SECTION 1: GENERAL INFORMATION

1.1 INTRODUCTION

The State of Oregon, acting by and through the Oregon Department of Fish & Wildlife, (“ODFW” or “Agency”), is issuing this Request for Proposal under the provisions of ORS 279B.060.

The Agency is seeking a Contractor (hereafter “Contractor” or “Provider”) to provide up to two

(2) Helicopters, experienced Pilot(s), and support services including a fuel truck with licensed driver to support simultaneous missions. The Contractor will provide approximately 405 hours of helicopter flights for big game census operations during the fall for deer, during summer for pronghorn and bighorn sheep, and during the spring for elk, deer, and bighorn sheep. Anticipated areas of operation will include all areas within Klamath, Lake, Harney, and Malheur Counties, Oregon. Additional need for wildlife management activities including, but not limited, disease surveillance, damage activities, wildlife research, limited wildlife capture operations, and animal census may be requested of the Contractor during other times of the contract period.

Rocky Mountain elk, mule/white-tailed deer, bighorn sheep and pronghorn are the primary big game species in Eastern Oregon. These species have high social, economic, aesthetic and hunting values and play important roles in the economies of rural communities. Periodic abundance estimates and annual post season/post winter sex ratios and young to adult ratios are critical to Agency objectives to achieve healthy big game populations and recreational opportunity. The Agency has authorization to conduct wildlife management activities under ORS. 496.012 with related tag issuance under ORS 496.146 (11).

The Agency anticipates the award of one Contract from this RFP.

The term of the Contract is anticipated to be eight (8) years (through June 30, 2033). In May of each year the Agency will contact the Contractor with rate adjustments based on the reported Consumer Price Index (CPI – U) for Portland Oregon. Agency reserves the right to adjust pricing based only on the CPI or negotiate with Contractor for additional cost. Adjustments to pricing will be processed by written Amendment.

Additional details are included in the Scope of Work section.

2.3 OVERVIEW AND PURPOSE

2.3.1 Agency Overview and Background

The Agency’s mission is to protect and enhance Oregon's fish, wildlife, and their habitats for use and enjoyment by present and future generations. Proposals are being requested by the Agency’s Wildlife Division. The Wildlife Division consists of two main programs – Diversity Program and Game Program.

• The Diversity Program is responsible for statewide species surveys, conservation and management of sensitive, threatened, and endangered species, marine mammal health, and implementation of the State Wildlife Action Plan

• The Game Program is responsible for inventories of game species, game management, hunter surveys, harvest regulations, investigation of wildlife diseases, wildlife damage prevention and response, and predator control.

This proposal request is under the Game Program with the goal of supporting the Agency mission by conducting big game survey operations, wildlife research, disease surveillance, other wildlife species census, related wildlife actions, and habitat condition inventories.

2.4 SCOPE OF WORK/SPECIFICATIONS

Aerial inventory techniques are used to monitor mule deer throughout the eastern region. The optimal time for aerial surveys is when mule deer have a more concentrated distribution on their winter habitat (e.g.: animals occupy more open habitat in spring when vegetation starts to green up). Most flights occur in November/December for mule deer herd composition counts, in July for pronghorn and bighorn sheep herd composition counts, and in March/April for measuring recruitment. Fall buck ratios are compared with agency management objectives for each Wildlife Management Unit. These data are used to build population models, and direct public hunting season recommendations. For elk, the primary goals is to complete surveys before the bulls shed their antlers and late enough in the season that calves can be assumed to be recruited into the population. As a result, some surveys for Rocky Mountain Elk in eastern Oregon may not be completed until April. Bull and calf ratio data are used to build elk population models and are compared with Agency management objectives for each Wildlife Management Unit. This information is necessary for the Agency to manage Elk populations compatible with primary uses of the land, and direct public hunter season recommendations. Pronghorn buck and fawn ratios are used to model and estimate harvest strategies. Bighorn sheep herd composition data is used to monitor population performance and to understand the number of older age rams in each population that are available for harvest.

The Proposer (s) will:

a. Provide up to two (2) helicopters, experienced pilot(s), fuel/service truck(s) and driver(s) to support simultaneous missions.

b. Transport up to three (3) authorized Agency personnel as flight passengers to conduct big game surveys, wildlife research and disease sampling procedures at designated locations.

c. Conduct approximately 405 hours of helicopter based operations to include wildlife surveys, wildlife research, disease sampling assistance, and habitat condition surveys, DAS Procurement Services, Version 4.4 July 1, 2021 Page 7 of 24 during three (3) separate mission periods, throughout several wildlife management units. Operations are expected to begin in Klamath County and work in an efficient manner through Lake and Harney Counties ending with surveys in Malheur County, however the order and direction of operation may be modified based on needs of the Agency. Refueling will often occur in remote locations via fuel truck.

d. Provide mechanic services, given reasonable accommodations, to perform any necessary aircraft maintenance during the contract period.

e. Meet with the designated Agency biologist and be ready to fly at sunrise each morning.

The usual procedure will be to fly eight (8) hours per day, at the Agency biologist’s discretion.

f. Provide the ability to support on-board tablet devices with ship supplied power and mounting options for project needs. Agency will provide tablets (iPads).

g. Be ready to launch the aircraft in sub-zero temperatures and potentially inclement weather and without overnight indoor cover. The agency cannot guarantee indoor cover or access to electrical outlets for this project.

h. Determine all conditions regarding safety prior to and during the flight. Advise Agency if conditions are unsafe and either forgo the particular flight or return to base or any other site deemed appropriate for safety reasons.

i. Coordinate flight schedule with Agency contact no less than 30 days in advance of the anticipated start date. Flight schedule is approximate, and may be subject to change for reasons of inclement weather, animal distribution as a result of range conditions and weather, data collection needs, or budget availability. Schedules may be adjusted between locations if necessary to complete survey work in an effective manner. Actual departure sites may vary to facilitate efficient and safest use of helicopter time. Schedule may also require non-flight days to accommodate weather conditions, aircraft service schedules, and unforeseen events. Additional mission periods may be requested by Agency within the contract period.

j. For non-flight (Stand By) days to accommodate for weather, Agency may choose to reimburse the Contractor a flat rate per day.

The Agency will:

a. Provide up to three (3) Agency biologists as observers and survey equipment.

b. Provide dates and times of flights.

c. Provide maps of areas to be surveyed as requested by Proposer.

Instruct the Proposer’s pilot regarding survey locations, routes, approaches, flight patterns, and techniques to allow the Agency biologists to collect all necessary big game survey data.

2.5 SAFETY PROCEDURES:

The Proposers pilot(s) must communicate and maintain all safety procedures. Safety procedures

DAS Procurement Services, Version 4.4 July 1, 2021 Page 8 of 24 will not be compromised at any time during the Contract.

2.6 AIRCRAFT TO BE PROVIDED: AS DESCRIBED IN SECTION 3.1.1

2.7 AIRCRAFT OR EQUIPMENT BREAKDOWN:

Should the helicopter or other essential equipment break down and cause delay or termination of the operation, the equipment shall be repaired or replaced within 48 hours to allow continuance of the project. Failure to do so may result in a $500/day penalty until deficiencies are corrected. In the event weather conditions force a long-term shutdown during the surveys, and it is agreed the airship has to return to its home base then one-half the ferry time will be paid.

All aircraft repairs must be made in accordance with FAR Part 135 standards before the operation proceeds.

2.8 PILOT TO BE PROVIDED: AS DESCRIBED IN SECTION 3.1.4

2.9 ADDITIONAL OR SUBSTITUTE HELICOPTER OR PILOT:

If for any reason an additional or substitute helicopter or pilot are required to complete the work required under this contract, it will be the responsibility of the contractor to supply or subcontract the same, within 48 hours, and with ODFW approval, at the contractor’s expense.

The contractor must specify names of pilots provided for this contract and may not provide substitute pilots without prior approval by ODFW.

2.10 POOR PILOT PERFORMANCE:

ODFW reserves the right to ground any pilot who, in its sole opinion, violates Contract requirements, is unsafe, or otherwise performs unsatisfactorily. Contractor will be required, within 48 hours, to replace the grounded pilot. All replacements shall be approved in advance of use under the contract by ODFW. Failure to furnish a replacement pilot within the specified time will authorize ODFW to assess Contractor the amount of $500 per day for delay.

2.11 DAMAGES:

Contractor shall deliver within the time indicated in Sample Contract (Attachment A). Should Contractor fail to meet the delivery schedule, thereby making it necessary for the State to purchase urgently needed services from another source, Contractor shall pay the difference between the accepted bid price and the new purchase price.

2.12 SPECIFIC REQUIREMENTS:

Successful Proposer shall:

• Meet with the designated Agency biologist and be ready to fly at sunrise each morning. The usual procedure will be to fly eight hours per day, at the biologist’s discretion.
