About this file

This is Addendum #2 to RFQ 8626, issued by the City of Waterbury, Connecticut on November 6, 2025, for City-Wide Retail Electricity Supply Service. The addendum addresses multiple questions submitted by potential proposers regarding modifications to the City's standard terms and conditions included in the contract documents. The City of Waterbury seeks qualifications from Full Requirements Electricity Supply Service Providers to serve all of the City's facilities up to the delivery point, with the intention to approve all qualified respondents who will then participate in a subsequent traditional electricity RFP administered by Titan Energy New England, Inc. Proposers are required to acknowledge receipt of all addenda on the Addendum Acknowledgment Form, with failure to do so potentially resulting in disqualification.

The addendum clarifies that any modifications to the City's Standard Terms and Conditions require approval by the City's Corporate Counsel, and all responses must reference section G14 of the RFQ for guidance on contract document precedence and modification procedures. Key questions addressed include proposed changes to Force Majeure provisions, Default and Termination language, Non-Appropriation or Lack of Funding clauses, and Indemnification requirements. The City indicates that respondents have discretion in determining what qualifications documents to submit, including the option to submit prior proposals in lieu of preparing entirely new responses. The addendum emphasizes that the RFQ process focuses on qualification review rather than pricing evaluation, with pricing to be addressed in the subsequent RFP stage.
