About this file

This document contains the City and County of San Francisco Office of Contract Administration's standard contract terms for the Technology Marketplace 3.0 Micro LBE Set-Aside Request for Proposals, which seeks qualified information technology suppliers to provide IT commodities and services to City Departments on an as-needed basis. The solicitation establishes a framework agreement through which multiple City Departments may procure IT products and services, with specific project details, quantities, and timelines determined on a case-by-case basis as departments submit individual purchase orders. Proposers must carefully review the P-690 RFP document for complete solicitation requirements, including response procedures, evaluation criteria, and submission deadlines.

The contract terms establish a Micro Locally Based Enterprise (LBE) set-aside, restricting participation to businesses meeting the City's MBE certification requirements. Pricing shall be submitted in accordance with the RFP specifications, with rates subject to negotiation based on individual project scope and complexity. The term of any resulting agreements will extend for the period specified in individual purchase orders, with renewal options available at the City's discretion. Funding for purchases under this contract will be provided by individual City Departments from their respective departmental budgets as services are procured on an as-needed basis.

If City is required to pay a price that exceeds the price agreed upon by this Agreement, the excess price will be charged to and collected from Contractor (or sureties on its bond, if bond has been required); or, the City may terminate the Agreement for default; or, the City may return deliveries already made and receive a refund.

4.5.8 Safety Data Sheets. Where required by law or by City, Contractor will include Safety Data Sheets (SDSs) with delivery for applicable items. Failure to include the
