12. VHA SUPPLEMENTAL CONTRACT REQUIREMENTS FOR COMBATTING COVID-19
1. Contractor employees who work in or travel to VHA locations must comply with the following:
a. Documentation requirements:
1) If fully vaccinated, contractors shall show proof of vaccination.
i. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination.
2) If unvaccinated, contractors shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor’s order or an FDA approved over-the-counter test that includes an affiliated telehealth service.
3) Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel.
4) Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.
2. Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates.
a. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. 3. Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities.
1. For indefinite delivery contracts: Contractor agrees to comply with VHA Supplemental Contract Requirements for any task or delivery orders issued prior to this modification when performance has already commenced.
13. SECURITY & PRIVACY CONTROL:
All contractor employees are subject to the same level of investigation as VA employees who have access to VA Sensitive Information. The level of background investigation commensurate with the level of access needed to perform in accordance with the performance work statement is: National Agency Check with Inquiries (NACI) (below VA-PSAC TIER 2 AO). This requirement is applicable to all subcontractor personnel requiring the same access. Fees are the responsibility of the Contractor and will be billed accordingly.
B.2 PRICE SCHEDULE
1. Pricing Information
Contractor must provide a fixed monthly price that is inclusive of all transports, (both wheelchair and sedan) at Jesse Brown VA Medical Center for a base year and four option years. Monthly fixed pricing shall include all costs (e.g. labor, insurance, fuel, wait time, no loads, tolls, etc.). Proposals that delineate separate costs (e.g., for excess mileage, wait times, etc.) will not be entertained. A monthly fixed price will enable VA to schedule as many trips as needed up to the monthly trip ceiling identified for each month with no additional charges. The monthly ceiling varies by month. See chart on page 11.
The monthly trip ceilings represent the maximum number of trips the contractor may be required to perform in a given month. The number of actual trips required per month will fluctuate and typically fall below the monthly trip ceiling. Therefore, as illustrated in the sample schedule below, the Department of Veterans Affairs (VA) requests that offerors propose a range of discounts that will be applied to the flat monthly price that takes into consideration the actual trips taken. We refer to these ranges as “Discount Tiers.” Each offeror is free to propose as many “discount tiers” in varying ranges as it deems practicable for which there are corresponding discount amounts. Discounts are not required, but offerors who propose discounts may have a significant price advantage over those who do not.
VA requests that offerors propose the following:
1. An all-inclusive price for each monthly-priced line item and;
(2) If it elects to do so, discount amounts for each “Discount Tier” that can be applied to the monthly priced line item. Each Discount Tier should be composed of a range of trips up to but not including the monthly trip ceiling OR a range of trips that includes the monthly trip ceiling (for which there would be no discount).
The sample schedule below reflects a fixed monthly price along with associated discount amounts for each discount tier. The monthly price for October (which is based on a monthly ceiling of no more than 3055 trips provided) is $305,500. This imaginary offeror has decided to offer a discount when the number of actual trips provided during the month falls below the ceiling. In this example, the discount tiers include 100 trips in each range. So, if during the month of October, the contractor only performed 2,149 trips, Discount Tier 10 would be applicable, and the contractor would apply a $90,100 discount to the fixed monthly price of $305,500, resulting in an invoiced amount of $215,400 for that month.
SAMPLE SCHEDULE
In the sample schedule below, cells that represent trip totals that exceed that month’s trip ceiling are blackened out, so that only the blank cells are completed with proposed sicounts.

While each range in this example contains 100 trips, the offeror is free to include as many trips as it desires in each range, and each range does not have to contain the same number of trips. For example, an offeror is free to propose a range in one tier that includes 34 trips, and the next tier may have a range that includes 110 trips. The VA will not limit the number of Discount Tiers an offeror may propose, and an offeror is not required to propose any discounts at all (for instance it may decide to price each month at such a competitive price that it would amount to a better value to VA than another offeror’s pricing with discounts). The VA recognizes as well that discounts may not be economically feasible below a certain minimum number of trips per month, based on an offeror’s pricing model. The contractor may, but is not required to, perform monthly trips in excess of the monthly trip ceiling, but the contractor will not be paid additional compensation for these excess trips if performed under this contract. Instead, if both parties agree, provision of trips that are in excess of the monthly trip ceiling amounts may be authorized outside this contract and paid for by the VA under a “1358 Obligation” as permitted in accordance with Department of Veterans Affairs Financial Policy Vol. II Chapter 6.
The following estimated data is provided to assist Contractors in preparing proposed pricing. These figures are estimates, based upon historical usage and forecasted changes, are not intended to identify an exact number of trips that will be ordered under the contract.
