EOLWD and the Commonwealth accept no responsibility and will provide no accommodation to Bidders who submit responses based on an out-of-date Bid or on information received from a source other than COMMBUYS.
4.7 Oral Presentations/Product Demonstrations
EOLWD may, in its sole discretion, invite those Bidders whose responses have been judged competitive and responsive in the course of the evaluation to participate in a facilitated oral presentation, including demonstrations of proposed software or technology and may use these demonstrations or oral presentations to clarify aspects of the Bidder’s response or to inquire as to the Bidder’s proposed approach, recommendations, and experience with regard to any aspect of this project. Scoring of a prospective Bidder may be adjusted based on the Bidder’s performance during demonstration and/or oral presentation.
Presentations may be conducted virtually or in person—as required by EOLWD.
Bidders who are asked to participate in oral presentations will be expected to prioritize this in their schedules. EOLWD will endeavor to find a mutually convenient time for presentations, if any, however, failure to appear at the scheduled time of the presentation/demonstration may result in disqualification, reduction of points, or other action that EOLWD deems appropriate. The EOLWD reserves the right to reschedule any Bidder’s oral presentation date.
4.8 Bidder Response Requirements and Format
EOLWD is seeking clearly articulated proposals that conform with the requirements set forth in the accompanying Response Template and cost template and address only the specific needs associated with this project. Superfluous information and marketing materials are strongly discouraged; if received, such materials will not be reviewed and will not factor into bid evaluations.
All response forms must be submitted in the same format in which they were provided. Do not change file format or combine forms. Bidders should rename forms only to add their company name and response category to the file name.
Bidders must complete and submit all information and forms using the designated Response Template and related documents provided on COMMBUYS along with this RFR in accordance with the instructions set forth therein.
4.9 Bidder Qualifications
The Commonwealth will accept proposals from qualified Bidders with expertise in the secure collection and compilation of confidential data derived from electronic or paper reports and the ability to convert or transmit a high volume of data into useable, exportable machine-readable text. Said data will need to be aggregated, measured and published in manner suitable for public consumption and analysis within the time constraints set forth.
4.10. Evaluation Criteria
4.10.1 Overview
SST members will rate each Bidder’s ability to deliver a best value solution based on their review of the information presented in the Bidder’s response and their knowledge of the Bidder gained through the evaluation process. Sources of information which may be used in their evaluation include the written proposal, product demonstrations, oral presentations, verbal and written responses to questions asked by the Committee, technical prototyping/proof of concept, the Bidder’s past performance as a Commonwealth contractor, references, and other evidence the SST deems relevant.
4.10.2 Mandatory Requirements
RFR sections that include terms such as: “must”, “shall”, “will” and “required” are mandatory. Failure to meet the requirements of a mandatory specification without providing an alternative that is acceptable to the evaluators may result in the disqualification of a Bidder’s proposal. The SST reserves the right, in its discretion, to determine whether non-compliance with a mandatory specification is insignificant or can be easily corrected.
4.10.3 Preferred Specifications
RFR specifications prefaced with language such as: “desirable”, “could,” “can,” “may,” “should,” “preferably,” “prefer,” “suggested,” and “requested” identify a desirable or discretionary item or factor that is considered by EOLWD to be “desirable.”
4.10.4 Compliance with Minimum Submission Requirements:
1. Response has been received timely, by the submission deadline.
2. Response follows the format set forth in the response template and includes an RFR Cost Response separate from the RFR Business Response.
3. All documents requiring an electronic signature have been signed and are included.
4. Response complies with and does not alter the Commonwealth’s Terms and Conditions for Information Technology Contracts, the Commonwealth Standards Contract Form, the terms of the RFR, and other required RFR attachments.
5. All forms, questions, and checkboxes in the Response Template have been completed.
6. There are no disqualifying answers, or checkboxes not filled in, on the Cover Letter, the Statement of Minimum Qualifications, Legal and Other Requirements, Representations and Warranties, and Disclosure Statement, all contained within the Response Template.
It is the Bidder’s responsibility to ensure that all required materials in the designated format are included with its Response.
4.10.5 Selection Criteria and Priorities
Responses to the RFR will be evaluated based on the Bidder’s compliance with the submission requirements, demonstrated ability to securely ingest and synthesize the data required by the Frances Perkins Wage Equity Act, and experience with related data analysis. Preference will be given to bidders who prioritize supplier diversity, cost efficiency, and an understanding of RFR requirements. EOLWD remains committed to ensuring that the selected bidder is capable of providing the best value to the Commonwealth.
4.11 Conflicts of Interest
Bidders must disclose any potential conflicts of interest, whether direct or indirect, arising from a Bidder’s current or previous contracts or Bidder’s marketplace offerings. EOLWD will evaluate whether potential conflicts would interfere with an awarded Bidder’s work on a case-by-case basis.
4.12 Bid Review
EOLWD reserves the right to reject any or all bids (responses), in whole or in part and for any reason deemed non-compliant or non-responsive per this RFR, its attachments or any subsequent changes.
Submitting a Bid in response to this RFR will not bar or disqualify any potential Bidder from responding to future RFRs that may be issued related to the ongoing modernization initiatives at EOLWD. Bidders are advised to check prior to submitting a response to ensure that they have the most recent RFR files and questions and answers. Bidders may not alter (manually or electronically) the RFR language or any RFR component files. Modifications to the body of the RFR and Response Template, questions and answers, specifications, terms and conditions, or which change the intent of this RFR are prohibited and may disqualify a response.
The SST may also use pass/fail ratings, scoring thresholds, or other criteria deemed necessary or appropriate by the SST, to eliminate proposals that do not warrant full evaluation. Note that the order of the sections in the RFR and Response Template does not signal importance or weighting.
All eligible responses received on or before the Bid Opening Date defined in this RFR will be reviewed by the SST. Proposals that are deemed ineligible or non-responsive may NOT be presented to the SST for further evaluation. EOLWD reserves the right to exclude from further consideration nonresponsive bids or bids that fail to meet the submission requirements of this RFR.
EOLWD will not release any ratings or evaluation information (other than the evaluation criteria set forth in this section) prior to Contract award.
4.13 Award
The SST will rate and rank Bidders to determine which Bidders will proceed to subsequent stages of the evaluation and/or enter into negotiations with the Commonwealth to receive a Contract award. EOLWD may request Best and Final Offers from any or all of the Bidders. The SST will select the Response which demonstrates the best value overall to achieve the procurement goals of EOLWD. The SST will announce the apparent successful Bidder based on the final overall scores.
EOLWD may negotiate the terms of the Contract, including the award amount, with the apparent successful Bidder prior to finalizing a Contract. If contract negotiations cannot be concluded successfully with the awarded Bidder, EOLWD may negotiate a Contract with the next Bidder in the award sequence.
It is entirely within EOLWD’s discretion to award or not award a Contract under this RFR.
4.14 Contract Amendments
EOLWD reserves the right to amend this RFR or any contract resulting from this RFR. EOLWD may negotiate changes to the original performance measures, reporting requirements or payment methodologies tied to performance at any time during the contract duration if they are consistent with the specifications of this RFR. EOLWD reserves the right to negotiate and execute contract amendments with the Vendor(s) that EOLWD determines as necessary to result in the intent of this RFR, to amend the specifications for necessary requirements, or to result in a better valued contract. Amendments may include, but are not limited to, contract dollars, contract performance, increased or decreased obligations, scope of work, quantity, etc.
4.15 Additional Services
EOLWD may procure additional services from the Selected Vendor(s) to provide additional or related services under this RFR. If additional funds become available, EOLWD reserves the right to increase the maximum obligation under this RFR subject to available funding, satisfactory contract performance, and service needs. EOLWD may also determine that previously approved work products are no longer required, or that work products or deliverables must be modified. In such event, the scope of the Agreements entered into hereunder will change upon EOLWD’s and the Selected Vendor’s mutual written agreement.
4.16 Limitations
This RFR does not commit the Commonwealth or EOLWD to enter into any contract or to pay any costs incurred in the preparation of a Bidder’s response to this RFR. EOLWD reserves the right to accept or reject any and all proposals received as a result of this RFR and to contract for some, all or none of the products and services as a result of this RFR. EOLWD further reserves the right to negotiate with any or all qualified Bidders and to cancel in part or in its entirety this RFR if it is in the best interest of EOLWD or the Commonwealth of Massachusetts to do so.
EOLWD may evaluate additional information beyond the Bidder’s RFR response (such as generally available industry research and Bidder’s own public web content) to determine conformance to RFR requirements.
4.17 Insurance
Acknowledgment that the Bidder currently has, and will maintain, insurance sufficient to cover liability related to the Bidder’s performance and obligations under this RFR. At the time of award, the Selected Bidder shall provide proof of the type and minimum limits of insurance set forth including the following:

No new maintenance or other agreements for services may be executed after the Contract has expired.
