About this file

This document is a Notice of Intent to Award issued by the Kissimmee Utility Authority (KUA) Procurement Division for RFQ 25-060-JG, a solicitation to purchase two radiator oil pumps for a 230kV transformer, which is a rebid of a previous procurement. The notice, dated August 1, 2025, indicates that KUA intends to award the contract to Positive Slopes LLC, subject to final approval by the KUA Board of Directors. The award is not yet a confirmed contract, and the successful bidder will not acquire legal rights until a formal purchase order or contract is executed.

The notice outlines KUA's discretionary rights in the procurement process, including the ability to revoke the award if the apparent successful bidder fails to negotiate and execute the contract, and the option to award to the next lowest responsive and responsible bidder or re-solicit the opportunity. Additionally, the document provides a mechanism for potential bidders to file a written notice of protest within 72 hours of the posting of the award decision, which must be submitted to the Vice President of Finance and Administration. The procurement is for specific technical equipment (radiator oil pumps) for a high-voltage electrical transformer, suggesting this is part of KUA's infrastructure maintenance and upgrade efforts.

RE: RFQ 25-060-JG Purchase 2 Radiator Oil Pumps for 230kV Transformer-REBID

All, Kissimmee Utility Authority (“KUA”) hereby provides notification of its intent to award the above referenced solicitation to the following firm(s):

Positive Slopes LLC

This Notice of Intent to Award is subject to final approval by the KUA Board of Directors, as applicable. Therefore, this Notice of Intent does not constitute the formation of a contract between KUA and the apparent successful bidder. The successful bidder shall not acquire any legal or equitable rights relative to this solicitation until a contract or purchase order, containing terms and conditions acceptable to KUA, is duly approved and executed by KUA.

In the event the apparent successful bidder fails to accept, negotiate, and execute a contract with KUA, KUA may, at its sole discretion, revoke the award and proceed to award to the next lowest, responsive and responsible bidder, reject all bids received, cancel the solicitation, and/or re-solicit at a later time. KUA further reserves the right to cancel this Notice of Intent to Award at any time prior to execution of the contract or purchase order, as applicable.

Thank you for your interest in doing business with KUA. We look forward to receiving your submittals in the future.

Sincerely, Jennifer Grieves Buyer cc: project file

Any person adversely affected by the decision or intended decision of award must file a written notice of protest to the Vice President of Finance and Administration within seventy-two (72) hours (excluding Saturday, Sundays, and legal holidays) after the posting of KUA’s decision or intended decision.

KUA Procurement personnel should be contacted to obtain comprehensive written protest procedures prior to filing a written notice of protest.
