The procurement seeks hardware and services for approximately 122 low-bandwidth pole-mounted terminals for AHAB siren remote terminal units, 4 portable/mobile terminals for SEOC field deployment, and 2 higher-bandwidth terminals for fixed sites. Bidders must provide hardware with standard data connection outputs, ensure terminals remain functional upon contract expiration, deliver only new equipment, and maintain a current hardware catalog with pricing. The pre-bid conference is scheduled for Wednesday, October 21, 2026, at 11:00 AM PDT via Microsoft Teams. The RFP questions deadline is Monday, November 2, 2026, at 5:00 PM PST, with responses posted by November 9, 2026. Proposals are due Thursday, December 3, 2026, at 5:00 PM PST, with an anticipated announcement of the apparent successful bidder by January 15, 2027. The contract term is three years with two optional three-year renewal periods, with initial delivery required no later than 90 days after order placement and no later than 90 days after completed contract execution.

Data service requirements include measurable latency less than 100 milliseconds, priority connectivity service tiers, and encrypted data transmission support for all sites. Low-bandwidth sites require minimum download speeds of 10 Mbps and upload speeds of 5 Mbps, with approximately 3-5 GB/month data allowance per terminal structured for pooled or low per-terminal costs. Mobile and higher-bandwidth sites require download speeds of 25 Mbps or greater and upload speeds of 10 Mbps or greater, with the ability to operate outside pooled data structures and relocate within Washington State without roaming charges. Contractors must provide a centralized management portal, 24/7/365 technical support, and maintain a 99.9% uptime Service Level Agreement, with critical service outages requiring immediate response and non-critical operational support within 24 hours. WMD anticipates purchasing approximately 130 terminals over the contract life with an annual service budget of around $50,000, not including initial equipment costs, though these figures are provided for planning purposes only and do not guarantee minimum purchase volumes. The contract is fixed-price with maximum allowable annual cost increases of 3% per year, and bidders must bear all credit card processing or surcharge fees. Voluntary MWBE participation goals of 10% for Minority Business Enterprises and 6% for Women's Business Enterprises are encouraged. Additional procurement preferences provide 15 points for firms without mandatory individual arbitration clauses, 20 points for Washington small businesses, and 20 points for certified veteran-owned businesses, with a maximum of 30 combined points for businesses qualifying as both small and veteran-owned.

SECTION 2 - INFORMATION ABOUT THE PROCUREMENT

2.4 PURPOSE OF THE PROCUREMENT. The purpose of this Competitive Solicitation is to receive competitive bids to evaluate and, as appropriate, award a Contract for WMD to procure Low Earth Orbit (LEO) satellite internet data service and associated hardware specific goods and/or services as set forth herein. Pursuant to Washington’s Procurement Code for Goods and Services, RCW chap. 39.26, state agency purchases of goods and services must be based on a competitive solicitation process in which the Contract is awarded to the lowest responsive, responsible bidder. This RFP may be used to identify more than one Contractor, representing different Low Earth Orbit (LEO) satellite constellations for redundancy and continuity.

2.5 SCOPE OF WORK OF THE PROCUREMENT. WMD is soliciting bids from qualified Contractors to provide Low Earth Orbit satellite internet service and associated hardware to support the Washington State Emergency Management Division's statewide emergency communications infrastructure, including the All-Hazard Alert Broadcast (AHAB) siren network, State Emergency Operations Center (SEOC) field and continuity operations, and other WMD satellite connectivity needs that may arise during the Contract term.

WMD operates approximately 122 AHAB sirens located primarily along the Washington coast, providing outdoor public alerting for tsunamis and other hazards. Satellite connectivity serves as a primary communication path between siren remote terminal units (RTUs) and the control system, with cellular or other terrestrial connections providing redundancy at most, but not all, sites. WMD also requires satellite connectivity for a small number of higher-bandwidth fixed sites and several mobile terminals supporting SEOC field deployment and continuity of operations. Other satellite internet use cases for WMD may be also supported through this contract.

The awarded Contractor shall provide:

2.5.1 Hardware: Satellite terminals and associated equipment suitable for three deployment types. Numbers are provided for planning reference and may change:

Low-bandwidth, pole-mounted terminals for AHAB siren RTU sites (122 sites);

Portable/mobile terminals (4) for SEOC field deployment, continuity operations, and other required use cases;

Higher-bandwidth terminals for a small number (2) of fixed sites.

Terminals must be capable of, or the Contractor must sell appropriate hardware for, mounting to a wood utility pole. Terminals must output a standard data connection (e.g., Ethernet) to a separate modem, gateway, or networking device supplied by WMD. Terminals must not be rendered inoperable, bricked, or deactivated by Contractor upon Contract expiration or termination; WMD shall retain functional use of hardware it has purchased regardless of the status of the service contract.

Only original, new-condition hardware shall be delivered; substituted, refurbished, used, or non-original hardware will not be accepted. Contractor must provide hardware availability and provide advance notice of hardware revisions or End-of-Life changes. Additionally, Contractor must provide and maintain a complete and current ‘catalog’ of hardware and accessories list with pricing.

Contractor shall provide, in writing, the process for WMD to troubleshoot hardware problems and exercise warranty claims. WMD shall have the benefit of the manufacturer's/ Contractor's standard hardware warranty.

All applicable electronics must be listed on the Electronic Products Environmental Assessment Tool Registry (EPEAT).

2.5.2 Data Service: Contractor shall provide, or be an authorized reseller of, LEO satellite data service meeting, at minimum:

For all sites:

Measurable latency of less than 100ms;

A priority (or equivalent non-best-effort) connectivity service tier for all terminals.

Support for encrypted data transmission (e.g., VPN or equivalent secure tunneling) between terminals and WMD's network, without material degradation to latency or throughput performance.

In addition to the common requirements, for low-bandwidth sites:

Download speeds of 10 Mbps or greater (25 Mbps or greater preferred);

Upload speeds of 5 Mbps or greater (10 Mbps or greater preferred);

A data allowance of approximately 3-5 GB/month per terminal, with pricing structured to reflect low per-terminal cost across a large multi-site deployment, such as pooled data or an alternative solution;

o If using a pooled data structure, Contractor must provide a pathway for accommodating and billing for unexpected increases in data consumption without service.

In addition to the common requirements, for mobile and higher bandwidth sites:

Download speeds of 25 Mbps or greater (50 Mbps or greater preferred);

Upload speeds of 10 Mbps or greater (15 Mbps or greater preferred);

The ability for certain terminals to reside in a standby state, with service able to be activated at time of need (within 1 hour), or a similar capability;

The ability to operate outside any pooled or capped data structure;

Mobile terminals must be capable of relocating to different areas within Washington

State without incurring roaming charges or other penalties.

Contractor shall provide, in writing, the process of WMD to relocate and subsequently

(re)activate mobile terminal devices.

2.5.3 Program Management and Support: Contractor shall provide a centralized management portal for device activation, monitoring, and billing; 24/7/365 technical support and trouble reporting; and a defined uptime Service Level Agreement of at least 99.9%, consistent with industry-standard offerings for Priority-tier LEO satellite service. The Contractor management portal must be capable of supporting multiple users.

The Contractor may provide a tiered support model to ensure timely and effective resolution of service needs. At a minimum, the Contractor must meet the following response requirements:

Critical Service Outage: If the supported service becomes unavailable or experiences a critical failure, the Contractor shall provide immediate response and begin remediation without delay.

Non-Critical Operational Support: For operational needs that do not impact immediate continuity of service, such as relocation of units or routine adjustments, the Contractor shall provide a response within 24 hours of notification.

Failure to meet any SLA requirement may constitute grounds for contract termination or other remedies as determined by the State. The State reserves the right to cancel the contract, in whole or in part, if the Contractor repeatedly or materially fails to meet SLA obligations.

Contractor must provide advanced notice of at least 24 hours of any planned service interruptions, maintenance, or testing that could affect service availability or performance, when such notice is made available to Contractor by the underlying satellite provider, regardless of whether the affected service is currently active.

Contractor shall monitor the Service for each device and provide real-time, end-to-end status visibility to WMD via the management portal. Contractor shall maintain and provide an issue escalation procedure identifying points of contact, escalation order, and resources engaged at each stage. All data transmitted is WMD's data; Contractor shall not access, monitor, capture, or tag WMD data.

2.5.4 Contractor Neutrality: This procurement is open to qualified resellers/value-added resellers of any LEO satellite constellation meeting the requirements herein and is not intended to be restricted to a single reseller of a given constellation's service.

2.5.5 Deployment and Phasing: WMD has some initial funding to procure an initial batch of terminals and associated initial annual service. WMD anticipates continuing to procure additional terminals and service incrementally, as funding becomes available, until the siren network and other identified sites are fully equipped. Thereafter, the Contract will primarily support ongoing data service, hardware replacement, additional terminals as needed, and technical support.

2.5.5.1 Contractor shall provide estimated time to delivery for all specified goods and services. Goods and services should be delivered no later than 90 days after order is placed with Contractor, and be available starting no later than 90 days after completed contract.

2.6 CONTRACT TERM. The resulting Contract term is three (3) years, with two (2) optional three (3) year renewal periods. The awarded contract may be extended if necessary, due to funding or time constraints.

2.7 ESTIMATED CONTRACT VALUE. Although WMD does not represent or guarantee any minimum purchase from the Contract, WMD anticipates purchasing approximately 130 terminals over the life of the Contract (across siren, fixed, and mobile site types) with an annual service budget of around $50,000, not including initial equipment costs. Contractors are encouraged to be as competitive as possible. These figures are provided for planning purposes only, based on preliminary Contractor pricing information, and do not constitute a guarantee of purchase volume or value.

2.8 CONDITIONS OF WORKING ON-SITE. Successful Bidders must be willing to work on the WAARNG/WMD installations during normal business hours and on the availability of site personnel. Generally, this is Tuesday through Friday from 7:00 am through 4:30 pm. Any site work NOT within the agency’s core hours is to be coordinated and scheduled a minimum of one (1) week in advance of the site visit. This will allow personnel to be present and available during those hours. Failure to provide advance notice may result in temporary denial of access to the installation and/or time delays and interruptions of daily operations at Camp Murray.

2.9 SUBCONTRACTOR PARTICIPATION MONITORING AND REPORTING Once a contract is awarded through the solicitation or proposal process, the awarded Prime Contractor is obligated to complete the Contractor registration in Access Equity. Access Equity is a secure online Contractor management system (B2GNow). Confidential information (Tax ID, etc.) will not be published. Prime Contractors that have previously registered with B2Gnow for any public entity, must verify the system has updated information. Contractors can access the system at https://omwbe.diversitycompliance.com/ or through a direct link on the Office of Minority and Women’s Business Enterprises (OMWBE) website at: https://omwbe.wa.gov/.

Each month during the contract, the Prime Contractor will report payments to ALL Subcontractors through the Access Equity system. This monthly reporting information includes total payment in dollars made to the Subcontractor, payment dates, and any additional information required to verify payment to Subcontractors. The Prime Contractor will enter this payment information into the Access Equity system, and the Subcontractors will verify this payment information in the system. Online training is available through the Access Equity/B2Gnow system. This requirement applies to both Prime Contractors and Subcontractors.

4.1. OVERVIEW. The WMD will evaluate proposals for this RFP as described below.

The WMD reserves the right to determine a Bidder’s compliance with the requirements specified in this RFP, request clarification, and to waive informalities in a proposal. An informality is an immaterial variation from the exact requirements of the competitive RFP, having no effect or merely a minor or negligible effect on quality, quantity, or performance of the services being procured, and the correction or waiver of which would not affect the relative standing of, or be otherwise prejudicial, to bidders.

The WMD reserves the right to: (1) Waive any informality; (2) Reject any or all proposals, or portions thereof; (3) Accept any portion of the items proposed unless the bidder stipulates all or nothing in their proposal; (4) Cancel an RFP and re-solicit proposals;

and/or (5) Negotiate with the highest scored responsive and responsible bidder to determine if that proposal can be improved.

The WMD will use the following evaluation criteria for an award of a contract:

EVALUATION SCORING AND CRITERIA

The following points/awards will be assigned to the proposal for evaluation purposes (maximums):

Bid Responsiveness Pass/Fail

Responsibility Pass/Fail

Exhibit C – Performance Requirements 104 points

Exhibit D – Bid Sheet 100 points

4.2. RESPONSIVENESS. The WMD will review proposals – on a pass/fail basis to determine whether the proposal is ‘responsive’ to this RFP. This means that WMD will review each proposal to determine whether the proposal is complete (i.e., does the proposal include each of the required proposal submittals, are the submittals complete, signed, legible?). WMD reserves the right – in its sole discretion – to determine whether a proposal is responsive. Bidders whose proposals are determined to be non-responsive will be rejected and will be notified of the reasons for this rejection. See Exhibit A1 for a checklist of responsiveness.

4.3. RESPONSIBILITY ANALYSIS. The WMD will review Bidder’s responses to Exhibit C – Performance Requirements and make reasonable inquiry to determine the Bidder’s responsibility. The WMD’s assigned Evaluation Team will determine Bidder responsibility on a pass/fail basis.

The WMD may request record of past performance, clarification of a Bidder’s offer, on-site inspection of a Bidder’s or subcontractor’s facilities, or other information as necessary. WMD may use references to confirm satisfactory customer service, performance, satisfaction with service/product, knowledge of products/service/industry and timeliness. The WMD reserves the right to be its own reference. Any negative or unsatisfactory reference can be reason for rejecting a bidder as non-responsible.

4.4. PERFORMANCE REQUIREMENTS AND PRICE EVALUATION. WMD’s designated Evaluation Team will review, evaluate, and score each Bidder’s response to this RFP. Pricing scores will be calculated using the following formula:

(Lowest Bidder Pricing (NRC + MRC for the Initial Term) ÷ Bidder Being Evaluated Pricing (NRC + MRC for the Initial Term)) × 100 points

4.6. CONTRACT NEGOTIATIONS. The WMD will negotiate with the Top Bidder(s) to finalize contract terms and to determine if the proposal may be improved. If, after a reasonable period of time, WMD, in its judgement, cannot reach agreement on acceptable contract terms with the Top Bidder(s), WMD may suspend negotiations and undertake negotiations with the next Bidder as determined by the evaluations.

SECTION 5 - CONTRACT AWARD

5.1 ANNOUNCEMENT OF APPARENT SUCCESSFUL BIDDER. The WMD will determine the Apparent Successful Bidder(s) (ASB). The ASB will be the responsive and responsible Bidder(s), whose proposal, in the sole opinion of the WMD, best meets the requirements of this RFP and presents the best total value to the WMD.

Designation as an ASB does not imply that the WMD will issue an award for a contract to the designated firm. Rather, this designation allows the WMD to perform further analysis and ask for additional documentation. A Bidder’s failure to provide requested information to WMD within ten (10) business days may result in disqualification. The Bidder must not construe ASB designation as an award, impending award, attempt to negotiate, etc. If a Bidder acts or fails to act in response to designation as an ASB or a request for information, it does so at its own risk and expense.

Upon announcement of the ASB, bidders may request a debriefing conference as specified in Exhibit E – Complaint, Debrief & Protest Requirements.

5.2 CONTRACT EXECUTION. Subject to protests, if any, and the process outlined in section 4.7 above, the WMD and the ASB will enter into a contract as set forth in Exhibit B1 – Proposed Contract.

An award, in part or full, is made and a contract formed by signature of the WMD and awarded Bidder on the contract. The WMD reserves the right to award on an all-or-nothing consolidated basis.

Following the award of the contract, all Bidders will receive a Notice of Award, usually through an email to the Bidder’s email address provided in the bidder’s proposal.

5.3 ADDITIONAL AWARDS. WMD reserves the right, during the resulting Contract term, to make additional Contract awards to responsive, responsible bidders who provided a bid but who were not awarded a Contract. Such awards would be on the same or substantially similar terms and conditions and would be designed to address a Contractor vacancy (e.g., a contractor is terminated or goes out of business) or be in the best interest of the State of Washington.
