About this file
This is a Bid Bond form for Napa County, California, establishing the bonding requirements for contractors submitting bids on county projects. The form establishes that bidders must provide a bid bond issued by a licensed surety insurer as a condition of bid submission. The bond secures the principal contractor's obligation to execute a written contract if awarded and to file the required performance and payment bonds within the specified timeframe. The bid bond amount is set at ten percent (10%) of the total bid amount submitted to the Napa County Board of Supervisors. The form references compliance with state specifications and project-specific requirements, and obligates both the principal and surety to fulfill contractual commitments in accordance with the bid specifications and State of California Department of Transportation standards adopted by Napa County.
The surety's liability under the bond is capped at the specified penal sum, with provisions requiring the surety to pay all costs incurred by the county in the event of litigation, including reasonable attorney's fees as determined by the court. Both the principal contractor and surety must execute the bond with signatures acknowledged before a notary public. This bond form applies to the Napa County Animal Shelter Phase I Furnace Replacement project, which involves replacing two existing furnaces at the facility, installing a gas line seismic shutoff valve, and associated work. The bond ensures contractor performance and protects the county's interests should the awarded bidder fail to enter into the contract or file the required performance and payment bonds following bid acceptance.
