2.2.1 General Definitions
Capitalized terms not specifically defined in this document are defined in OAR 125-246- 0110.
2.3 OVERVIEW AND PURPOSE
2.3.1 Agency Overview and Background
The Oregon Department of Fish and Wildlife (ODFW) is responsible for managing Oregon’s fish and wildlife resources. As part of the ODFW, the Marine Resources Program (MRP) works with Oregonians to sustain ocean and estuary resources by: 1. Building understanding about fish, wildlife, and their habitats as well as peoples’ connections to them; 2. Conducting work that benefits Oregon’s marine species, ecosystems, and people; and 3. Taking actions that ensure resources and opportunities for use and enjoyment for today and into the future.
2.3.2 Project Overview, Background and Purpose
Red sea urchins are the state’s third most economically valuable invertebrate fishery (behind Dungeness crab and pink shrimp). The commercial sea urchin fishery in Oregon is not monitored by yearly landings or an annual quota, but rather by trends in the size-structure of wild-stock populations generated during underwater field surveys of sea urchins in rocky sub-tidal habitats. These fishery-independent surveys were initiated in 1991 and have been periodically repeated and updated over the past three decades to develop a long-term, robust quantitative dataset which is essential for prudent management of Oregon’s valuable commercial sea urchin fishery.

2.4 SCOPE OF WORK/SPECIFICATIONS
The Successful Offeror agrees to provide an at-sea research platform and capable dive team to perform sea urchin surveys at four locations: (1) Gold Beach (Rogue Reef); (2) Port Orford (Orford Reef); (3) Depoe Bay; (4) Redfish Rocks, Oregon. The time span of the project is approximately June 14, 2024 to October 31, 2024. It is estimated that about 14 vessel days will be required to complete the sea urchin surveys, although the specific number of vessel days will be determined by a combination of factors including weather and sea conditions, depth and topographic characteristics of the survey habitat, abundance of the sea urchins, safety of the vessel and crew, and other considerations.
Sea urchin surveys are expected to entail performing underwater work along several transects at pre-described locations each day. Sea urchin surveys require two divers working efficiently as a team, following established protocol to use video equipment, record careful notes, and collecting samples of sea urchins.
The total estimated boat time is as much as 140 hours (14 days at 10 hr/day).
Charter time is defined to: (1) start at Gold Beach and Depoe Bay when the vessel is launched into the water, and end when the vessel is docked or returned to a trailer; and (2) start at Port Orford when the vessel is hoisted into the water, and end when the vessel is hoisted onto the pier again.
Each trip shall be a day trip (no overnight trips), departing and returning to the ports of Gold Beach, Port Orford, or Depoe Bay, Oregon.
Underwater dive transect surveys will be conducted in the vicinity of Gold Beach (Rogue Reef), Port Orford (Orford Reef & Redfish Rocks), or Depoe Bay, Oregon. Contractor will be required to provide vessel, divers, dive gear, safety gear, etc. for a full day of surveys each day. The target for this contract is to complete 8 underwater belt transects each day, and each transect takes about 30 minutes to complete (i.e. 4 hrs underwater transect surveys each day).
Tasks & Responsibilities:
The Contractor will:
1) The Contractor agrees to provide an Operator that has knowledge of:
a. Safe vessel operation
b. Safe diving operations
c. Weather and its effects
2) The Contractor must have the knowledge of how to launch and retrieve divers with scientific sampling gear, and the ability to exercise sound judgment in conducting safe, efficient and effective vessel operations.
3) The Contractor agrees to provide certifications of all required insurance, mechanical inspection, operator license, Coast Guard inspection, and boater safety cards.
4) The Contractor agrees to furnish an approved vessel, Operator, and two SCUBA divers. The deckhand and/or skipper must conduct all boating and SCUBA operations along with the deployment and retrieval of all mooring anchors.
ODFW biologists will dictate specific sampling locations and direct the planning of scientific sampling, and also provide assistance aboard the vessel. The Contractor shall provide labor for all minor repairs or modifications to the vessel.
5) The Contractor agrees to provide all fuel, operating supplies, and diving equipment. The Contractor hereby assumes full responsibility for the operation, repair, and maintenance of the vessel and other equipment furnished by the Contractor. The Agency shall not control the means or manner of the operation of the vessel except to specify sampling locations, and shall rely on the skills, knowledge, and guidance of the Contractor.
6) The Contractor agrees to provide a safety orientation/training to staff and volunteers.
7) The Contractor agrees to cooperate with the Agency in collecting GPS location information at each sample site so that the Department may return to each site later for repeated sampling.
8) No fish encountered during the underwater transect surveys shall be retained for the purpose of consumption.
ODFW will:
1) ODFW biologists will identify the specific sampling locations and direct the planning of scientific surveys.
2) Provide crew members and specialized science equipment required to perform underwater surveys.
3) Work with Contractor on a flexible schedule across the award period for this Contract.
The Successful Offeror agrees to provide a vessel that has:
1. Functional standard navigation, communication, and safety equipment, including life raft, EPIRB, depth sounder, radar, running lights, fire extinguishers, immersion suits for operator and any crew, etc. ODFW will provide immersion suits for Agency staff.
2. Sufficient deck space to carry:
a. The operator
b. Two (2) to three (3) divers
c. Two (2) to three (3) ODFW biologists
d. Scientific sampling gear (transect tapes, quadrants, cameras)
Special Considerations:
1. Should the vessel or other essential equipment break down and cause delay or termination of the operation, the equipment shall be repaired or replaced within 48 hours to allow continuation of the project. Failure to do so may result in a $500/day penalty until deficiencies are corrected.
2. If for any reason an additional or substitute vessel operator or diver is required to complete the work required under this contract, it will be the responsibility of the contractor to supply or subcontract the same, within 48 hours, and with ODFW approval, at the contractor’s expense.
3. ODFW reserves the right to ground any vessel operator who, in its sole opinion, violates Contract requirements, is unsafe, or otherwise performs unsatisfactorily. Contractor will be required, within 48 hours, to replace the grounded vessel operator. All replacements shall be approved in advance of use under the contract by ODFW. Failure to furnish a replacement operator within the specified time will authorize ODFW to assess Contractor the amount $500 per day for delay.
4. Contractor shall deliver within the time indicated in Sample Contract (Attachment A). Should Contractor fail to meet the delivery schedule, thereby making it necessary for the State to purchase urgently needed services from another source, Contractor shall pay the difference between the accepted bid price and the new purchase price.

Each trip shall be a day trip (no overnight trips), departing and returning to the ports of Gold Beach, Port Orford, or Depoe Bay, Oregon. The days and dates on which operations shall be conducted shall be subject to joint determination by the Agency and the Offeror within the following limitations:
Operations shall be terminated when, as determined by the Agency, either:
1) The scientific objectives of the research have been met, or the available funds have been exhausted, or it is deemed the scientific objectives cannot be met with the time and funds available, or research is legally constrained;
2) Due to equipment failure, inclement weather, or other causes, the Contractor decides the scientific objectives cannot be met within a reasonable time frame
Work dates shall be set at least one (1) day in advance for scheduling purposes.
Payment Methodology:
Payment will be made for daily surveys, and will be paid at the end of periods of work. The Contractor will deliver to the Agency an invoice for payment at the end of each session of work completed at: (1) Port Orford, (2) Gold Beach, and (3) Depoe Bay, Oregon.
