About this file

This is a Service Level Agreement (SLA) schedule for the Michigan Department of Transportation (MDOT) Winter Maintenance Truck Buildup Components contract (RFP 260000002057). The agreement establishes performance standards and accountability measures for contractors delivering units to support MDOT's winter maintenance fleet. Contractors must deliver all units within 120 calendar days of order receipt, with deliveries occurring on the same day unless partial delivery is approved in advance. Units must match the Order Confirmation exactly in items, brands, and quantities with no substitutions permitted without prior written authorization from the Program Manager. Deliveries must comply with facility-specific schedules and receiving hours as outlined in Schedule A, with signed and dated packing slips required at the time of delivery. The State emphasizes that timely delivery is critical to fleet availability and the State's ability to perform essential winter maintenance services.

The SLA structure includes two primary performance metrics: Timely Deliveries and Accurate Deliveries, each with a 100% compliance standard. For failure to meet delivery deadlines, contractors incur service credits equal to 0.2% of the per-unit Delivery Order cost per calendar day, accruing for up to 30 calendar days maximum per affected unit. Similarly, if units are delivered before the scheduled date but fail to meet Delivery Order Specifications, service credits of 0.2% of the per-unit Delivery Order cost are assessed per calendar day from the scheduled delivery date until the State determines full compliance, also capped at 30 calendar days per unit. Contractors are exempt from liquidated damages for delays caused by circumstances beyond their control, including acts of God, weather, strikes, and quarantine restrictions, provided such extenuating circumstances are communicated to the Program Manager prior to the scheduled delivery date. Credits due are applied against amounts payable to the contractor or invoiced directly at the State's discretion.
