L-3
AGREES TO BE BOUND BY THE FOLLOWING PROVISIONS RELATING TO
PROTESTS:
(a) Protests concerning Federal Aviation Administration Screening Information Requests (SIRs) or awards of contracts shall be resolved through the Federal Aviation Administration (FAA) dispute resolution system at the Office of Dispute Resolution for Acquisition (ODRA) and shall be governed by the procedures set forth in 14 C.F.R. Parts 14 and 17, which are hereby incorporated by reference. Judicial review, where available, will be in accordance with 49 U.S.C.
46110 and shall apply only to final agency decisions. A protestor may seek review of a final FAA decision only after its administrative remedies have been exhausted
(b) Offerors initially should attempt to resolve any issues concerning potential protests with the Contracting Officer. The Contracting Officer should make reasonable efforts to answer questions promptly and completely, and, where possible, to resolve concerns or controversies. The protest time limitations, however, will not be extended by attempts to resolve a potential protest with the Contracting Officer.
(c) The filing of a protest with the ODRA may be accomplished by mail, overnight delivery, hand delivery, or by facsimile or if permitted by order of the ODRA, by electronic filing. A protest is considered to be filed on the date it is received by the ODRA during normal business hours. The ODRA's normal business hours are from 8:30 am to 5:00 pm Eastern Time.
(d) Only an interested party may file a protest. An interested party is one whose direct economic interest has been or would be affected by the award or failure to award an FAA contract.
Proposed sub-Offerors are not "interested parties" within this definition.
(e) A written protest must be filed with the ODRA within the times set forth below, or the protest shall be dismissed as untimely:
(1) Protests based upon alleged improprieties in a solicitation or a SIR that are apparent prior to bid opening or the time set for receipt of initial proposals shall be filed prior to bid opening or the time set for the receipt of initial proposals.
(2) In procurements where proposals are requested, alleged improprieties that do not exist in the initial solicitation, but which are subsequently incorporated into the solicitation, must be protested not later than the next closing time for receipt of proposals following the incorporation.
(3) For protests other than those related to alleged solicitation improprieties, the protest must be filed on the later of the following two dates:
(i) Not later than seven (7) business days after the date the protester knew or should have known of the grounds for the protest; or
(ii) If the protester has requested a post-award debriefing from the FAA Product Team, not later than five (5) business days after the date on which the Product Team holds that debriefing.
L-4
(f) Protests shall be filed at:
(1) For filing by hand delivery, courier or other form of in-person delivery:
Office of Dispute Resolution for Acquisition Federal Aviation Administration 600 Independence Avenue SW., Room 2W100 Washington, DC 20591; or

(2) Other address as specified in 14 CFR Part 17.
(g) At the same time as filing the protest with the ODRA, the protester shall serve a copy of the protest on the Contracting Officer and any other official designated in the SIR for receipt of protests by means reasonably calculated to be received by the Contracting Officer on the same day as it is to be received by the ODRA. The protest shall include a signed statement from the protester, certifying to the ODRA the manner of service, date, and time when a copy of the protest was served on the Contracting Officer and other designated official(s).

3.14-8 Non-FAA Information Systems (July 2017)
(a) For all non-FAA Information systems (including those from cloud services providers) to be used under this contract, Offerors must disclose with their proposal all countries where FAA data and information is to be stored, processed, backed up to, or if the data and information is transmitted through an international processing hub or exchange.
(b) Offerors must disclose to the FAA with their proposal, the country of ownership (if more than 50% foreign-owned) for all sub-Offerors and third parties that will process, store, or backup the data and information.
L-5
(c) If an international processing hub or exchange is involved or there are foreign-owned sub- Offerors or third parties, Offerors must provide to the FAA with their proposal, the details of the security measures for how the Offeror, sub-Offeror, and third party processing facilities will protect the FAA data and information at the sub-Offeror or third party processing facility.
L.3 POINTS OF CONTACT
The Contracting Officer (CO) is the sole point of contact for this acquisition. All questions or concerns must be submitted in writing via email and addressed to the Contracting Officer, Krystalyn Wacyra at krystalyn.wacyra@faa.gov, with a courtesy copy to Patrick Weare, Contracting Officer, at patrick.weare@faa.gov.
L.4 COMMUNICATION WITH OFFERORS
The FAA may, at any time and within its sole discretion, communicate orally or in writing with Offerors on an individual basis to clarify particular aspects of their proposal, to negotiate the terms and conditions of the proposed contract, or to seek clarification or additional information regarding Offerors’ submissions. Communication with potential Offerors may take place throughout the source selection process. The purpose of communications is to ensure mutual understandings between the FAA and the Offerors on all aspects of the procurement, including the Offerors’ proposals. Communications with one Offeror does not necessitate communications with other Offerors. Information disclosed as a result of oral or written communication with an Offeror may be considered in the evaluation of an Offeror’s proposal. The FAA also reserves the right to allow Offerors to revise their proposals. The FAA is not required, however, to request clarifications or accept offeror revisions. Additionally, Offerors are advised that the FAA reserves the right to make an award based on initial proposals received without communications.
Accordingly, Offerors are strongly encouraged to ensure that their proposals are complete and fully responsive to the SIR upon initial submission.
All communications will be conducted through the FAA CO. Each Offeror must provide in its submission cover letter: a point of contact, telephone number, and email address for purposes of initiating all communications.
L.5 NOTIFICATION OF AWARD AND DEBRIEFING OF UNSUCCESSFUL
OFFERORS
In accordance with FAA Acquisition Management System (AMS) 3.2.2.3.1.4, Debriefing, all offerors who participated in the competitive process will be notified of the award and given three
(3) working days from the receipt of the award notification to request a debriefing. Written notice to unsuccessful Offerors and contract award information will be promptly provided upon contract award.
Debriefings will be conducted only after completion of source selection activities and award of the contract.
mailto:krystalyn.wacyra@faa.gov
L-6
Debriefings are conducted with the goal of helping offerors identify areas where changes can be made to improve future source selection participation. To that end, source selection debriefing will be conducted with only one offeror at a time. The debriefing will be confined to discussion of the Offeror’s proposal only. A point-by-point comparison with other Offerors proposals will not be made. The debriefing will neither discuss nor reveal the relative merits, nor will it reveal the evaluation. In addition, debriefings will not reveal any information prohibited from disclosure or exempt from release under the Freedom of Information Act.
Prior to and/or during the debrief, time will be provided for the Offeror to ask questions. Every effort will be made to answer all questions at the debriefing or as soon as feasible. The FAA reserves the right to conduct an oral debriefing or a debriefing solely in writing.
L.6 DISPOSITION OF PROPOSALS
Proposals will not be returned. A copy of the proposal will be retained in the official contract file and the remaining copies will be destroyed or deleted.
L.7 NUMBER OF AWARDS
The FAA intends to award one contract as a result of this SIR. However, the FAA reserves the right to make multiple or no awards if it considers that to be in the FAA’s best interest.
To be eligible for the award, an Offeror must meet all requirements of the SIR. However, the FAA reserves the right to reject any and all offers, or waive minor irregularities and discrepancies, if it is in the best interest for the FAA to do so.
L.8 RESPOSIBILITY DETERMINATION OF PROSPECTIVE CONTRACTORS
To be eligible for award, an Offeror must be determined by the Contracting Officer to be a responsible contractor in accordance with the FAA Acquisition Management System (AMS), Section T.3.2.2.7 – Contractor Qualifications and this SIR Section M.2. The FAA will consider the elements identified below to determine a potential contractor’s responsibility. Offerors must provide substantiating information to support their assertions as described in Section L.17. Failure to provide the requested information with the proposal submission will eliminate the Offeror from consideration for award. The FAA’s analysis is not limited to consideration of the information provided by the Offeror; the FAA may use information gleaned from other sources when making the responsibility determination.
In accordance with AMS Section T.3.2.2.7, a responsible contractor:
(1) Has or can obtain adequate financial resources to perform a contract;
(2) Has the ability to meet any required or proposed delivery schedules;
(3) Has a satisfactory performance history;
(4) Has a record of integrity and proper business ethics;
L-7
(5) Has appropriate accounting and operational controls that may include, but are not limited to:
(a) Production control;
(b) Property control systems;
(c) Quality assurance programs;
(d) Appropriate safety programs; and
(6) Is qualified and eligible to receive an award under applicable laws or regulations.
L.9 NON-GOVERNMENT PERSONNEL PARTICIPATION
Offerors are notified that individuals from support contractor organizations (including employees, consultants, and subcontractors) may support the FAA in the evaluation of proposals, including reviewing proposals, and may act as advisors. These organizations will not be eligible to participate on Offeror teams. The FAA currently intends for the following companies to be the only support contractors, but reserves the right to include others:
• Constellation Aviation Solutions, LLC
• MCR, LLC
• Arctic Slope Regional Corporation (ASRC)
• INCATech
If the Government decides to use support contractors other than, or in addition to those listed above, the CO will notify Offerors in writing of this decision.
Individuals employed by these firms will be required to sign nondisclosure agreements (NDAs) and Conflict of Interest Disclosure Forms before the evaluation process begins and will be authorized to access only those portions of the proposal data, communications, and evaluation materials that are necessary to enable them to provide the required support. If an Offeror objects to the disclosure of information to these non-Government individuals, it must notify the CO in writing no later than 15 calendar days after SIR release and must include a detailed statement with the basis of the objection.
The exclusive responsibility for source selection remains with the FAA.
L.10 GENERAL SIR INSTRUCTIONS
L.10.1 Compliance with Instructions
Offerors must comply with all instructions in Section L when developing proposals. Failure to comply with the instructions may result in a determination that the Offeror’s proposal is non-compliant and may be excluded from further consideration. This determination will be made at the sole discretion of the FAA, and may be made without prior communication with the Offeror.
Proposals must conform to all incorporated AMS clauses and provisions and be prepared in accordance with this section L. To aid in the evaluations, proposals must be clearly and concisely
L-8 written, as well as neat, indexed (cross-indexed, as appropriate), and logically assembled. All material submitted should be directly pertinent to the requirements of this SIR.
Offerors must adhere to all terms and conditions of this SIR. Any objection to any of the terms and conditions will constitute a deficiency, which may make the offer unacceptable. Any deviations and/or exceptions to any requirements listed in this SIR must be identified by the Offeror at the time of proposal submission and submitted in proposal Volume VI, as set forth in Section L.18.11. The FAA reserves the right to award this contract without communications after evaluation of initial written submissions. The FAA also reserves the right to conduct Offeror-specific communications/discussions as needed and permit Offerors to revise their proposals, if the CO deems this appropriate and is in the best interest of the FAA. The FAA reserves the right to reject any exception for any reason.
L.10.2 Expenses Related to Offeror Submissions
The FAA is not responsible for and will not pay or reimburse any costs incurred by the Offeror in the development, submission, or any other part of the offer under this SIR. This includes costs associated with any aspect of the proposal activity, and any research, studies, or designs carried out for the purpose of incorporation into any part of the offer. This also includes any costs to acquire or contract for any services or product relating to the offer under this SIR. Furthermore, no pre-contract costs will be allowed on this contract. Pre-contract costs are defined as any costs incurred at the Offeror’s risk in anticipation that any such costs may later be charged to any resulting contract.
L.10.3 Alternate Proposals
Alternate proposals are not authorized and will not be accepted or considered.
L.10.4 SIR Questions, Concerns, and Clarifications
The Contracting Officer (CO) is the sole point of contacts for this acquisition. Offerors must direct general questions, concerns, and clarifications to the CO listed in Section L.3.
Any questions or requests for clarifications concerning any aspect of the SIR must be emailed, utilizing Attachment L-X, Question/Comment Matrix, and submitted to krystalyn.wacyra@faa.gov, with a courtesy copy to patrick.weare@faa.gov no later than 2:00 p.m. Eastern Time on XX, 2023. Questions must make reference to the applicable page number, section, and paragraph of the SIR. Offerors’ questions and the responses by the FAA may form the basis of an amendment to the SIR. Please be advised that the FAA will post responses to all questions on the www.SAM.gov website.
Written inquiries received within this timeframe will be answered in writing and provided to all Offerors prior to the required date for submittal of the Offeror proposals. The FAA reserves the right to not answer any requests received outside of the above timeframe. Furthermore, Offerors should note that the proposal due date will not be extended solely on the basis of questions mailto:krystalyn.wacyra@faa.gov mailto:patrick.weare@faa.gov
L-9 received within or beyond the timeframe mentioned above. The FAA will not provide verbal responses to Offeror questions, concerns, and clarification requests initiated via Offeror telephone calls.

(P) 202-267-5483
• ELECTRONIC COPIES: An electronic file must be provided on a flash drive for each proposal volume and included within the original of each volume. Each proposal volume must be in its own file. Offerors must not password protect or compress (e.g. zip) any submitted files. The file name must adhere to the following naming convention using the Volume/Part names listed in Table L-2:
• “Offeror Name - ETR VOL # - Volume/Part Name”
• Examples:
L-10
ABC Company – RWSL VOL I – Technical Proposal ABC Company – RWSL VOL IV – Price Proposal – Section 3 Detailed Narrative and Supporting Cost/Price Documentation
• The FAA will only use Adobe Acrobat Pro DC 2015 Release, or Microsoft Excel 2016 software to read and evaluate Offeror proposals. The FAA has no special software or monitors to review diagrams, drawings, or illustrations such as those created using Computer Aided Design and Manufacturing (CAD/CAM). Submitted proposals that are not compatible with the Adobe Acrobat Pro DC 2015 Release, or Microsoft Excel 2016, will not be evaluated.
If the identified CO or its designated alternate, as identified in Section L.3, does not receive a proposal by the specified date and time, the proposal may not be evaluated. Offerors assume full responsibility for ensuring that the appropriate authority receives proposals not later than the date and time specified above.
L.12 PROPOSAL PREPARATION AND GENERAL FORMAT INSTRUCTIONS
This section provides general guidance for preparing proposals, as well as, instructions on format and content of the proposal. In addressing Section L’s requirements, Offerors must ensure that all aspects of the Factors in Section M are addressed. Replies to the SIR must follow the outlines and instructions concerning the format given in Section L.
L.12.1.1 General Proposal Preparation Instructions
The Offeror must include a cover submittal letter with the proposal. The submittal letter must include the Offeror’s acknowledgement of any and all SIR amendments in accordance with AMS 3.2.2.3-12 Amendment Screening Information Requests (July 2004).
Proposals must include supporting rationale, substantiation of all claims, and factual information to facilitate the FAA’s evaluation. Proposals should be specific enough to provide the FAA evaluators with enough information to be able to judge the technical and financial ability of the Offeror to conduct this contract and meet all requirements.
General statements that the Offeror understands the requirements of the work to be performed or simple rephrasing or restating the FAA’s requirements will not be considered adequate and may result in weaknesses, risks, and/or lower evaluation scores or may be cause for rejection of the proposal and/or result in the Offeror being eliminated from consideration for the contract award.
Proposals must contain enough detail to enable the FAA evaluators to determine the ability of the Offeror and the proposed solution to meet the SIR requirements. Lack of detail in a proposal may be deemed a weakness or risk by evaluators. Offerors must not assume that they will be contacted or afforded an opportunity to clarify, discuss, or revise their proposal if FAA evaluators identify omissions, ambiguity, or lack of detail. Submittals
L-11 containing omissions or incomplete responses to the requirements of this SIR, or that merely paraphrase the Statement of Work, or that use nonspecific phrases such as "in accordance with standard procedures" or "well-known techniques" will also be considered inadequate and may result in weaknesses, risks, and/or lower evaluation scores or may be cause for rejection of the proposal and/or result in the Offeror being eliminated from consideration for the contract award.
It is the Offeror’s responsibility to ensure the completeness of its proposal. The evaluation of proposals will be conducted on the basis of the information contained in the written proposal, communications (to the extent the FAA elects to engage in communications), and past performance information received from other sources, if any. Offerors should assume that the FAA has no prior knowledge of their proposed solution, capability, and/or experience and that the FAA will base its evaluation on the information presented by the Offeror. The Government will not assume that an Offeror possesses any capabilities not specified in the proposal. Offerors are strongly encouraged to ensure that their proposals are complete and fully responsive to the SIR upon initial submission.
The Offeror must mark any data that may contain trade secrets, copyright data, or financial information that the Offeror or proposed team members do not want to be disclosed for any purpose other than the evaluation of the proposal. The markings should be in accordance with Clause 3.2.2.3-16, Restricting, Disclosing, and Using Data (July 2004). Owing to the FAA’s obligations under federal law, including the Freedom of Information Act (FOIA), the FAA may require the Offeror to provide justification for its assertion that certain material should be treated as exempt from disclosure.
The proposal must be signed by an official who is legally authorized to obligate the Offeror to a contract.
L.12.1.2 Proposal Organization
Offerors must assemble and identify volumes in accordance with Table L-2 Proposal Volume Requirements. Offerors must ensure that all volume titles and associated content are compiled and delivered within the page limitations shown below.
Pricing information may only be included in Volume IV and must not be included within any other volume. If pricing information is included within other volumes, the FAA reserves the right to exclude the proposal from the evaluation.

The font used for text must be Times New Roman, size 12 point. Tables, charts, graphics, and figures must not use fonts smaller than 9 points. Top, bottom, left, and right margins must be no less than 1.0 inch.
A page is defined as one face of a sheet of paper containing information. The proposal pages must be numbered sequentially. Any items embedded within a document must be objects only, not links.
Proposal submissions must not exceed any page limitations established for the individual volumes. Any submission exceeding a page limitation will only be evaluated up to the established page limitation.
L.12.1.3 Binding and Labeling
L-14
Offerors must label the cover page of each Proposal Volume with the Proposal Volume Number and the Offeror contact information including a Point of Contact (POC), telephone number, and an email address.
Each volume must be contained in a separate binder and must be separate and complete in and of itself so that evaluation of one may be accomplished independently of the other. A cover page must be affixed to each volume that clearly identifies each volume, volume number, solicitation number, and Offerors’ name. Whenever practical, enclosed headings, subheadings, titles, sequence of material and a number identification system must be used. Each volume must be organized such that a search of Government-required documents is not necessary to review the proposal. Information not in its appropriate section or not appropriately referenced may be assumed to have been omitted and potentially not evaluated. Cost or pricing information must not be included in any volume other than Volume IV (Cost and Price).
L.12.1.4 Cross-Referencing
Each volume, other than the Cost volume, must be written to the greatest extent possible on a stand-alone basis without cross-referencing to other volumes of the proposal. Minimal cross-referencing within a proposal volume is permitted where its use would conserve space without impairing clarity. Hyperlinking of cross-references is permissible. Information required for proposal evaluation that is not found in its designated volume or clearly cross-referenced is assumed omitted from the proposal and will not be considered for evaluation as part of that Factor. Heavy reliance on cross-referencing is not permitted, and an Offeror’s use of cross-referencing risks the FAA deeming information omitted from the proposal. The Offeror must clearly identify each piece of information that is intended to satisfy a requirement and/or specification as being submitted in response to that requirement or specification. In other words, the Offeror should not expect the FAA to search for potentially responsive information across more than one volume. The Offeror must explicitly make clear—by referencing the appropriate requirement and/or specification—each piece of information the Offeror wants the FAA to consider when evaluating the Offeror’s solution to that requirement and/or specification.
L.12.1.5 Glossary
Each volume must contain a consolidated glossary of all abbreviations and acronyms used in all volumes, with an explanation for each. Glossaries do not count against the page count.
L.12.1.6 Indexing
Each volume must contain a table of contents to delineate the subparts within that volume. Tab indexing must be used to identify parts.
L.13 FACTOR 1: TECHNICAL FACTOR PROPOSAL – VOLUME I
Offerors are instructed to provide information for each of the sections described below in the Technical Volume. Offerors must fully substantiate the soundness of the technical approach and
L-15 demonstrate understanding of the requirements. Technical proposals must be submitted without any reference to cost/pricing information.
