B.3 Performance Work Statement (PWS) Introduction
The Michael E. DeBakey Veterans Affairs Medical Center, Facilities Management Service Line requires waste treatment and disposal of Regulated Medical Waste (RMW) to be performed continuously from April 2022 through April 2027. The facility located in Houston, TX is an integrated healthcare system comprised of many community-based outpatient clinics (CBOC) listed in section 1.7 of the PWS.
1. GENERAL:
1.1. The Contractor shall be responsible for allocating all equipment and personnel, including back-up resources, to meet all requirements for the comprehensive management of the RMW at the Michael E.
DeBakey Veterans Affairs Medical Center (MEDVAMC) in Houston, TX, and all affiliated facilities. The comprehensive waste services shall not only include the collection and disposal of the waste, but also training and support required to ensure compliance with all Federal, State and Local regulations. The ability to provide waste audits and to properly separate waste streams is crucial to this requirement. The Contractor shall be able to assist the facilities in properly profiling their waste. The Contractor shall provide the tracking and reports in a timely manner, and action plans to address any shortfalls. The Contractor shall provide specific services to include all materials, manpower, process equipment, licenses, permits, fees, fuel surcharge, transportation and computerized documentation for the complete pickup, treatment and disposal of all twelve facilities with an estimated total of 5,000 lbs./monthly (60,000 lbs.
annually) of medical/special, pathological and residual chemotherapy waste in an Approved or Alternate Treatment Methods Technology for Special Waste from Health Care-Related Facilities in strict compliance with all applicable guidelines listed in the Regulations Requirements section below.

1.2. Federal Acquisition Regulation (FAR): Requirements Contract. In accordance with FAR 16.503, Requirements Contract that will be solicited competitively to contractors for a single award. The contract award’s ordering period will be a base period of 12 months with four 12-month option periods.
1.3. Protection of Government Property: During work execution, the Contractor shall take special care to protect Government property including interior and exterior buildings, furniture, walls, baseboards, and other surfaces. Damage resulting from Contractor operations shall be repaired by the Contractor, including painting, refinishing, or replacement (if necessary), at no additional cost to the Government.
Contractor shall be responsible to meet all OSHA/Safety requirements in the performance of the work.
This shall include but not be limited to taking all the necessary precautions to protect the patients, visitors and/or staff at each location. Contractor shall be held responsible for any injuries and/or damage, which may be caused as a result of the Contractors failure to adhere to these requirements.
1.4. Abbreviations/Definitions:
1.4.1. Contracting Officer (CO) – a person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the contracting officer acting within the limits of their authority as delegated by the contracting officer.
1.4.2. Contracting Officer Representative (COR) – an individual, designated, and authorized in writing by the contracting officer to perform specific technical or administrative functions.
1.4.3. On-site - (Medical waste managed on property that is owned or effectively controlled by one entity and that is within 75 miles of the point of generation or generated at an affiliated facility is considered to be managed on-site in accordance with Title 30, Texas Administrative Code, Subsection 326.3(29) (30 TAC 326.3(29))

1.5. Contingency Plan (CP): The Contractor shall furnish a CP in the event any VA facility, listed in the Performance Work Statement (PWS) is affected by shut down, planned or unplanned and/or inoperable Autoclave equipment. The CP shall be active within 12 hours of notification from the COR. The contractor shall furnish appropriate and adequate amounts of 97/100-gallon, portable pre-labeled bio-hazard containers with closeable lids for the daily collection, storage and transportation of medical waste, and 20 each for chemotherapy waste containers. The Contractor shall develop and provide a copy of their CP that would be implemented to provide and support all VA facilities listed in this PWS, as applicable for equipment and supplies installed/placed on site or during any National Weather Service (NWS) declared major natural disaster weather event that has the ability to hinder or stop the pick-up and removal of infectious medical waste from any of the VA facilities listed in this PWS. The contingency plan shall include provisions for temporary storage requirements and delivery of 3 to 4 days’ supply of medical waste storage containers to the facility prior to any confirmed natural disaster that may impact medical treatment processes at this facility. The plan shall:
1.5.1. Include provisions for short term CP 5-7 days for each PWS facility.
1.5.2. Include provisions for long term CP 4 weeks for each PWS facility.
1.6. The Contractor shall as a separate contingency plan (CP), furnish all services, materials, equipment, transportation, storage, and manpower, as necessary to treat and dispose of DOT Infectious Substances, i.e., identified as “Category A and Category B” mixed with medical/infectious waste on a fixed per-drum-fee, in strict compliance with Federal (CDC, OSHA, EPA, and DOT) and State (TCEQ) regulations.
1.7. Period of Performance: The period of performance shall be a base period of 12 months with four 12-month option periods exercisable at the discretion of the Government.

VA follows all Federal holidays that are set by law (USC Title 5 Section 6103).

2. REQUIREMENTS CONTRACT INFORMATION:
2.1. Contract Administration: The Department of Veterans Affairs, National Contracting Office (NCO) 16, Division III, Services Team B warranted Contracting Officers is the only group authorized to award a requirements contract from this solicitation. After the requirements contract award, only a Contracting Officer from NCO 16, Division III, Services B can authorize any action at the requirements contract level, including basic contract modifications. The Government reserves the right to reassign contract administration to other Contracting Officers on NCO 16, Division III, Services Team B. Per VAAR 816.505 (b)(8), should the contractor have any complaints of the task-order, contact VA Ombudsman, Associate Deputy Assistant Secretary (ADAS) for Procurement Policy, Systems and Oversight via email, AcquisitionRMCS@va.gov. Pricing shall be provided in response to this solicitation for a binding price for the services listed in section B Price/Cost Schedule.
2.2. Authority To Issue Orders: The Department of Veterans Affairs, NCO 16, Division III, Services Team B warranted Contracting Officers are the only group authorized to place Task Orders under this requirements contract except as otherwise delegated in writing by NCO 16, Division III, Services Team B. The NCO 16, Division III, Services Team B Contracting Officer which issues the respective Task Order will be responsible for all administration functions for the given Task Order.
During the term of the contract, NCO 16, Division III, Services Team B reserves the right to add other customer groups within NCO 16 to be supported by this requirements contract.
2.3. Task Order Placement Procedures: This solicitation will result in a single award, firm fixed-price requirements contract with estimated quantities pursuant to Federal Acquisition Regulation Subpart 16.5. Individual Task Orders will be requested from the Contracting Officer via email. Orders may be place by designated individuals in the NCO 16, Division III, Services Team B office via email. The contractor shall respond to all Task Order quote requests within three business days. Any Task Orders issued under this Requirements contract shall be at the same rate as listed in section B Price/Cost Schedule.
3. CONTAINER REQUIREMENTS FOR MEDVAMC MAIN HOSPITAL:
3.1. The contractor shall be able to provide containers designed and dedicated solely for the collection of hazardous/non-hazardous regulated medical waste. The containers for the MEDVAMC main campus location will be 97/100-gallon, portable pre-labeled bio-hazard containers with closeable lids for the daily collection, storage, and transportation of medical waste, and 20 each for chemotherapy waste containers. All containers shall be washed and sanitized daily before delivery and reuse.
Containers shall be maintained per manufactured-design or replaced to meet manufacturer’s specifications, per Occupational Safety and Health Administration (OSHA), Hazard Communication Standard (HCS), 29 CFR 1910.1200(f), Department of Transportation (DOT), Hazardous Materials Transportation Act {U.S.C. 1801 et seq.} and regulations issued under the Act by the Department of Transportation and Texas Commission on Environmental Quality (TCEQ) per Texas Regulations on mailto:AcquisitionRMCS@va.gov
Medical Waste RG-001, 30 TAC 326.17, 326.19, and 326.21. Boxes shall not be acceptable for the packaging of the biomedical waste, only carts shall be used to minimize handling by the staff at the facilities.
4. CONTAINER REQUIREMENTS FOR CBOCs:
4.1. The contractor shall furnish appropriate and adequate amounts of containers for the daily collection, storage, and transportation of medical waste. Containers shall be maintained per manufactured-design or replaced to meet manufacturer’s specifications, per Occupational Safety and Health Administration (OSHA), Hazard Communication Standard (HCS), 29 CFR 1910.1200(f), Department of Transportation (DOT), Hazardous Materials Transportation Act {U.S.C. 1801 et seq.} and regulations issued under the Act by the Department of Transportation and Texas Commission on Environmental Quality (TCEQ) per Texas Regulations on Medical Waste RG-001, 30 TAC 326.17, 326.19, and 326.21. The containers shall be designed so it can be easily and safely handled by the VA staff. It should also be designed so that it can be easily secured and transported within the facility by the VA staff. The Contractor shall ensure that containers being delivered to the sites are sanitized and disinfected.
5. PERFORMANCE REQUIREMENTS:
5.1. The contractor shall provide all labor, supplies, equipment, and disposal for the following services:
5.1.1. Regulated medical waste removal and disposal services
5.1.2. Waste audits
5.2. The contractor shall adhere to established methods for picking-up, manifesting, transporting, documenting, labeling, processing, and delivery verification to the treatment and disposal facility generated infectious medical, pathological, and chemotherapy waste per Texas Commission on Environmental Quality (TCEQ), Transporting Waste in Texas RG-86, Texas Regulations on Medical Waste RG-001, Occupational Safety and Health Administration (OSHA), Hazard Communication Standard (HCS), 29 CFR 1910.1200(f), Department of Transportation (DOT), Hazardous Materials Transportation Act {U.S.C. 1801 et seq.} and regulations issued under the Act by the Department of Transportation and Environmental Protection Agency (EPA) Title 40 - Protection of Environment of the Code of Federal Regulations (CFR), Chapter 1 – Environmental Protection Agency, Subchapter I
– Solid Wastes Part 263 – Standards Applicable to Transporters of Hazardous Waste.
5.3. The Contractor shall ensure treatment and disposal of VAMC generated Chemotherapy (CD) wastes and Pathological Waste (PW) are segregated at storage on site, in separate pre-labeled containers provided by the vendor. CD and PW shall be treated (incinerated) and disposed in accordance with the approved treatment method enforced by federal, state, and local regulations listed in Section 1.1.1 Regulations Requirements.
5.4. The Contractor shall provide evidence their on-site or off-site medical/special waste treatment and disposition system for processing untreated RMW, special, infectious waste meets the performance standards, as outlined in Title 30, Texas Administrative Code, Subsection 326.75(r).
Failure to meet this requirement shall call for immediate termination of requested service stated and required in this contract.
5.5. The Contractor shall ensure an electronically generated copy of the medical waste manifest or a written record per 30 TAC 326.53(b)(8) and (9) and follows the requirements in 30 TAC 326.53(b)(10) is attached to each electronically generated invoice showing proof of the daily quantity and total monthly amount of medical waste treated in pounds, prior to requesting and receiving payment for services rendered. The inventory report shall include each site listed in this SOW; along with the amount of RMW, chemotherapy (CD) waste, and pathological waste (PW).
5.6. The Contractor shall maintain documentation demonstrating its employees or contractors are properly trained, medical tested and wear an appropriate level of Personal Protective Equipment (PPE). The Contractor shall ensure employee or contractors wear PPE prior to engaging in any activities involving maintenance of processing equipment or handling of infectious waste generated by this health care facility per 29 CFR OSHA 1910.1030, Bloodborne Pathogens.
5.7. The Contractor shall provide technical assistance and training to facility personnel (supervisors) on current waste segregation, waste collection, and reduction practices, as needed to support the facility’s solid waste reduction program goals per Executive Order 13693, Planning for Federal Sustainability in the Next Decade, dated March 19, 2015.
5.8. The Contractor shall meet all requirements necessitated by regulatory or technology changes during the life of this contract. Failure to meet these specifications and requirements in 25 TAC Chapter 1, Subchapter K; Definition, Treatment, and Disposition of Special Waste from Health Care- Related Facilities, shall be grounds for unilateral termination of the service.
5.9. The Contractor is fully responsible and liable for all incidents resulting from any claims or reports for any infectious diseases or reactions resulting from using their technology either on-site or off-site at present or in the future.
5.10. The Government shall ensure RMW (includes special waste), other infectious materials and residual chemotherapy waste generated from clinical and/or research processes are discarded into approved containers provided by the contractor for storage and transport of medical, special, infectious, and residual chemotherapy waste to the contractor’s RMW treatment and disposal site.
5.11. All regulated medical waste that requires incineration shall be brought to a central staging area.
All pathological waste collected from the facilities shall be incinerated. The VA will be responsible for the segregation of waste in accordance with Federal, State, and Local requirements. Contractor is required to provide labels to clearly identify these containers. The Contractor shall demonstrate the controls that shall be in place to ensure this waste is properly treated.
5.12. The Contractor shall provide leak and puncture proof reusable containers with lids that can be secured for transportation of the regulated medical waste. Contractor shall provide labeling on all containers of regulated waste. With the following information at a minimum:
5.12.1. Name of transporter or immediate handler
5.12.2. “Regulated Medical Waste”
5.12.3. Bar-coded labels identifying the generator
5.13 Pickup and delivery by the Contractor shall be required for each site. Full containers shall be removed from the designated storage area at each site and replaced with empty containers. The replacement containers shall be sanitized and disinfected. The replacement containers shall be placed within the designated empty container storage area at each site.
5.14 Delivery and pick up shall be made at a time agreed upon by the Contracting Officer Representative (COR). Scheduled arrangements shall be made in the best interest of the VA to ensure ample dock space is available. Pick up sites and required pick-up schedules are identified during COR scheduling arrangements.
5.15 Transportation vehicles shall be equipped with fully enclosed leak-resistant cargo body maintained in a sanitary condition and secured when left unattended. Vehicles shall bear the transporter's name, state permit number, and the words "Regulated Medical Waste" on the sides of the body. Waste shall not be subject to mechanical stress. Regulated medical waste shall not be combined with other wastes, such as solid waste or recyclables. Regulated medical waste shall be secured prior to leaving the VA facility. The waste shall always remain on the permitted vehicle and shall be unloaded at the appropriate disposal or transfer facility. The facility shall be permitted to accept regulated medical waste.
5.16 Contractor shall immediately notify the appropriate agencies if a vehicle is involved in a spill or accident which renders the vehicle non-compliant with applicable rules and regulations.
5.17 The contractor shall furnish, sign, and date a properly prepared manifest prior to removing the regulated medical waste from the facility. The VA designated employee and the transporter shall certify that the manifest data matches the contents of the load to be transported. A ticket or copy of the manifest shall be left with the facility to verify the waste has been removed. The contractor shall deliver the waste to an authorized disposal facility. The disposal facility shall sign the manifest to verify that the regulated medical waste has been delivered and accepted. Contractor shall return a copy of the manifest to the generator, assuring final disposal.
5.18 The VA reserves the right to thoroughly inspect the Contractor's disposal facility to assure acceptable standard of performance.
5.19 Contractor shall maintain a log of regulated medical waste shipments. The log shall identify the quantities of regulated medical waste shipped.
6. TRAINING REQUIREMENTS:
6.1 Due to the health and safety risks (especially Bloodborne Pathogens) associated with this requirement, the Contractor’s methods, procedures, training, and other controls that are proposed shall allow the performance of the tasks with no adverse effects from the risk factors.
6.2 The training plan shall demonstrate a good working knowledge of the United States Department of Transportation (DOT), Occupational Health and Safety (OSHA), Texas Commission on Environmental Quality (TCEQ) and Environmental Protection Agency (EPA) regulations that govern the health and safety risks involved in the handling and shipping of regulated medical waste. The contractor shall be able to provide, at a minimum, the following training in HAZAMAT Familiarization, Proper Packaging, Safety Audit, Security Awareness/In-Depth Security, OSHA Bloodborne Pathogens Standards, and Waste Minimization.
7. CONTRACTOR PERSONNEL QUALIFICATION:
7.1. The contractor shall provide a contract manager who is responsible for the performance/coordination of work defined in this contract. The name and phone numbers (during and after hours) of this person and alternate(s), who shall act for the contractor when the manager is absent, shall be designated in writing to the Contracting Officer no later than fifteen (15) days after the contract start date. The contract manager and alternate(s) shall be able to understand, read, fluently speak, and legibly write the English language. This person may perform services under this contract in addition to contract management duties. The contract manager or alternate shall have full authority to act for the contractor in all contractual matters relating to daily operation of this contract.
All changes shall be provided in writing to the Contracting Officer Representative no later than forty-eight (48) hours prior to the implementation of staff changes.
7.1.1. Contractor shall provide their employees with appropriate protective clothing, equipment, and apparel as prescribed by the Occupational Safety & Health Administration (OSHA).
The technician shall be dressed neatly in appropriate uniform and wear an identification badge at all times when servicing at the VA facility.
7.1.2. Contractor shall provide details of what training their employees undergo. Contractor shall be available for consultation and education to Medical Center's staff on the proper use of reusable sharps containers.
7.1.3. The contractor shall provide all training necessary to perform the work as defined in this contract. Training shall not hamper the quantity, quality, or timeliness of work requirements of the contract.
7.1.4. The contractor shall ensure that all employees understand the risks involved with regulated medical waste and are trained in specific procedures to handle spills on the VAMC premises, and enroute to a treatment facility.
7.1.5. Contractor employees who pick up regulated medical waste from the VAMC are identified as being susceptible and/or occupationally at risk to certain biological hazards. The contractor shall provide these employees with the required immunizations.
7.1.6. Contractor employees shall adhere to dress code to include proper facial coverings when required.
7.1.7. Contractor’ approve Medical Waste Registration (TCEQ Form #00426) shall be provided to the COR as part of the contractor’s proposal.
8. PERMITS AND RESPONSIBILITIES:
8.1. The Contractor shall, without additional expense to the Government, be responsible for obtaining Department of Transportation (DOT) RCRA Permits and Texas Commission of Environmental Quality (TCEQ) Hazardous Waste permits, and for complying with any applicable Federal, State, and Municipal laws, codes, and regulations in connection with the prosecution of the work. Contractor shall be similarly responsible for all damages to persons or property. Contractor shall take proper safety and health precautions to protect the work, the workers, the public and the property of others.
Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work.
8.2. If you transport waste that does not originate or terminate in Texas, you are exempt from the medical waste rules in 30 TAC Chapter 326, (per [30 TAC 326.31(e) and 326.53(b)(16) except the rules on transportation units used to collect or transport untreated medical waste [30 TAC 326.53(b)(6). If you transport untreated medical waste from Texas to other states or countries or from other states or countries to Texas or collect or transport waste in Texas but have a principal place of business in another state, you must comply with all applicable requirements in 30 TAC Chapter 326 for such transportation activities. [Per 30 TAC 326.23(g). If you also engage in any activity of storage, processing, or disposal of medical waste in Texas, you must follow the applicable requirements for facility operators of such activities.
9. QUALITY ASSURANCE SURVEILLANCE PLAN:
9.1. The ability to successfully provide the number and types of services required on a daily basis over an extended period of time requires a good Quality Assurance Surveillance Plan (QASP). The required services shall be performed within the normal working hours (8AM-4:30PM), while meeting the quality standards required. The Contractor shall identify the methods and procedures to be used to ensure that the quality standards are met for regulated medical waste, universal waste, solid waste & recycling, and scrap metal. The Contractor shall focus on delivering the primary services of collections, consolidation, transportation, shipping, and disposal in a manner the meets the requirements. The Contractor shall identify the key staff members who will carry out the requirements. The contractor shall provide a copy of their QASP for approval by the COR within 2 days from the effective date of award. The contractor’s QASP shall cover all of the contract requirements with an effective approach to ensure continued satisfactory performance as well as address how to remedy any deficiencies encountered during contract performance.

11. COMMUNICATION:
11.1. The contractor shall explain the communication plan for employees. Highly functional and efficient data and voice communications are critical for successfully performing the contract requirements. The Contractor shall be capable of sending and receiving e-mails and faxes, communicate with the Project Manager, communicate with service vehicles regularly to determine locations and relay service-related messages, and send/receive electronic data files. Communication shall be critical in ensuring no interruption of services. Communication shall include how waste will be collected, manifested, and treated. The contractor shall ensure the biomedical waste be collected according to the schedule, and the “incinerate only” waste is properly handled.
12. HEALTH AND SAFETY:
12.1. The Health and Safety plan shall demonstrate a good working knowledge of the Occupational Health and Safety (OSHA), Department of Transportation (DOT), and Texas Department of Health (TDH), Environmental Protection Agency (EPA) and Texas Commission on Environmental Quality (TCEQ) that govern the health and safety risks involved in the handling and shipping of regulated medical waste. All tasks with potential health and safety risks shall be identified along with the proposed control measures to ensure minimal exposure to minimize risk. The Contractor agrees that his personnel and equipment are subject to safety inspections by Government personnel while on Federal property. The Contractor shall ensure that all personnel involved in the handling, repackaging, and transportation of the items listed herein shall be trained in the areas of spills and general first aid procedures.
13. ADMINISTRATION:
13.1. Facility Orientation: An initial orientation of the facilities will be conducted by the COR at the start of the contract. The contractor shall be responsible for conducting orientation for new employees thereafter.
13.2. Reports: The contractor shall be required to provide a waste audit report on a monthly basis to the COR. This report shall identify the dates of servicing, the weight of each servicing location and the total weight of all locations for the respective month, and the method used for disposal (i.e., incinerated), and training requirements to achieve opportunities identified in the audit. The Contractor shall demonstrate the training records and reporting that shall be provided. This shall comply with the regulations as defined in the “Training” section.
