About this file

This document contains two sections related to a VA solicitation for a Service-Disabled Veteran-Owned Small Business set-aside contract. The first section details Safety and Environmental Record requirements for bidders/offerors, mandating that companies must have:

  1. No more than three serious, or one repeat or willful OSHA/EPA violations in the past three years
  2. An Experience Modification Rate (EMR) equal to or less than 1.0, verified by insurance carrier letterhead or NCCI form ERM-6
  3. Compliance with these requirements is critical, as failure to submit or meet these guidelines will result in a "Non-Responsibility" determination and contract ineligibility

The second section addresses Limitations on Subcontracting, Monitoring, and Compliance, indicating that the VA may use support contractors to assess the prime contractor's compliance with subcontracting requirements. Support contractors must sign non-disclosure agreements and may require access to the contractor's business records to verify performance requirements, with the contractor obligated to fully cooperate and make records available for review.
