About this file
This is an employee rights notice issued by the U.S. Department of Labor's Wage and Hour Division regarding the Davis-Bacon Act, applicable to laborers and mechanics employed on federal or federally assisted construction projects. The notice outlines mandatory wage and labor requirements that contractors must comply with, including payment of prevailing wage rates as specified in the Davis-Bacon Wage Decision posted with the solicitation, overtime compensation at no less than one and one-half times the basic rate of pay for hours exceeding 40 per week, and apprentice rates applicable only to properly registered apprentices under approved Federal or State apprenticeship programs.
The document emphasizes enforcement mechanisms available to ensure compliance, including contract payment withholding, liquidated damages for overtime violations, contract termination, and debarment from federal contracts for up to three years. Contractors who falsify certified payroll records or induce wage kickbacks face potential civil or criminal prosecution, fines, and imprisonment. The notice provides contact information for inquiries regarding applicable wage rates: Daniel P. Kinney, Contract Specialist at the Department of Veterans Affairs National Cemetery Administration (daniel.kinney@va.gov, 402-830-4683), or the U.S. Department of Labor's Wage and Hour Division (1-866-487-9243, TTY: 1-877-889-5627, www.dol.gov/whd).
