52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) technical capability of the item offered to meet the Government requirement; (ii) price
Basis for Award
The Government intends to award a Firm-Fixed-Price contract to MC Machinery Systems on a sole-source basis in accordance with the authority of 41 U.S.C. 1901, as implemented by FAR 12.102(a). This acquisition is for a commercial service, and the procedures of FAR Part 12, "Acquisition of Commercial Products and Commercial Services," will be used.
Award is contingent upon the Contracting Officer determining that the offeror's quote is technically acceptable and the proposed price is fair and reasonable. The evaluation process will be conducted as follows.
I. Technical Evaluation The Government will evaluate the offeror's quote to ensure it meets the technical requirements of the solicitation. To be considered technically acceptable, the quote must satisfy the submission requirements and demonstrate the necessary technical capability.
A. Technical Submission Requirements Quotes must include the following to be considered for evaluation:
· Firm-Fixed Pricing: For all scheduled corrective maintenance as required by the Performance Work Statement (PWS).
· Fully Burdened Labor Rates: For both regular and emergency unscheduled repairs, submitted by individual labor category (e.g., Senior Technician, Technician). Lump-sum rates are not acceptable.
· Labor Category Definitions: Clear definitions for each proposed labor category.
· Parts & Materials Markup: A proposed fixed percentage markup for commercially procured parts and materials, applicable only to unscheduled or emergency repair actions.
· Statement of Compliance: A written statement affirming compliance with all post-award requirements for estimate submissions and cost documentation as outlined in the PWS.
B. Technical Capability Assessment The Government will assess the offeror's demonstrated capability based on the following criteria:
· Experience: A proven track record of providing maintenance and repair services for Mitsubishi Plunge EDM and Mitsubishi Wire EDM equipment.
· Qualifications: Evidence that technicians possess the necessary training, certifications, and experience to perform the required maintenance and repairs.
· Understanding of Requirements: The quote must demonstrate a clear understanding of the Government's maintenance needs and the unique operational requirements of the specified equipment.
· Maintenance Plan: A detailed plan outlining the services to be provided, frequency of maintenance, and guaranteed response times for service calls.
C. Technical Evaluation Ratings
Rating
Description
Acceptable
Submission clearly meets all requirements of the solicitation.
Unacceptable
Submission does not clearly meet all requirements of the solicitation.
A technical submittal rated as “Unacceptable” renders the entire quote technically unacceptable and ineligible for award.
II. Price/Cost Evaluation The Government will evaluate the proposed price for reasonableness.
· Price Reasonableness: The overall firm-fixed price for the base period and all option years will be evaluated to ensure it is fair and reasonable.
· Cost Breakdown: For any unplanned or emergency repairs, the Government will verify costs based on the contract's established fully burdened labor rates and the fixed percentage markup on parts/materials.
III. Award Determination A single award will be made to the responsible offeror whose quote is determined to be technically acceptable and whose price is deemed fair and reasonable. The Government reserves the right to make no award if the proposal is found to be technically unacceptable or the price is determined to be not fair and reasonable.
Clarification of Evaluation
· Labor rates and parts markups will be reviewed for price reasonableness only and will be incorporated into the contract as fixed ceiling rates for ordering purposes.
· These values will not be scored or compared as part of the price evaluation for contract award.
Failure to provide the required structure and documentation will result in the quote being deemed nonresponsive and ineligible for award.
(c)A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
