures for the basic IDIQ. The contractor with a technically acceptable proposal, a favorable past performance, and who is the lowest price will be awarded the basic IDIQ and this task order.

E. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition, the contracting officer determines that adequate price competition no longer exists, offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness of the price.
F. Specific Instructions – The offeror shall submit the following volumes of material. A complete proposal consists of three separate volumes:
1. Volume I – Technical Proposal
**QUALIFICATION: QUALIFIED ON HILL AIR FORCE BASE TO ACCOMPLISH THIS WORK
Contractors must submit their Statement of Qualifications (SOQ) as described in the below “Asbestos/Lead Based Paint (LBP) Abatement Contract Qualification Requirements.”
ABESTOS/LEAD BASED PAINT (LBP) ABATEMENT
CONTRACTOR QUALIFICATION REQUIREMENTS
PART 1: INSURANCE
1.1 The contractor will provide proof of insurance to handle asbestos-containing materials/LBP.
The contractor will submit a prequalification letter from an A.M. Best “A” rated surety (not a bonding agent), that verified your bonding relationship and shows a minimum aggregate bond capacity of $10 Million for this IDIQ contract. The letter should also identify a single project bond amount.
PART 2: SUBMITAL REQUIREMENTS
The following information must be submitted for prequalification in sequential order
2.1 List of employees by date of last exams, who are medically qualified to work with asbestos (29 CFR 1926.1101) and Lead (29 CFR 1926.62). Include examiner’s name, signature, medical qualifications and place of employment. At least 50% of the employees must be current at time of submittal. 100% of employees must show current medical qualification documents at the beginning each abatement job.
2.2 Contractor’s respiratory protection program (29 CFR 1926.1101, 29 CFR 1926.62, EPA
Publication 560/5-85-024, Utah DAQ R307-801).
2.3 Air sampling protocol used to support sampling requirements found in 29 CFR 1926.1101, 29 CFR 1926.62, and Utah DAQR307-801.
2.4 List of equipment to be used for asbestos/LBP work under this contract. Examples of equipment include negative air machines (with maintenance logs/High Efficiency Particulate Air (HEPA) filter documentation), scaffolding, decontamination facilities, disposable clothing, air pressure differential measuring devices (with proof of annual calibration), HEPA vacuums, etc. Copy of manufacturers’ certification of HEPA filter for vacuum. (EPA Publication 560/5-85-024).
2.5 List of National Institute for Occupational Safety and Health (NIOSH)-approved respirators to be used on site by employees. Include NIOSH approval numbers and proof of approval (29 CFR 1926.1101, 29 CFR 1926.62, EPA Publication 560/5-85-024).
2.6 Qualifications of the Independent Third Party Industrial Hygienist (IH) who will oversee the project to include certification date, college degrees, years of experience, and any other qualifications to perform this work. It is recommended the IH overseeing the project be an American Board of Industrial Hygiene-Certified Industrial Hygienist of college graduate with at least eight years of work related experience. The third party on site monitor must have current UDAQ Contractor/Supervisor Certification. If more than one IH consultant is used, list those who may oversee the asbestos/LBP work.
2.7 List of employees fit tested for respirator use in accordance with 29 CFR 1926.1101, 29
CFR 1926.62. List these employees by date and respirator. Include proof of employee fit testing and the name and qualifications of the fit tester. At least 50% of the employees must be current (i.e., WITHIN 6 MONTHS) at the time of submittal. 100% of employees must show current fit test documents at the beginning of each abatement job.
2.8 Asbestos – Proof of at least one year minimum work experience in Utah as a UDAQ certified asbestos abatement company. Provide a current list of employees who have received training in accordance with 29 CFR 1926.1101 and EPA Publication560/5-85-
024. Proof of UDAQ certification is required for all asbestos work categories. Include proof of training (i.e. written certification of completion) from a nationally recognized EPA asbestos training course for each employee. At least 100% of the employees must be currently certified at the time of submittal. All workers, contractor/supervisors, project designers must show current UDAQ certification documents before the beginning of each abatement job.
2.9 Lead – Proof of at least one year minimum work experience in Utah as a UDAQ certified lead abatement company. Provide proof of employee training (i.e., written certification of completion) from an EPA approved course of each employee. All workers, contractor/supervisors must show current UDAQ certification documents before the beginning of each abatement job.
2.10 Copies of air monitoring data taken during and after abatement from previous projects completed by contract (not to exceed five projects). (29 CFR 1926.1101, EPA Publication 560/5-85-024).
2.11 List of prior asbestos abatement contracts performed during the past two years. Include the names, addresses, telephone numbers and dates the projects were performed.

2.12 Additional information to adequately show compliance with applicable laws and regulations in the following areas:
A. Medical certification B. NIOSH Analytical Lab Certification (independent lab) C. Disposal of waste D. Department of Transportation transport of asbestos waste E. Cleanup procedures
2.13 List of any asbestos/LBP abatement projects including those of any corporation, limited liability company, partnership, or sole proprietorship of which any director, officer, or agent of the contractor now making application was a director officer, partner, or agent, to have been prematurely terminated. Include the circumstances surrounding the termination. (EPA Publication 560/5-85-024).
2.14 List of any contractual penalties within the past two years including those of any corporation, limited liability company, partnership, or sole proprietorship of which any director, officer, or agent of the contractor now making application was a direct, officer, partner, or agent, whom the contractor has paid for breach or noncompliance with contract specifications. (EPA Publication 560/5-024).
2.15 List any enforcement action levied by any Federal, State or local government agencies against the contractor for violations related to asbestos/LBP within the past two years including those of any corporation, Limited Liability Company, partnership, or sole proprietorship of which any director, officer, or agent of the contractor now making application was a director, officer, partner, or agent. The citations will be identified by contractor including the name of location of the project, the date(s) and how the allegations were resolved. (EPA Publication 560/5-024).
2.16 Description of all legal proceedings, lawsuits, or claims which have been filed or levied against the contractor or any of his past or present employees for asbestos/LBP related activities within the past two years including those of any corporation limited liability company, partnership, or sole proprietorship of which any director, officer, or agent of the contract now making application was a director, officer, partner, or agent. (EPA Publication 560/5-85-024).

INFORMATION FOUND TO BE FALSE, WILL BE GROUNDS FOR IMMEDIATE
DISQUALIFICATION OF CONTRACTOR.

SUBMITTED WITH YOUR PROPOSAL. ANY PROPOSAL RECEIVED WITHOUT THESE
QUALIFICATIONS WILL BE CONSIDERED INELIGIBLE FOR THIS AWARD. **
2. VOLUME II – PRICE PROPOSAL Submit (1) copy electronically
a. Complete blocks 14-20c of the RFP Section A, SF 1442. In doing so the offeror accedes to the contract terms and conditions as written in the RFP Sections A through K. These actions constitute the model contract.
b. Complete the necessary fill-ins and certifications in Sections I through K. Section K shall be returned in its entirety. For Sections C through I, the offeror shall submit only those pages that requires a fill-in.
c. Insert proposed unit prices in the attached Supplemental Schedule B – Price List on the excel spreadsheet posted on Beta.sam.gov for each location and the applicable Davis-Bacon Wage Determination. Quantities listed on the Supplemental Schedule B – Price List are estimates used for evaluation purposes only.
d. A Task Order project will also be awarded with the basic IDIQ contract and a separate and specified bid for that project will need to be turned in. The details of that specific project are found as attachments to this solicitation. The three documents pertaining to the task order are “Seed TO Bldg 100 Bay H SOW”, “RFP

3. VOLUME III – Past Performance
a. Offerors may submit recent, relevant contracts as defined in Section M. The government will consider this information, along with information obtained from other sources (e.g. www.cpars.gov, customer interviews, etc.).
I. Offerors are encouraged to address any performance problems/issues that the Government may identify and explain corrective action taken and current status. The Government will consider this information in determining the offerors past performance rating.
II. An offeror’s failure to address performance problems/issues within this volume does not preclude the government from using such information in determining a past performance rating.
b. Offerors shall submit all Past Performance information on Past Performance Information Sheets (Section J Attachment).
