About this file

This is a representation form for the Indian Health Service Buy Indian Act Indian Economic Enterprise certification requirement.

The form is used for offerors responding to Sources Sought Notices, Requests for Information (RFI), or solicitations issued by the Indian Health Service. Offerors must self-certify whether they meet the definition of an "Indian Economic Enterprise" with Indian ownership as defined under 25 U.S.C. 47 and HHSAR 326.601. The enterprise must maintain eligibility throughout three critical periods: at the time of offer submission, at contract award, and during the entire contract performance period. Any changes in eligibility status require immediate written notification to the Contracting Officer. Successful offerors must also be registered with the System of Award Management (SAM). Contracting Officers may require documentation of eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if the offeror's eligibility is questioned. False or misleading information submitted with an offer violates 18 U.S.C. 1001 and is subject to criminal penalties. False claims during contract performance are subject to civil penalties under 31 U.S.C. 3729-3731 and criminal penalties under 18 U.S.C. 287. The form requires identification of the 51 percent owner, the federally recognized tribal entity, business name, Unique Entity Identifier (UEI) number, certifying signature, and printed name of the signatory.
