About this file
This is a solicitation document for a design-build contract to improve and construct border roadways at the Santa Teresa Land Port of Entry (LPOE) in New Mexico. The solicitation (47PH0825R0004) is set aside for small businesses under NAICS code 237310 with a size standard of $45 million.
The project involves repairing approximately 190,000 square feet of concrete pavement using Low Embodied Carbon (LEC) materials including asphalt, concrete, and steel. The work includes complete reconstruction, surface reconstruction, shoulder hardening, joint sealing, and patching of 8-13 inch thick reinforced concrete across eleven areas within the LPOE. The estimated price range is $5-10 million with a 300-day performance period. Proposals are due March 4, 2025 at 12:00 PM local time, with award anticipated in April/May 2025. A virtual pre-proposal conference will be held January 22, 2025, followed by a site visit on January 23, 2025. The project will be awarded using a "Best Value" methodology with four evaluation factors: Past Performance/Experience of Key Personnel (40%), Past Experience of Company (25%), Technical/Management Approach (20%), and Sustainability-LEC Materials (15%). The project is partially funded through the Inflation Reduction Act and requires specific environmental product declarations for construction materials.

Electronic Submission of Proposals
Electronic Submission of Proposals: Offers must be received by the email address of the GSA Point of Contact (POC) listed herein on or before the date and time established for receipt of offers. The date and time of receipt will be established according to the Government computer system’s documentation showing the exact official time of receipt by the GSA POC listed herein and not by the time the electronic proposal was sent by the Offeror or received by the GSA server. WARNING: Consistent with GAO case law on the issue of “late-is-late rule” related to electronically submitted proposals, GSA will strictly comply with and enforce FAR 52.215-1(c)(3)(ii)(A). Pursuant to GAO’s application of FAR 52.215-1(c)(3)(ii)(A), an electronically submitted proposal that is received late will not be considered unless (1) it is received before award is made, (2) the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition and (3) it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals. FAR 52.215-1 (c)(3)(ii)(A)(1).

The proposal should include a cover page with the firm’s point of contact, phone number and email. Also included is the company's DUNs number, UEI number, and TIN number and name, phone number, email of the person who is authorized to negotiate on behalf of the offeror.
The price proposal section portion of the proposal does not count towards the 40-page limit.
This solicitation does not commit the Government to pay any costs incurred in the submission of any proposals. Nor does it commit the Government to procure or contract for said services. The Contracting Officer is the only individual who can commit the Government to the expenditure of public funds in connection with this proposed procurement.
II.C. Price Proposal
(1) Contents
The Price Proposal shall consist of:
a. Standard Form (SF) 1442 blocks 14, 15, 16, 17, 19, & 20a, b, c signed and dated by an authorized individual. Please include the offeror UEI and EIN number in Block 14 of the SF1442 (note: Block 14 “code” and “facility code” can be left blank). Indicate the
(The Solicitation)
Base Contract Price plus options in Block 17 of the SF 1442, which must be fully executed by the Offeror.
b. Pricing Sheet (excel and signed PDF), with prices and/or rates indicated for each price element shown on the pricing sheet with a signature by an authorized individual on the pricing sheet. Pricing Sheet total shall match what is listed on the 1442.
c. The Bid Bond in accordance with FAR 52.228-1 Bid Guarantee
d. Acknowledgement of all amendments in Block 19 of the SF1442.
(2) Qualifications, Exclusions and Conditions
If the Offeror communicates in its proposal any qualifications, exclusions, or conditions to the proposed prices not provided for in the Contract Documents, the Contracting Officer may reject the proposal and exclude the Offeror from further discussions.
(3) GSA is required to track spending for each of the three appropriations it received under the Inflation Reduction Act of 2022 (IRA) -- for low-embodied carbon (LEC) materials, emerging and sustainable technologies, and high-performance green building measures -- and has established “budget activities” for each of these appropriations. A contract line-item number (CLIN) for each of these budget activities has been included in the Agreement as necessary. In addition, sub-CLINs will be used to track spending on each of the LEC materials designated for IRA funding -- asphalt, concrete, glass, and steel. Offerors must include separate prices for IRA work under the corresponding IRA CLINs and sub-CLINs.
Amounts for each IRA CLIN should reflect all expenses necessary to accomplish acquisition and installation of IRA work elements. A list of possible expenses follows below; this list is not exhaustive.
● Expenses of acquiring and transporting products and materials required for IRA funded work to the construction site;
● Labor, general and administrative expenses, and overhead and profit reasonably attributable to installation of IRA-funded work;
● Expenses for materials, tools, riggings and equipment (including safety equipment) required to install IRA-funded work;
● Design, submittal and documentation expenses reasonably attributable to IRA funded work;
● Demolition and disposal expenses reasonably necessary for and attributable to
IRA-funded work;
● Expenses necessary to return space to its condition preceding IRA-funded work;
● Environmental remediation expenses required in execution of IRA-funded work;
and
● Phasing and commissioning expenses reasonably attributable to IRA-funded work.
(The Solicitation)
II.D. Technical Proposal
The Technical Proposal shall include the information requested below for the non-price factors described in Section VI. Non-Price Factors, when combined, are significantly more important than Total Evaluated Price.
The term "similar projects" shall be defined for evaluation purposes projects that meet all three elements of size, complexity, and type as further defined herein. The project requires the phased working of various aspects of the project as day-to-day functions of the Land Port of Entry are accommodated for the full duration of construction with minimal impact on operations.
Each project need not contain every element, but the combination of projects should demonstrate the ability to perform these services in a satisfactory manner.
Similar in size projects are:
● Exceed $5,000,000 in total construction costs, two (2) projects completed in the last eight (8) years from the date of the Solicitation. One (1) of the two (2) project submissions can be incomplete, however it must be 75% complete from the date of the proposal submission.
Similar in complexity projects are:
● Design and construction of roadway repair and replacement of 300,000 SF of concrete pavement 8” or more in depth
● Phasing and planning of work to include road/lane closures
● Project is occupied during normal business hours to allow traffic flow to continue during construction
Similar in type projects are:
● A project consisting of major modernization or renovation for road repair of a Land Port of Entry (LPOE), complex, military base, commercial docks, or facility area, University Campuses, and highway road construction repair projects.
Additional examples include, but are not limited to, highways, airport runways, tarmacs, commercial dock areas, bridges, and distribution center projects.
● Projects involving POV and commercial primary inspection lanes with booths, secondary POV inspection area with inspection canopies, and road and paving site work that meet the minimum depth (8 inches thick) of concrete.
Projects NOT considered similar:
● Stand-alone parking lots, sidewalks, and driveways
GSA’s asphalt, concrete (and cement), glass and steel requirements establish numeric global warming potential (GWP) limits for each of the EPA-approved construction materials: concrete
(and cement), asphalt, steel, and glass (IRA-Eligible Materials). For each IRA-Eligible Material, GWP limits have been established for the best performing 20% of materials in terms of embodied carbon, as reported in terms global warming potential (Top 20% Limits), the best performing 40% of materials in terms of embodied carbon (Top 40% Limits) and better than industry average (Better Than Average Limit). In accordance with its proposal, Contractor shall provide all IRA-Eligible Materials required for performance of the Contract in compliance with the following IRA Limits.
