F.5 DELIVERABLES
The contractor must provide deliverables as specified in individually issued Delivery Orders or as otherwise mutually agreed to by the Contractor and the FAA.
All contractor deliverables must be shipped F.O.B (Destination) to the designated addressee(s) specified in individual delivery orders as further described in such orders.
F.6 DELIVERY SCHEDULE OF DELIVERY ORDERS
A complete description of the Supply/Service required, the quantity, delivery date, data deliverables, place of delivery, and other pertinent information, if applicable, will be specified in each Delivery Order.
All work must be performed and deliverables must be delivered in accordance with schedules set forth in individual Delivery Orders.
F-5
F.7 DELIVERY ORDERS
(a) Work under the Contract will be initiated only by the issuance by the Contracting Officer of written Delivery Orders (DO). DOs will (1) describe the supplies and services to be provided by the Contractor; (2) set forth the amounts payable by the FAA for such supplies and services; (3) identify other direct costs to be paid by the FAA; (4) set forth the ceiling price if and as required by Section B.; (5) set forth the schedule for performance; (6) specify the overall period of performance; (7) provide funding information (including identification of the not-to- exceed funding ceiling and accounting/appropriation data); and (8) set forth any other provisions deemed necessary and appropriate by the FAA. The FAA will not be responsible for the payment of any amount to the Contractor that is not provided for under a DO issued hereunder.
(b) The procedure for issuance of each Order must be as follows:
(1) The Contracting Officer will provide to the Contractor a statement of work describing the supplies and services required, and the schedule for performance.
(2) The Contractor will prepare a cost proposal for such supplies and services setting forth all proposed labor costs and other direct costs and submit such proposal to the Contracting Officer.
(3) The Contracting Officer will review the proposal.
(4) The FAA may contact the Contractor to discuss certain aspects of the Contractor’s proposal. The FAA will negotiate the proposal with the Contractor, as required, at this time.
(5) Upon completion of negotiations, if any, and the FAA and the Contractor agree to all terms and provisions, the Contracting Officer will issue the DO, which must be signed by the Contracting Officer and the Contractor.
(c) It is agreed and understood that a DO issued hereunder by the Contracting Officer shall constitute authorization for the Contractor to proceed with the work specified therein. The Contractor must not proceed with any work until it is in receipt of an officially executed DO for such work.
(d) Orders may be issued on a FFP, T&M, CR basis, or a combination thereof.
(e) It is understood and agreed that DOs define and authorize work to be performed by the Contractor within the general scope of work described in Section C. DOs must not change the terms and conditions of the Contract.
F.8. DELIVERIES TO FAA FACILITIES
(a) Security procedures at FAA facilities may require that all mail, materials, packages or parcels of any kind be delivered to a central screening point, for inspection by the FAA.
F-6
This can affect mail and other deliveries destined for all organizations located on FAA property, including government organizations, contractors, and permit holders. After passing security inspection, the mail or material may be handled and delivered by the FAA. FAA will make every reasonable effort to conduct such inspections and handle items carefully to avoid damage or delay.
(b) These inspections are for the benefit of the FAA only. The FAA makes no representation that any material passing inspection is without hazard, poses no threat, or that it conforms in form, fit, function or quantity to the expectations of the intended recipient.
(c) The FAA will not be liable for any 1) loss, damage or shortage of any mail or materials,
2) injury, or 3) delay in performance resulting from such inspections and handling, unless liable under the Federal Tort Claims Act (28 U.S.C. 2671-2680).
(d) Any item destined for the Contractor from the Contractor, or to the FAA from the Contractor, that fails to pass inspection remains the property of the Contractor, who is responsible for its disposition and coordination with law enforcement agencies as necessary.
F.9 NOTICE REGARDING LATE DELIVERY
In the event the Contractor anticipates difficulty in complying with any delivery schedule, the Contractor must immediately notify the CO in writing, giving pertinent details, including the date by which it expects to make delivery. This notice of late delivery is informational in nature only and receipt thereof by the Government will not be construed as a waiver of any contract delivery schedule of any of its rights or remedies provided by law or under this contract. All modifications to the Contract, including modifications to the delivery schedule, must be in writing and signed by the CO.
