About this file

This is a Solicitation Amendment (W519TC26RA0360002) that modifies the Special Ammunition and Weapon Systems (SAWS) procurement RFP issued by the Army Contracting Command - Rock Island Arsenal (ACC-RIA) under solicitation W519TC26RA036.

The amendment clarifies and updates key contract requirements for the procurement of non-NATO standard ammunition and select non-standard weapon systems to support the Department of War, other U.S. Government agencies, foreign governments, and international organizations. The solicitation seeks up to five Firm-Fixed Price Indefinite Delivery Indefinite Quantity (IDIQ) contracts from contractors who meet or exceed the Minimum Technical Threshold Rating under a Highest Technically Rated Offeror (HTRO) source selection methodology. Proposals are due October 19, 2026, at 5:00 PM Central Standard Time and must remain valid for 180 calendar days. The amendment updates evaluation criteria, clarifies that delivery orders issued after Ordering Period 1 will not have established contract-level NTE ceiling prices, incorporates FAR 52.232-32 for performance-based payments on a delivery order basis, and introduces a consideration formula for delinquent deliveries calculated as: Total Consideration = N × P × FFR / 12 Months × M × 30%, where N equals delinquent units, P equals contract unit price, FFR equals the Federal Funds Rate at award, and M equals cumulative months delinquent. The contract includes a guaranteed minimum of $1,000.00 per awardee with a maximum quantity of 3,552,685,000 items over five one-year ordering periods. Strict sourcing prohibitions apply, including exclusions for debarred entities, Chinese telecommunications equipment, Russian Federation sources, and entities on OFAC sanctions lists. All contractors must comply with ISO 9001-2015 quality standards, complete Pre-Award Safety Surveys, and submit ammunition and explosives supplier information for facilities performing AA&E work.

Miscellaneous text in this section has been modified from:

General Information

The Army Contracting Command - Rock Island Arsenal (ACC-RIA) and the U.S. Army, Product Lead Special Ammunition and Weapon Systems (PdL SAWS) herein issues Solicitation W519TC26RA036. This is for the procurement of Special Ammunition and Weapon Systems (SAWS) and non-North Atlantic Treaty Organization (NATO) standard ammunition. This is in support of the Department of War (DoW), other U.S.

Government (USG) Agencies, foreign governments, and international organizations.

This requirement requires highly capable Prime Contractors to procure and deliver a diverse portfolio of Non- Standard Ammunition (NSA) and select Non-Standard Weapon Systems (NSWS). The primary objective of this program is to establish reliable, agile, and responsive supply chains capable of sourcing specialized, foreign-produced munitions and mortar weapons systems. These materiel requirements support the National Security Strategy and enable the National Military Strategy for joint warfighters, USG agencies, and international allies or coalition partners.

The USG is seeking partners who can guarantee quality and safety despite the "non-standard" nature of these weapons. While these items are not type-classified for U.S. troop use, the Contractor will be strictly evaluated on its ability to provide experience of implementing rigorous quality control, visual and physical inspections, and ballistic testing to deliver safe, reliable, and effective SAWS or NSWS.

The applicable North Atlantic Industry Classification System (NAICS) code for this acquisition is 332993 - Ammunition (except Small Arms) Manufacturing

Procurement Categories

The ammunition and weapon systems to be procured fall within the following Federal Supply Groups (FSGs) provided in the SAWS Tailored Federal Supply Classification (FSC) Item List (Attachment 0001). With limited exceptions, all items must be compatible with the applicable weapons within their associated General Specification(s) for PdL SAWS (Attachments 0003 - 0007).

FSGs and subordinate FSC codes used as a basis for categories (Attachment 0001).

Contract and Award Details

Source Selection

A Highest Technically Rated Offeror (HTRO) source selection approach will be utilized. This is referenced in the DoD Source Selection Procedures (para 1.3.1.5) and will be conducted in accordance with Revolutionary Federal Acquisition Regulation (FAR) Overhaul (RFO) 15.103-3 and the DoD Source Selection Procedures.

Technical Experience Evaluation

Offerors are required to use the HTRO Self-Score Matrix (Attachment 0008) to self-score their past technical experience. To substantiate their self-scores, Offerors must submit work samples documenting relevant past technical experience as either a Prime Contractor or a Subcontractor.

It is the USG's expressed authority to reject or accept any additional terms and conditions proposed by an Offeror.

Contract Type

The USG anticipates awarding up to five Firm-Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) contracts to Offerors that meet or exceed the Minimum Technical Threshold Rating (MTTR) under the HTRO Source Selection criteria whose price proposal is deemed fair and reasonable, and who has been determined responsible IAW RFO FAR Part 9. If fewer than five Offerors meet this requirement, the USG reserves the right to make awards to the highest-rated Offeror(s) below the MTTR.

Delivery Orders will be competitive and will be awarded using either Lowest Price Technically Acceptable (LPTA) or Best Value Tradeoff approach. The source selection approach will be included as part of the Letter of Contemplation / Request for Proposal (RFP) for the applicable Delivery Order. Price shall be an evaluation factor for every Delivery Order, along with, but not limited to, any combination of the following: Technical, Source of Supplier, Delivery Schedule, Past Performance and/or Transportation Plan. Detailed evaluation criteria will be provided with the LOC/RFP for each Delivery Order. Army Contracting Command - Rock Island is the only ordering activity that can place orders on the resultant contract.

Guaranteed Minimum and Contract Maximum Quantity

An initial Delivery Order will be awarded to each IDIQ Contractor for a Contract Data Requirements List (CDRL) deliverable. The dollar value is set at $1,000.00 and will satisfy the guaranteed minimum. There is no guarantee of any Delivery Order beyond the initial guaranteed minimum.

During the life of the resulting contract, the USG is entitled to order a maximum quantity of 3,552,685,000 items.

Ordering Periods

The Solicitation outlines five, one-year ordering periods:

Ordering Period One Award - 365 Days After Award (DAA)

Ordering Period Two 366 DAA - 731 DAA

Ordering Period Three 732 DAA - 1097 DAA

Future Delivery Ordering Procedures

Each awardee will be provided a fair opportunity to compete for individual orders in accordance with RFO FAR 16.507-2(a)(1), unless a sole source order is justified and approved according to RFO FAR 16.507-6.

Letters of Contemplation or RFPs detailing the specific requirement, proposal instructions and evaluation factors will be issued via e-mail to all IDIQ awardees.

The firm-fixed Not To Exceed (NTE) unit price of each line item on Attachment 0016 - Price Matrix will be used to establish range pricing for Ordering Period 1. The firm-fixed NTE unit price will be exclusive of the transportation unit cost, which will be separately proposed and requested with the respective Delivery Order RFP/LOC included in the competitive offers on a Delivery Order basis. Awardees will have the ability to propose unit prices that are lower than the NTE FFP prices on contract for any of the competed Delivery Orders. The NTE FFP unit prices will be based upon the applicable unit prices for only Ordering Period 1. For instance, if a FFP order is issued on the first day of Ordering Period 2, then the applicable unit prices for Ordering Period 1 will not apply. If an order is placed on the last day of Ordering Period 1, then the applicable FFP unit prices for Ordering Period 1 will also apply.

Delivery Orders may also include a total price for transportation costs for each solicited Item Number, separate from the hardware, with the identified method(s) of delivery and back-up delivery quotes to substantiate the proposed transportation costs (if applicable). Delivery locations will be identified on an order-by-order basis.

4.

5.

Delivery Orders will be competitive and the Contracting Officer will determine the most advantageous approach for competition amongst all IDIQ Holders based on complexity, risk, and place of performance.

The source selection approach will be included as part of the RFP/LOC for the applicable delivery order.

Price shall be an evaluation factor for every order, along with, but not limited to, any combination of the following: Past Performance, Technical, Source of Supplier, Delivery Schedule, and Transportation Plan.

Detailed evaluation criteria will be provided with the RFP/LOC for each order.

If an Offeror proposes the use of Government property already in its possession for any competitive delivery order, the total evaluated price will be adjusted to include a rental equivalent factor for each item of such property calculated in accordance with RFO FAR 52.245-9. This adjustment will apply for the use of Government property by the Offeror as well as any subcontractor.

Satisfactory Performance meets contractual requirements. The contractual performance of the element or sub element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractors proposed actions appear only marginally effective or were not fully implemented.

Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub element contains serious problem(s) for which the contractors corrective actions appear or were ineffective.

The evaluation procedures to be used in this assessment, which include coordination with the contractor, are detailed in AFARS PGI 5142.1103.

Delivery Verification Document Guidelines

The list of acceptable delivery verification documents provided in Amendment 0002 is not exhaustive. The USG will consider other verifiable, official documents that serve the same purpose as those listed (e.g., DD Form 250, Signed Bill of Lading, DVC). Any alternative document submitted must clearly demonstrate proof of delivery, including details such as the customer, delivery date, and items delivered, and must be verifiable.

Contract Financing and Performance-Based Payments (FAR 52.232-32)

The incorporation of FAR 52.232-32 does not guarantee, commit, or entitle the Contractor to receive contract financing. Financing is not applicable at the base contract level and is not guaranteed for any subsequent order.

The availability, approval, and specific terms and conditions of performance-based payments shall be negotiated and established strictly at the individual delivery order level upon award.

The PCO retains sole discretion to approve, modify, or deny requests for contract financing in accordance with FAR Part 32 and DFARS Part 232. Adequate consideration may be required from the contractor prior to the bilateral execution of any approved financing arrangement within a delivery order.

Consideration for Delinquent Deliveries

(a) Scope and Applicability

A consideration factor is incorporated within all resulting awards of an IDIQ Contract under this Solicitation.

Awardees ("Contractor") shall be subject to consideration payable or creditable to the United States Government (USG) in the event awarded delivery schedules incorporated within an individual Delivery Order (DO) are delinquent.

3.

1.

2.

Consideration assessed under this clause is intended to compensate the USG for administrative costs, time value of money, schedule dislocation, and inventory impact, and is assessed without prejudice to any other rights or remedies available to the USG under this contract or law.

(b) Determination of Delinquency

Basis of Assessment: Consideration shall be assessed against the number of delinquent units/rounds relative to the binding delivery schedule established in the applicable DO.

First-Day Delinquency Rule: If the Contractor fails to deliver the required quantity on or before the contractual delivery due date, the Contractor shall be deemed one (1) full month delinquent upon the passage of one (1) calendar day following the required delivery date.

Example: If the required delivery date is 30 September 2026, the delivery shall be deemed one (1) month delinquent on 01 October 2026 for calculation purposes.

Subsequent Delinquency Periods: Unless the specific DO delivery schedule dictates otherwise, the USG shall calculate subsequent months of delinquency at thirty (30) calendar-day intervals following the initial assessment date until conforming items are formally accepted by the USG.

(c) Consideration Formula and Calculation

CLIN-by-CLIN Computation: Consideration shall be calculated separately for each affected Contract Line Item Number (CLIN) or Sub-CLIN (SLIN) and summed across all delinquent line items to determine the total consideration owed to the USG.

Formula: Unless expressly modified in an individual DO Request for Proposals (RFP), consideration shall be computed in accordance with the following formula:

Total Consideration = N x P x FFR /12 Months x M x 30%

Key:

N = Total number of delinquent units/rounds for the specified line item.

P = Contract Unit Price of the line item as specified in the applicable DO.

FFR = The Effective Federal Funds Rate (annualized) published by the Federal Reserve Bank of New York on the date of execution/award of the applicable DO.

M = Cumulative number of months delinquent (computed pursuant to paragraph (b) above).

30% = The established consideration factor rate (0.30).

3. Delivery Order Modifications to Formula: The consideration formula may be adjusted based on specific program, operational, or DO requirements. Any change to the base formula, interest benchmark, or consideration factor will be explicitly stated in the Request for Proposal (RFP) for that specific DO and incorporated into the resulting award.

(d) Assessment, Invoicing, and USG Remedies

1.

1.

2.

3.

4.

Periodic Assessment: The Procuring Contracting Officer (PCO) may assess consideration periodically throughout the period of delinquency or defer cumulative assessment until final delivery and acceptance under the DO.

Application of Consideration: Assessed consideration may, at the USG's sole discretion, be executed via:

- A unilateral or bilateral contract modification reducing the total DO obligated price;

- An administrative offset/withhold against pending or subsequent Contractor invoices; or

- Direct remittance from the Contractor via Treasury transfer or check payable to the United States Treasury.

Reservation of Rights: The assessment and collection of consideration under this clause does not constitute a waiver of the USG's rights. The USG expressly reserves all rights and remedies available under contract clauses including, but not limited to, FAR 52.249-8 (Default - Fixed-Price Supply and Service), standard warranty provisions, or common law claims to offset risk, cover costs, or address damages associated with late deliveries.

(e) Delivery Schedule Re-baselining

Re-baselining a delinquent delivery schedule is conditioned upon the Contractor providing consideration in accordance with paragraph (c) above. USG Re-baselining shall not be construed as an uncompensated extension of time or a waiver of the USG's right to consideration for the delivery delinquency.

Contractor Proposal: Upon written notification by the PCO of a delivery schedule delinquency and/or assessment of consideration, the Contractor shall submit a formal, realistic Re-baselined delivery schedule within ten (10) calendar days (or as…
