About this file
This document is an Indian Economic Enterprise (IEE) Representation Form issued by the Indian Health Service (IHS), Office of Management Services, Division of Acquisition Policy.
The form serves as a self-certification document for offerors responding to Sources Sought Notices, Requests for Information (RFI), or formal Solicitations under the Buy Indian Act (25 U.S.C. 47). Offerors must certify whether they meet the definition of an "Indian Economic Enterprise" with Indian ownership as defined in HHSAR 326.601. The enterprise must maintain eligibility status at three critical points: when the offer is submitted, at the time of contract award, and throughout the entire contract performance period. Contractors must provide immediate written notification to the Contracting Officer if eligibility is lost at any point. The form requires completion of fields identifying the federally recognized tribal entity, business name, 51% owner name, Unique Entity Identifier (UEI) number, and certifying signature. Successful offerors must also register with the System of Award Management (SAM). The document includes warnings that false or misleading information constitutes a violation of law punishable under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Contracting Officers may require eligibility documentation before awarding set-aside or sole source contracts, and awards may be subject to protest if the successful offeror's eligibility is questioned.
