About this file

This document is a Request for Qualifications (RFQ) issued by the Oregon Department of Energy (ODOE) to establish a pool of prequalified Energy Analysts to conduct energy consumption analysis for new construction and renovation projects for authorized state agencies in Oregon. The intent is to prequalify one or more Energy Analysts through this solicitation process to work on the State Energy Efficient Design (SEED) program, which requires newly constructed or renovated state facilities to exceed the energy conservation provisions of the Oregon State building code by at least 20%. The RFQ outlines the minimum qualifications for Energy Analysts, the SOQ submission requirements, the evaluation criteria, and the process for being awarded a Prequalified List Agreement to be eligible for future energy analysis service contracts with state agencies.

The RFQ specifies the information that must be included in the SOQ, including the firm's energy analysis experience, project expertise, work samples, key personnel and their qualifications, and modeling experience. Respondents must score at least 75 out of 100 points on the evaluation criteria to be prequalified. Once prequalified, the Energy Analysts will be eligible to submit bids or proposals to provide energy analysis services to state agencies, but ODOE will not be involved in the follow-on procurement and contracting processes. The RFQ does not commit ODOE to entering into any contracts, and prequalification does not guarantee that a firm will be selected for future energy analysis service contracts.

2.3 DEFINITION OF TERMS

For the purposes of this RFQ, capitalized words will refer to the following definitions.

2.3.1 General Definitions

Capitalized terms not specifically defined in this document are defined in OAR 125- 2460110.

2.3.2 Project Specific Definitions

Alternative Energy System means an environmentally sound energy system that uses power derived from renewable resources including, but not limited to, the sun, wind, geothermal sources and heat recovery.

Agency means a state agency, board, commission, department or division that is authorized to finance the construction, purchase or renovation of a facility that is or will be used by the State of Oregon (see OAR 330-130-0020(1))

Class I Buildings include the following:

• New buildings, additions, or renovations of 10,000 or more square feet of heated or cooled floor area; and

• Building additions that increase the size of an existing building to 10,000 or more square feet of heated or cooled floor area, and renovations to buildings of 10,000 or more square feet of heated or cooled floor area, which significantly affect either:

1. The existing mechanical or control system; or

2. At least two of the following energy systems: interior lighting, building envelope, the domestic hot water system, or special equipment that uses energy.

Contracting Agency means the Agency entering into a contract for facility construction or renovation (see OAR 330-130-0020(1)).

Cost-effectiveness for the purpose of the SEED program, is established by a benefit-to-cost analysis. If the benefit-to-cost ratio (BCR) exceeds 1.0, the Energy Conservation Measure (ECM) is considered to be cost-effective. BCR = Present value measure savings (PVS) divided by Present Value Incremental Cost (PVC). A detailed description is included in SEED Appendix J, http://www.oregon.gov/energy/energy-oregon/Documents/SEED%20Guidelines%20Appendix%20J.pdf http://arcweb.sos.state.or.us/pages/rules/oars_100/oar_125/125_246.html http://arcweb.sos.state.or.us/pages/rules/oars_100/oar_125/125_246.html http://arcweb.sos.state.or.us/pages/rules/oars_100/oar_125/125_246.html http://www.oregon.gov/energy/energy-oregon/Documents/SEED%20Guidelines%20Appendix%20J.pdf http://www.oregon.gov/energy/energy-oregon/Documents/SEED%20Guidelines%20Appendix%20J.pdf

RFQ #24-026 Oregon State Energy Efficient Design (SEED) Energy Analyst Page 5 of 17

ECM: see “Energy Conservation Measure”

Energy Analyst is a person who has expertise in analyzing energy savings and Energy Conservation Measure (ECM) costs, prepares the building energy analysis and the Energy Analysis Report

Energy Conservation Measure (ECM) is a measure primarily designed to reduce the use of energy resources in a facility.

Energy Consumption Analysis is the evaluation of all energy systems and components by demand and type of energy including the internal energy load imposed on a major facility by its occupants, equipment and components and the external energy load imposed on a major facility by the climatic conditions of its location. Energy Consumption Analysis includes, but is not limited to:

• The comparison of a range of alternatives that is likely to include all reasonable, Cost-effective ECMs and alternative energy systems;

• The simulation of each system over the entire range of operation of a major facility for a year’s operating period; and

• The evaluation of energy consumption of component equipment in each system considering the operation of such components at other than full or rated outputs.

Facility means a building or other structure owned or controlled by a Contracting Agency that is used or occupied by employees of the Contracting Agency or that is used for conducting public business.

Renovation means an addition to, alteration of or repair of a facility that adds to or alters the facility’s energy systems, provided that the affected energy systems account for 50 percent or more of the facility’s total energy use.

2.4 OVERVIEW

The SEED program was established in 1991 and directs authorized state agencies to work with ODOE to ensure cost-effective energy conservation measures are included in new and renovated public buildings. The program also requires that all newly constructed or renovated state facilities exceed the energy conservation provisions of the Oregon State building code by at least 20 percent.

Per OAR 330-130-0090(1)(a), ODOE is required to establish a list of prequalified Energy Analysts to execute the provisions of the SEED program through a solicitation process that uses qualification-based scoring criteria to determine a person’s ability to perform building energy analysis. Further, per ORS 276.915, whenever a Contracting Agency determines that a major facility is to be constructed or renovated, such Contracting Agency shall require, in the design phase of the construction or renovation project, that an energy consumption analysis be prepared under the direction of a person that is prequalified by ODOE.

RFQ #24-026 Oregon State Energy Efficient Design (SEED) Energy Analyst Page 6 of 17

2.4.1 Solicitation Process

ODOE will establish a short list consisting of those Interested Proposers that meet the qualifications of this RFQ, pursuant to the evaluation criteria below, and those Interested Proposers that qualify will be invited to join a pool of prequalified firms by entering into a Prequalified List Agreement (see Attachment A, Sample Prequalified List Agreement).

Once prequalified, the Energy Analyst is eligible to submit a bid or proposal to direct an energy consumption analysis for a Contracting Agency (ORS 276.915(7)).

Per OAR 330-130-0090, Contracting Agencies must only select persons or firms that have been prequalified by ODOE to perform energy analysis services, unless a Contracting Agency has requested and received preapproval from ODOE for an exemption (See ORS 276.915(7) and OAR 330-130-0090(1)(a)(B)).

Following prequalification, ODOE is not responsible for or involved in the follow-on procurement and contracting processes of Contracting Agencies for Energy Analyst services. Consequently, ODOE will not issue a subsequent RFP following conclusion of this RFQ process. This RFQ does not commit ODOE to enter into a Contract, as that term is defined under the public contracting code (ORS 279A, ORS 279B, ORS 279C). Execution of a Prequalified List Agreement does not obligate ODOE in any way to the prequalified entity, nor does it guarantee a Contracting Agency will select a firm prequalified for the performance of Energy Analyst services. Further, Contracting Agencies must still comply with and a prequalified entity must still participate in any follow-on procurement processes applicable to the Contracting Agency for the performance of Energy Analyst services. Nothing in this RFQ nor Prequalified List Agreement relieves any Contracting Agency from complying with all applicable laws and regulations, including the Contracting Agency’s procurement rules.

2.5 DESCRIPTION OF AN ENERGY ANALYST

An Energy Analyst is an advocate for energy efficient design resulting in a building that serves as a model of energy efficiency and leads design team efforts in implementing energy efficient strategies in the building systems design. Through early involvement in the design process, the Energy Analyst assures energy efficiency is an integral part of the building design.

An Energy Analyst shall be knowledgeable about all building systems (including building envelope, heating, ventilation, air-conditioning, and lighting systems) and shall have expertise with current energy efficient technologies.
