About this file

This document is a Request for Response (RFR) issued by the Massachusetts Department of Mental Health (DMH) for a Master Agreement to establish a list of approved camps for DMH-referred children. The procurement seeks to create a master list of camps that can serve DMH clients, children receiving services through the Children's Behavioral Health Initiative (CBHI), and siblings of DMH clients during summer and non-school periods. Applications will be accepted on a rolling basis until June 1, 2036, with the first review period closing on December 9, 2025. The initial contract period will be up to 5 years, with potential for 5 additional one-year renewal options, for a total maximum contract duration of 10 years. The anticipated procurement termination date is December 31, 2036, and DMH estimates annual spending on camp services up to $1,000,000.

The procurement requires camps to have a current Department of Public Health license, be in business for at least 3 consecutive years, and meet specific fiscal and operational requirements. Camps will be compensated at an all-inclusive rate, with DMH recommending a weekly rate but open to alternative pricing structures. A key component of the procurement is the Supplier Diversity Program (SDP), which requires contractors to commit at least 1% of grant funds to partnering with certified diverse business enterprises or non-profit organizations. The evaluation will allocate at least 25% of total points to the SDP plan, and contractors must provide monthly reports demonstrating compliance with their diversity commitments.

General Description of the Procurement

1.2.1 Services Being Procured.

The Department of Mental Health (DMH) seeks to establish a Master List of approved camps to which the Department can send children as needed during the summer (June through Labor Day) and/or other times children are not in school.

A camp for this purpose is defined as follows:

A day or residential summer camp program, after school or school vacation program that operates on a permanent site; conducted for recreation or recreational instruction; operates for four or more days or nights; for profit or charitable purposes; and serves at least five children unrelated to the operator. Refer to the DPH regulation 105 CMR 430.000. A camp includes all programs operated under the same DPH license.

DMH seeks to include on the Master List a wide range of camps, from highly specialized camps for youth with behavioral health needs to camps operated by community organizations that all children can access.

DMH will use the camps as needed for: (1) DMH Clients living in the community; (2) children and adolescents receiving services via Children’s Behavioral Health Initiative (CBHI) through their local Community Service Agency (CSA), and (3) siblings of DMH Clients. DMH may consider using camps for other DMH Clients as appropriate.

DMH reserves the right to make contract changes and/or amendments during the term of the procurement because of new knowledge of best or promising practice.

Camp requirements and use of camps by DMH are more fully described in Section 4 of this RFA.

DMH MISSION STATEMENT AND SERVICE PRINCIPLES

A Contractor will be responsible for ensuring the Department’s mission; vision; commitment to race, equity, and inclusion, and service principles are adhered to in all Contract activities and by all staff members.

Vision Mental health is an essential part of health care. The Massachusetts Department of Mental Health, as the State Mental Health Authority, promotes mental health through early intervention, treatment, education, policy, and regulation so that all residents of the Commonwealth may live full and productive lives.

Mission Statement The Department of Mental Health, as the State Mental Health Authority, assures and provides access to services and support to meet the mental health needs of individuals of all ages, enabling them to live, work, and participate in their communities. The Department establishes standards to ensure effective and culturally competent care to promote recovery. The Department sets policy, promotes self-determination, protects human rights, and supports mental health training and research. This critical mission is accomplished by working in partnership with other state agencies, individuals, families, providers, and communities.

DMH believes that everyone, regardless of their race, national origin, sex, religion, ability, age, sexual orientation, and identity, should be treated fairly and receive resources equitably to feel valued and safe. Achieving this goal is crucial to fulfilling DMH's mission of providing access to mental health services and comprehensive mental health assistance to all individuals.

DMH places a high priority on promoting race, equity, and inclusion in all its services and internal business practices. This commitment is crucial as it has a direct or indirect effect on employees, individuals who receive services, their families, providers, and communities. Therefore, it is vital to give equal priority to both service delivery and internal practices to ensure that this commitment is reflected in all aspects of the Department’s work.

A commitment to ensuring race, equity, and inclusion includes but is not limited to:

(a) addressing both the results and root causes of historical and systemic disparities.

(b) providing physical and linguistic accessibility;

(c) engaging with communities across the Commonwealth, especially those that have been traditionally underserved by the behavioral health system to listen and learn to better provide culturally and linguistically responsive mental health services;

(d) creating physically and emotionally welcoming, safe, and inclusive spaces;

(e) seeking out and considering the perspectives and experiences of individuals and groups who have been traditionally excluded from positions of power or influence;

(f) utilizing data for continuous monitoring and evaluation of progress towards these goals;

A Contractor may bill DMH for services only as described in the Purchase Order and at the rates set forth in the Purchase Order.

The decision to make referrals to an approved camp on the Master List will be based on the DMH service needs and best value to DMH. The decision to make referrals will be made by DMH Site Offices. In determining the best value, the following may be considered:

· Nature of the camp program

· Cost to DMH

· Supplier Diversity Plan

· Past performance under the Master Agreement.

Communication with DMH A Contractor must communicate with DMH, as requested, regarding coordination of camp services for a DMH youth. This can include, but is not limited to, e-mail, phone, or face-to-face meetings, as appropriate.

FISCAL SPECIFICATIONS

Pricing Statement

DMH will compensate providers at the all-inclusive rate specified in their pricing statement subject to DMH approval. Costs which are not specifically identified in the Applicants’ responses, and accepted by DMH as part of a contract, will not be compensated under any contract awarded pursuant to this RFA. DMH will not be responsible for any costs or expenses incurred by Applicants responding to this RFA.

Payment is based on the provision of a unit of service. DMH recommends that providers develop a rate that is based on a weekly unit. However, DMH will consider an alternative pricing option based on a different unit, such as a daily rate. This requires sufficient documentation and reasoning for considering the option.

The rate will be agreed upon at time of contract negotiations, and each Invoice will specify the unit of service, the unit rate and the maximum number of Units that may be billed.

6.2 Pricing Limitation

Contractors agrees that no other public entity or customer within the United States purchasing similar services (subject to similar terms and conditions) shall receive a lower price for the service during the contract period, unless the same lower price is immediately effective for DMH. If DMH believes that it is not receiving this lower price as required by this language, the contractor agree upon notice to provide current or historical pricing offered or negotiated with such other customer at any time during the contract period in the absence of proprietary information being part of such contracts.

Costs which are not specifically identified in the Applicant’s response, and accepted by DMH as part of a contract, will not be compensated under any contract awarded pursuant to this RFA. The Commonwealth will not be responsible for any costs or expenses incurred by Applicants responding to this RFA.

0. Camps Services Purchased

DMH makes no guarantee that any services will be purchased from a Contractor as a result of the Contractor entering into a contract as a result of this RFA. Selection of Contractors for referrals will be based on a variety of factors.

6.4 Supplier Diversity Program

All Applicants awarded a Grant under this RFA are required to participate in Commonwealth of Massachusetts Supplier Diversity Program (SDP), by making a meaningful financial commitment to partnering with one or more Supplier Diversity Office (SDO) certified or recognized diverse business enterprise or non-profit organizations. To receive the minimal score on the Supplier Diversity Program in the Response review a Bidder must propose committing at least 1% of the grant funds to partnering with one or SDO business. For more information on the SDP is set forth below.

6.4.1 Program Background

Pursuant to Executive Order 565, the Commonwealth’s Supplier Diversity Program (SDP) promotes business-to-business relationships between awarded Contractors and diverse businesses and non-profit organizations (“SDP Partners”) certified or recognized by the Supplier Diversity Office (SDO).

6.4.2 Financial Commitment Requirements.

All Applicants responding to this solicitation are required to make a meaningful financial commitment (“SDP Commitment”) to partnering with one or more SDO-certified or recognized diverse business enterprise or non-profit organization. This SDP Commitment must be expressed as a percentage of any contract dollars resulting from this solicitation that would be spent with the SDP Partner(s).

After an award, if any, the Total SDP Commitment shall become a contractual requirement to be met annually on a Massachusetts fiscal year basis (July 1 – June 30) for the duration of the Contracts.

A Contract shall not be awarded to an Applicant without an SDP Commitment that meets the requirements stated herein. This requirement extends to all Applicants regardless of their own supplier diversity certification.

6.4.3 Eligible SDP Partner Certification Categories

· SDP Partners must be business enterprises and/or non-profit organizations certified or recognized by the SDO in one or more of the following certification categories:

· Minority-Owned Business Enterprise (MBE)

· Minority Non-Profit Organization (M/NPO)

· Women-Owned Business Enterprise (WBE)

· Women Non-Profit Organization (W/NPO)

· Veteran-Owned Business Enterprise (VBE)

· Service-Disabled Veteran-Owned Business Enterprise (SDVOBE)

· Disability-Owned Business Enterprise (DOBE)

· Lesbian, Gay, Bisexual, and Transgender Business Enterprise (LBGTBE)

6.4.4 Eligible Types of Business-to-Business Relationships

Applicants and Contractors may engage SDP Partners in the following two ways:

· Subcontracting, defined as a partnership in which the SDP partner is involved in the provision of products and/or services to the Commonwealth.

· Ancillary Products and Services, defined as a business relationship in which the SDP partner provides products or services that are not directly related to the Contractor’s contract with the Commonwealth but may be related to the Contractor’s own operational needs.

Other types of business-to-business relationships are not acceptable. All provisions of this RFA applicable to subcontracting shall apply equally to the engagement of SDP Partners as subcontractors.

6.4.5 Program Flexibility

The SDP encompasses the following provisions to support Applicants in establishing and maintaining sustainable business-to-business relationships meeting their needs:

· SDP Partners are not required to be subcontractors.

· SDP Partners are not required to be Massachusetts-based businesses.

· SDP Partners may be changed or added during the term of the contract as long as the Contactor continues to meet its SDP Commitment.

6.4.6 SDP Form Requirements

All Applicants must complete the SDP Plan Form included in this Bid’s COMMBUYS File and include it in their bid Application. In addition to proposing an SDP Commitment, each Applicant must propose one or more SDP Partner(s) to utilize in order to meet its SDP Commitment. Certified diverse Applicants may not list their own companies, or their subsidiaries of affiliates, as SDP Partners and may not meet their SDP Commitment by spending funds internally or with their own subsidiaries or affiliates.

Applicants may be SDP Partners that are:

· Already Certified or recognized by the SDO: Such partners appear in the SDO Directory of certified Businesses or in the U.S. Dept of Veterans Affairs VetBiz Vendor Information Pages directory. After contract award (if any), spending with such partners will contribute to meeting the Contractor’s SDP Commitment.

· Not yet certified or recognized by the SDO: Such partners must be certified in eligible categories by a third-party certification body, such as another city or state supplier diversity certification office, the National Minority Supplier Development Council, the Women Business enterprise National Council, Disability: IN, or the National LGBT Chamber of Commerce (NGLCC) but not listed in the above-mentioned directories. Self-certification is not acceptable. While Applicants may list proposed Partners on their SDP Plan, spending with such partners will not Contribute to meeting the Contractor’s SDP Commitment unless they apply for and are granted SDO supplier diversity certification or recognition. If proposed SDP Partners do not receive SDO supplier diversity certification or recognition, then the Contractor must find alternative SDP Partners in order to meet their SDP Commitment.
