Capitalized terms not specifically defined in this document are defined in OAR 125-246-0110.

Terminology specific to the OregonBuys system may be found at OregonBuys.

The Oregon Water Resources Department (OWRD) is charged with carrying out the water management policies and rules set by the Water Resources Commission and with overseeing the enforcement of Oregon’s water laws.

The OWRD is organized into five divisions: Field Services, Technical Services, Water Rights and Adjudicaons, Director’s Office, and Administrave Services. OWRD headquarters and the Northwest Regional Office are in Salem, Oregon. The OWRD also has four other regional offices and 20 small field offices throughout Oregon.

The Field Services and Technical Services Divisions manage and administer the gage staon operaons and maintenance. The OWRD operates and maintains over 250 gaging staons across the state. OWRD invites proposals for its purchase of water measurement devices. See the list of device specificaons below.

The Crooked River Collaborave Water Security and Jobs Act of 2014 (CRCWA) resulted in, among other things, a modificaon to the use of water storage rights in the Prineville Reservoir. Due to modificaons in the number of account holders by the passage of the CRCWA, a more detailed accounng of Crooked River diversions is required. To determine how accounts are filled and how unused water is carried over from one water year to the next water year, exisng Hydromet gages [operated, maintained and managed by Oregon Water Resources Department (OWRD) and the U. S. Bureau of Reclamaon (Reclamaon)] are ulized to track inflows, oulows, and diversions along the Crooked River.

In a connuing effort to effecvely manage and oversee the allocaon of water resources in the Crooked River, OWRD and Reclamaon have idenfied the need for the measurement of the Crooked River Central Diversion from the Crooked River downstream of the Prineville Reservoir. The OWRD District 24 Watermaster’s office and the Bureau of Reclamaon will use data gathered at the site for water management and for hydrologic analysis to support water management and policy decisions.

Oregon Water Resources Department (OWRD) is requesng a proposal for construcon of a concrete flume to upgrade the Crooked River Central Diversion to accommodate a stream gaging staon. These services will upgrade the exisng Crooked River Central Diversion with a concrete flume to enable gage measurement at the site – specifically, upgrades to the South ditch facilitate measurement of the diversion. Measurement equipment will be provided by OWRD. These services will be funded with our exisng contract with the Bureau of Reclamaon.

The proposed Crooked River Central (CRC) diversion is in the Northwest Quarter of the Northeast Quarter of Secon 27, Township 14 South, Range 15 East. The approximate site coordinates are 44.33393°, -120.91300° (Figure 1). The proposed concrete flume project area is located approximately 950 feet west of the diversion along the south ditch (Figure 2). The CRC diversion (RM 44.3) is located approximately 3.5 miles downstream of the Highway 126 bridge in the City of Prineville.

Driving Directions:

Beginning in the City of Prineville, drive northwest on the O’Neil Highway (HWY 370) for roughly 4 miles to Elliot Ln. Turn North (right) on Elliot Ln. and travel approximately 1/3 mile to the gate on the right. Turn east (right) onto the gravel road and travel roughly 3/4 mile to the gravel turnaround and the diversion structure.

The project area is secured behind at least 2 gates and accessible to large vehicles, including concrete trucks.

The Crooked River Central (CRC) diversion site consists of a diversion structure, a concrete headgate structure, headgate, fish ladder, and a secondary turbine pump down-gradient of the headgate (Figure 3). There are two irrigaon ditches leading from the diversion – the north ditch supplied by the turbine pump, and the south ditch supplied by gravity flow.

The proposed concrete flume is to be located within the south ditch, approximately 950 feet west of the diversion headgate. The south ditch is currently unlined with alluvial surface soils comprised of silty SAND and GRAVEL with scatered cobbles.

The proposed work is expected to take place out of the irrigaon season; therefore, no water is expected in the south ditch during construcon and no dewatering design is needed. While groundwater is generally shallow at the project site, the proposed concrete flume subgrade elevaon is not ancipated to intersect the groundwater table. During periods of diversion for irrigaon in the summer months, the south ditch conveys water at a rate between 5 and 25 cubic-feet-per-second (cfs).

An underground ulity locate (411) is required prior to the work. However, underground ulies are not ancipated at the flume construcon site.

The proposed concrete flume is located approximately 950 feet west of the Crooked River Central Diversion structure within the exisng south ditch (Figure 4). The exisng unlined ditch is approximately 3.5 feet deep and between 18 and 25 feet wide. The exisng grade elevaon of the south ditch is adequate and is to be maintained through the finished flume structure.

Required dimensions of the proposed structure are presented on Figures 5a and 5b. As shown on Figure 5a, proposed flume dimensions consist of an 8-foot-wide, by 10-foot-long, by 3-foot-deep concrete box with 10-inch-thick floor and walls. A 3-inch-wide by 36-inch-long, ¼-inch stainless steel channel is required at the downstream end to accommodate weir boards (Figure 5b).

Ancipated site preparaon consists of excavaon of near-surface soils and subgrade placement and compacon. Reinforcement shall consist of #5 Rebar. Finished flume walls shall be backfilled with clean, compacted backfill to finished grade. Clean, screened 4- to 6-inch rock shall be placed along the upstream and downstream lips of the structure to minimize erosion.

To provide a foundaon for the NEMA box gage house, a 4-foot by 4-foot by 6-inch-thick concrete pad is required adjacent to the concrete flume. The pad may be integrated into the north wall of the flume as needed or may be formed separately. The pad must be along the north side of the flume and south of the exisng access road.

Fencing of adequate size and strength is required around the NEMA box gage house. The fencing shall consist of metal posts with cross bracing to prevent livestock damage to the gage house. The fenced area should be large enough for entry and maintenance of the NEMA Box and associated instrumentaon (approximately 10’ by 10’). A lockable gate is required.

To accommodate power and communicaon between the exisng CRC diversion and the proposed NEMA box gage house, a 950-foot-long trench and 1-inch conduit is required along the exisng access road.

• Proposer with the second lowest Price Proposal will receive 10 points.

• Proposer with the third lowest Price Proposal will receive 5 points.

• All other Proposers will receive 0 points.

Agency prefers Oregon Goods and Services, and for evaluaon purposes per ORS 279A.128, Agency shall subtract 5% from the price for any Proposer proposing all Goods fabricated or processed or all services performed enrely in Oregon before calculang the price score.

For evaluaon purposes per OAR 137-046-0310, Agency shall add a percentage increase to each out-of- State Proposer’s Proposal price that is equal to the percentage preference, if any, given to a resident Proposer in the Proposer’s State.

Agency will give preference to Goods manufactured from Recycled Materials if each of the condions specified in ORS 279A.125(2) exists following any adjustments made to the price of the Goods according to any applicable reciprocal preference.

If Agency receives Proposal idencal in price, fitness, availability, and quality and chooses to Award a Contract, Agency shall Award the Contract in accordance with the procedures outlined in OAR 137-046- 0300.

4.10.3 Price Evaluaon 20

The SPC will average all scores for each evaluaon criterion. The average score will be used as a percentage mulplier of the maximum points for that criterion. 1=10%, 5=50%, 7.2=72%, 9=90%, etc. Price points are calculated as stated in the Price Evaluaon secon as set forth in Secon 4.10.3.

Example:

Proposer A receives scores of 10, 9, and 9.5 for criterion worth 50 points. The SPC averages 10, 9, and 9.5 for a score of 9.5 and uses 95% as a mulplier to the possible points of 50. 50 Mulplied by 95% is 47.5. Proposer A’s points for the criterion is 47.5.

The SPC will average the scores for each Proposal in a given round of compeon (calculated by totaling the points awarded by each Evaluaon Commitee member and dividing by the number of members). The SPC will combine the average score for each Proposal with Proposer’s Price Score and Reference Score.

Aer any applicable preference has been applied, the SPC will determine the rank of each Proposal, with the highest score receiving the highest rank, and successive rank order determined by the next highest score.

Agency may, in Agency’s sole discreon, determine an apparent successful Proposer with no addional rounds of compeon. If addional rounds are conducted, Agency will rank advancing proposers at the conclusion of each subsequent round and may determine an apparent successful Proposer at any me during the Solicitaon process.

NEXT STEP DETERMINATION

At the conclusion of a round of compeon, Agency may choose to conduct addional round(s) of compeon if it’s in the best interest of the State. Addional rounds of compeon may consist of, but will not be limited to:

• Interviews

• Presentaons/Demonstraons/Addional Submital Items

• Discussions and submital of revised Proposals

• Serial or simultaneous Negoaons

• Best and Final Offers

If Agency, in its sole discreon, determines that one or more addional rounds of compeon is necessary, it will select a Compeve Range to indicate the Proposers that will be invited to parcipate in a subsequent round. The Compeve Range may include all, or at Agency’s sole discreon, some (based primarily on a natural break in the distribuon of scores), of the Proposers from a previous round. Agency will post a noce in OregonBuys of its Compeve Range Determinaon and provide details about the process and schedule for the subsequent round.

Proposers excluded from a round may submit a writen protest of Compeve Range. Protest must:

• Be emailed to the SPC;

• Reference the OregonBuys Bid Solicitaon number;

DAS Procurement Services, Version 4.5 March 31, 2023 Page 17 of 20

• Idenfy Proposer’s name and contact informaon;

• Be sent by an authorized representave;

• State the reason for the protest; and

• Be received within 7 Calendar Days aer issuance of the Noce of the Compeve Range unless a different due date and me is specified in such noce.

Agency will address all protests within a reasonable me and will issue a writen decision to the respecve Proposer. Protests that do not include the required informaon may not be considered by Agency.

No addional round(s) planned for the RFP.

Agency, if it awards a Contract, will Award a Contract to the highest ranking Responsible Proposer(s) based upon the scoring methodology and process described in Secon 4. Agency may Award less than the full Scope of Work described in this RFP.

Agency will nofy all Proposers in wring that Agency intends to Award a Contract to the selected Proposer(s) subject to successful negoaon of any negoable provisions.

An affected Proposer shall have 7 calendar days from the date of the Intent to Award noce to file a writen protest.

A Proposer is an Affected Proposer only if the Proposer would be eligible for Contract Award in the event the protest was successful and is protesng for one or more of the following reasons as specified in ORS 279B.410:

• All higher ranked Proposals are non-Responsive.

• Agency has failed to conduct an evaluaon of Proposals in accordance with the criteria or process described in the RFP.

• Agency abused its discreon in rejecng the protestor’s Proposal as non-Responsive.

• Agency’s evaluaon of Proposal or determinaon of Award otherwise violates ORS Chapter 279B or

ORS Chapter 279A.

If Agency receives only one Proposal, Agency may dispense with the evaluaon process and Intent to Award protest period and proceed with Contract Negoaons and Award.

Protests must:

• Be delivered to the SPC via email;

• Reference the OregonBuys Bid Solicitaon number;

• Idenfy Proposer’s name and contact informaon;

• Be signed by an authorized representave of Proposer;

• Specify the grounds for the protest; and

• Be received within 7 calendar days of the Intent to Award noce.
