About this file

This is a Small Business Enterprise (SBE) Contractor's Statement of Proposed Utilization form used by the City of Phoenix, Office of the City Engineer, Street Transportation Department, for Job Order Contracts related to pavement surface treatment services. The form requires contractors selected for the Street Transportation Department Pavement Surface Treatment Program to identify certified SBE firms that will be utilized to meet the established 6% annual SBE subcontracting goal. Contractors must submit a completed Statement of Proposed SBE Utilization for each individual Job Order Agreement, with responses due by 12:00 pm on Friday, May 1, 2026. The contract structure includes an initial 36-month term or $18 million per contractor (whichever occurs first), with an option to renew for an additional 24-month term or the balance of the maximum contract amount, not to exceed $30 million per contractor. Individual Job Order Agreements cannot exceed $4 million in construction costs.

The form requires contractors to list all certified SBE firms that will perform work on each Job Order, including the scope of work, subcontract dollar amounts, and designations for supplier and broker utilization, which are capped at 25% of the total SBE goal. Only SBE firms certified with the City of Phoenix as of the proposal date will have their subcontract amounts counted toward meeting the required goals. Contractors must maintain monthly compliance reports through the City's online database at https://phoenix.diversitycompliance.com with reports due by the 15th of each month. Failure to meet annual SBE goals or demonstrate good faith efforts may result in noncompliance status, potentially triggering payment withholding of 10-100%, contract rejection for one year, or contract cancellation. Additionally, contractors must comply with Arizona Revised Statutes Section 34-221(G), which requires prompt payment to subcontractors within seven calendar days of receipt of progress payments from the City.
