About this file

This document is an Invitation for Bid (IFB) Modification that makes two key amendments to the existing solicitation. First, the minimum bid price requirement has been removed, allowing offerors to submit proposals without a specified dollar amount threshold. Second, the performance period has been modified to include a 12-month base period with four optional 12-month extension periods that may be exercised based on government requirements and contractor performance.

The modification explicitly clarifies the government's broad rights in the procurement process, including the ability to reject any or all proposals when deemed advantageous. Potential reasons for rejection include excessive pricing, inadequate technical proposals, changes in government needs, or other factors contrary to government interests. The document emphasizes that submitting a proposal does not guarantee an award, and the government retains sole discretion in contract award decisions, governed by 41 CFR Part 102-38.205. Offerors must acknowledge these terms by submitting a proposal in response to the Request for Technical Proposal (RFTP).

IFB Modification: Performance Period & Removal of Minimum Bid Requirement & Government's Right to Reject Bids

1. Amendment to General Statements & Article 2 Section 1 Bidding Process:

The existing language in General Statements & Article 2 Section 1 Bidding Process, is hereby amended to remove any requirement for a minimum bid price. Offerors are no longer obligated to meet a specified minimum dollar amount in their proposals.

2. Amendment to General Statements & Article 6 Section 1 Performance Period:

The existing language in General Statements & Article 6 Section 1 Performance Period, is hereby amended to a 12-month base period and the four twelve (12) month option periods that could be exercised based on Government requirements and Purchaser performance.

3. Clarification of Government Rights:

While the minimum bid requirement has been eliminated, Offerors are hereby notified that the Government reserves the right to reject any or all proposals received in response to this RFTP when such action is determined to be advantageous to the Government. This right is explicitly retained and governed by Title 41 of the Code of Federal Regulations (CFR), Part 102-38.205, which states:

"The Government may reject any or all bids or offers when such action is advantageous to the Government."

4. Implications of Bid Rejection:

Offerors understand and acknowledge that the Government's right to reject any or all bids includes, but is not limited to, circumstances where:

* The proposed pricing, even without a minimum threshold, is deemed to be excessive or not in the best interest of the Government. * The technical proposals received do not adequately meet the Government's requirements, regardless of price. * Changes in the Government's needs or priorities necessitate the cancellation of the procurement. * Other factors arise that make accepting any of the submitted proposals contrary to the best interests of the Government.

5. No Guarantee of Award:

The submission of a proposal in response to this RFTP, even one that is technically compliant and competitively priced, does not guarantee an award. The Government's decision to award a contract, or not to award a contract, is at its sole discretion and subject to the provisions of applicable laws and regulations, including 41 CFR Part 102- 38.205.

6. Offeror Acknowledgement:

By submitting a proposal in response to this RFTP, Offerors acknowledge and agree to the terms and conditions outlined in this amendment, including the Government's right to reject any or all proposals under the provisions of 41 CFR Part 102-38.205.
