B.3 STATEMENT OF WORK

Kitchen Equipment Maintenance, Repair, and Emergency Services

1. Introduction

i. The purpose of this Statement of Work (SOW) is to establish requirements for comprehensive preventive maintenance (PM), corrective repairs, emergency services, testing, calibration, and technical support for all kitchen and dietary equipment at the

Mann-Grandstaff VA Medical Center (MGVAMC), 4815 N Assembly Street, Spokane

WA 99205.

ii. The Contractor shall furnish all labor, materials, tools, transportation, and qualified technicians to ensure safe, reliable, and continuous operation of all food service equipment.

2. Scope of Work

i. The Contractor shall perform scheduled PM, corrective repairs, and emergency response services in accordance with OEM specifications, VA Directives, VHA policies, NFPA, OSHA, and FDA standards.

ii. Services include cleaning, inspection, testing, lubrication, calibration, performance verification, and use of OEM or OEM-equivalent parts.

iii. Work Hours: Normal Work Hours are defined as Monday through Friday from 7 a.m. to

3:30 p.m., excluding federal holidays.

iv. Corrective repairs are any standard repairs that are not an emergency or high priority which are defined below.

v. An emergency response is any equipment failure that interrupts food safety or patient dietary service, causes risk of fire, contamination, or facility damage, impacts critical refrigeration, cooking, or sanitization equipment, represents a safety hazard requiring immediate correction or any other identifiable reason at the discretion of the Government

Point of Contact (POC) and/or Contracting Officer Representative (COR).

3. Contractor Responsibilities and Tasks

i. The Contractor shall provide fully certified technicians, maintain compliance with VA safety and access requirements, provide all tools and test equipment, maintain jobsite cleanliness, and notify Engineering Service immediately of any safety hazards or critical failures.

ii. The Contractor shall coordinate all scheduling in advance with Nutrition & Food

Services. Proposed scheduled PMs for the year are due 15 business days after award and within 15 business days after the start of each option period.

iii. The Contractor and any Subcontractor shall report to the Government POC or COR when arriving to perform any service under this requirement, including repairs. Check-in/out is mandatory at VA Police to obtain temporary badge unless the individual completes security background and obtains a flash badge at the request of the COR.

When the service is completed, the Contractor and any Subcontractor shall check out with the Government POC as well. Labor hours for Time-and-Material line items discussed below are validated using check-in/out logs and COR tracking;

therefore, this practice is mandatory.

iv. The Contractor shall coordinate with any applicable Subcontractor directly for any tasks associated with SOW. It is the responsibility of the Contractor to ensure Subcontractor performs all work in accordance with the SOW.

v. The Contractor shall comply with all applicable Federal, State, and local laws and regulations to include responsibility to conform by current Occupational, Safety, Health

Administration (OSHA) & Environmental Protection Agency (EPA) regulations while working on this facility.

vi. The Contractor shall take all precautions necessary to protect persons and property from injury or damage during the performance of this contract. The Contractor shall leave areas where he performs work neat, clean and orderly. All damage done by the

Contractor shall become the Contractor’s responsibility and expense.

vii. Contractor and Subcontractor staff shall conduct business professionally while on site and take any cautions from the Government POC and/or COR in order to minimize patients and staff disruptions.

viii. Specific tasks regarding corrective repairs and emergency services:

a. The corrective repairs and emergency services are considered Time-and-

Material (T&M) line item for base and each option year. These line items shall not to be used for any regular scheduled PMs, inspections, deliverables, other associated tasks or any re-work/corrections due to Contractor’s deficiencies.

b. Upon request and approval of the COR, the Contractor shall perform corrective repairs and emergency services. Each request and approval shall be documented with an initial Condition Found Report (CFR) provided by the COR – see Appendix A, with general details for the Contractor to complete.

c. Upon Contractor’s receipt of a CFR, the Contractor shall submit the following information on the CFR to the COR before work is approved to begin:

i. Contractor information, including Contractor POC and contact information.

ii. Location information for deficiency.

iii. Information explaining the deficiency.

iv. Recommendation for either repair, replacement, or no action.

v. Detailed cost breakdown, including:

1. Labor costs; number of direct labor hours, straight time; broken down by specific direct production labor category.

2. Material costs; broken down by a detailed bill of materials identifying description of materials, quantity of materials, cost of materials, and source of materials.

3. Nondirect production labor is not permitted ( this includes any and all labor associated with administration, quote preparation, supervision/project management, etc.). Only specific direct production labor categories incorporated at the time of award are permitted. It is the Contractor’s responsibility to ensuring direct production labor categories are fully burdened.

4. Travel reimbursement is not permitted.

5. Lump sums will not be acceptable.

vi. Name and signature of contractor employee providing cost estimate to the Government.

vii. After request and approval is received by the COR, Contractor shall respond in accordance with response times outlined below. For emergency repairs, it is recommended the technician prepare the

CFR on site, receive approval from the COR on site and begin work immediately if feasible to do so.

d. Contractor shall closely monitor actual work performed. If actual work exceeds

CFR estimate by more than 10%, the Contractor shall notify and receive approval from the COR to continue. Any major changes and daily status shall also be communicated to the COR as work is performed.

e. Contractor shall at its best control all labor and material costs associated with corrective repairs and emergency services.

f. At the end of each corrective repair or emergency service, Contractor shall submit documentation to the COR that shows a completed CFR and complete invoice breakdown of work actually performed. Documentation shall include the following information in a standardized format: task description, location, day and time of hours worked, number of hours worked, itemized materials used and material markup. All material pricing must be supported with separate receipt copies, as applicable. Material may include any applicable taxes, shipping, setup fees, etc. but these shall be itemized on the receipt. Only labor categories with straight time amount incorporated on contract may be used. Overtime rates are not permitted.

g. Contractor is responsible for tracking and certifying all labor hours are true and correct at submission.

h. Government has the right to reject any incomplete, inaccurate and lump sum labor and material pricing breakdowns submitted as part of T&M documentation.

Government has the right to audit Contractor’s submission for inaccuracies, abuse and request corrections. Contractor shall provide any necessary corrections within 10 business days and resubmit to the COR. Government may use observation, CCTVs, visitor log-in/out records, etc. to verify labor hours records are true and correct. In the event of lack of consensus on T&M

Documentation that cannot be resolved between COR and Contractor, the

Contracting Officer shall review all documentation and make final decision.

i. Contractor may not exceed the ceiling price as identified on each line item except at their own risk.

j. Contractor shall monitor T&M line items and report to COR when additional funding may be required for future repairs. Once additional funding is received, the CO may process a modification, to be mutually agreed upon, to increase the line item.

ix. Contractor shall provide an emergency response POC with phone number within five (5) business days of award to the Government POC and/or COR.

x. See Section 8. for specific tasks on each equipment item.

4. Safety & Compliance Requirements (NFPA, OSHA, FDA, VA Directives)

i. All work must comply with NFPA 70, NFPA 96, OSHA 1910, FDA sanitation requirements, VHA Directives 1105, 7701, 7002, and MGVAMC infection control policies.

ii. Lockout/Tagout, PPE, hazard identification, and refrigerant handling requirements shall be followed. PPE is not provided by the government.

5. QA/QC Performance Standards

i. The Contractor shall implement a Quality Control Plan (QCP) including internal inspections, technician competency management, PM compliance tracking, and parts validation.

ii. QCP shall be submitted to the Government Point of Contact (POC) and Contracting

Officer (CO) within 30 days of award.

iii. The Government will evaluate performance using a Quality Assurance Surveillance Plan

(QASP) and a Performance Requirements Summary (PRS). Performance standards include:

a. 95% PM completion on schedule.

b. Emergency and high priority responses shall be next business day, within 24 hour time period or by 8:00am the next open business day if the next day is a weekend day or holiday (i.e. if an emergency response is requested on Friday at

4:00pm, the Contractor shall arrive by 8:00am on Monday).

c. Other standard corrective repairs shall be within 72 hours depending on the type, and then complete documentation within 24 hours unless otherwise approved by the COR. See item 7. below for reporting requirements.

iv. The Government reserves the right to make any test or inspection it deems necessary to make sure that all performance requirements are maintained.

v. The Contractor and COR will work together to resolve deficiencies. Work not completed or not acceptable under general industry standards cannot be certified for payment.

vi. Government does not pay for services not received.

6. Technician Certification Requirements

i. Technicians must hold OEM training or CFESA certification, possess EPA 608 credentials for refrigeration handling, and demonstrate competency in electrical, mechanical, gas, steam, and control system diagnostics. Contractor shall provide certification records upon request to Government POC and CO.

7. Documentation & Reporting Requirements

i. The Contractor shall submit complete service reports to the Government POC and/or

COR within 24 hours of work completion, including equipment identifiers, test readings, tasks completed, parts replaced, performance results, safety verification, and future recommendations. Emergency repairs require immediate notification and follow-up reporting. See section 3. Contractor Responsibilities and Tasks for further details.
