About this file

This is a sample Labor and Material Payment Bond template, a standard surety instrument used in construction contracting by government agencies including the City of Meriden, Connecticut, for projects such as the Pulaski Gymnasium Floor Replacement. The bond serves as a guarantee that the principal contractor will promptly pay all claimants—including laborers, material suppliers, and subcontractors—for work performed and materials supplied in connection with the contract. The bond protects the project owner and ensures payment to all parties involved in the construction effort. Claimants are defined as those with direct contracts with the principal or subcontractors and include provisions for water, gas, power, light, heat, oil, gasoline, telephone service, and rental equipment directly applicable to the contract. Claimants who have not been paid in full within ninety days after completion of their work or supply of materials may initiate legal action against the bond. The bond remains in effect for one year following the date the principal contractor ceases work on the contract, subject to any state law modifications that mandate longer limitation periods.

The bond amount is to be determined and inserted at execution, and the surety agrees jointly and severally with the owner that claimants may pursue litigation in state court of competent jurisdiction in the county or political subdivision where the project is located or in the applicable United States District Court. Notice of claims must be provided to at least two of the following parties—the principal, owner, or surety—within ninety days of the claimant's final work performance or material delivery, stating the claim amount and the recipient of materials or services with substantial accuracy. The bond amount is reduced dollar-for-dollar by any payments made in good faith, including payments by the surety for mechanics' liens filed against the improvement. For the Pulaski Gymnasium Floor Replacement project, the bond must equal 100 percent of the lump-sum bid amount, which is estimated at $30,000.00, ensuring comprehensive protection for all labor and material payment obligations throughout the project timeline extending from June 29, 2026, through August 7, 2026.
