About this file

This document is a Green Procurement Memorandum from Vladimir Stoyanov (Contracting Officer) to Sharon Pierce (Supervisory Contract Specialist) regarding the Department of Veterans Affairs contract opportunity VA36C24226Q0095 for a Sewage Ejector Pump replacement. The memorandum critically highlights non-compliance with Executive Order 13693's green procurement requirements, specifically noting that neither the design engineer nor the Contracting Officer's Representative (COR) followed the mandated green procurement guidelines from the VA's green resources website or the sustainable procurement tool (sftool.gov).

The contract involves a sewage ejector pump replacement for the Veterans Health Administration's Veterans Integrated Service Network 2, with the memorandum dated 05/20/2021. The key issue raised is the complete absence of green procurement implementation strategies in the project's documentation, design, and procurement packages, which represents a significant deviation from federal sustainability procurement mandates outlined in Executive Order 13693.

P11 GREEN PROCUREMENT MEMORANDUM

Department of Memorandum Veterans Affairs

From: Vladimir Stoyanov (CO)

Subj: Green Procurement Implementation (Executive Order 13693 )

To: Sharon Pierce (Supervisory Contract Specialist)

After a close review of the contract file, I must state that Executive Order 13693 (https://www.gpo.gov/fdsys/pkg/FR-2015-03-25/pdf/2015-07016.pdf )was not incorporated into this project's design/construction/procurement documentation packages. None of the directions listed on https://www.va.gov/oal/business/pps/greenResources.asp#four were followed by the design engineer and/or requesting service, and none of the items listed on https://sftool.gov/GreenProcurement were specified for this project.

None of the requirements listed above were followed and/or addressed by the design engineer, nor were they enforced by the requesting service and/or the COR of record. COR refused to follow and/or enforce the requirements listed above.
