3. OVERVIEW AND GOALS:
A. In May of 2026 the Governor and the State Legislature created the Transit Investment Area Act through HB26-1065. This Act promotes transit-oriented development by establishing a Tax Increment Financing (TIF) program to provide funding for infrastructure close to passenger rail stations and public transit stations that will make it easier for people to access and use those transportation facilities. This program will capture future increases in State sales tax revenue resulting from the increase of in-person sales in the designated TIF area over a financing period not to exceed 30 years and divert a portion of this revenue to pay for the infrastructure project, called a Transit Investment Project. This program differs from traditional TIF districts in that the State will award the TIF mechanism to one or more local governments based on the local government’s Transit Investment Project meeting certain criteria and the location of the district being within a Transit and Housing Investment Zone, which is a two-mile radius of a transit station. The Colorado Office of Economic Development & International Trade is managing the program and Colorado Economic Development Commission is responsible for approving the Transit Investment Projects and the TIF areas, called Transit Investment Areas. A maximum of three (3) Transit Investment Projects and Transit Investment Areas can be approved in the 2027 calendar year and three (3) in the following year.
B. The Colorado Office of Economic Development & International Trade (OEDIT) is seeking to hire a qualified, economic analyst or firm with proven expertise in economic and financial analysis of tax increment financing districts to assist OEDIT and the Colorado Economic Development Commission (EDC) with the baseline growth rate assessment (“Assessment”) and a full feasibility and “but-for” economic analysis of a proposed project with State sales tax increment revenue projections (“Economic Analysis”). Also, the report will include an assessment of how the applicant’s Project and Area meet the criteria identified in the legislation.
C. In accordance with section 24-110-201, C.R.S., the award under this solicitation will be a cooperative purchasing agreement available for use by the State Agency issuing this solicitation and other State and local Agencies and Political Subdivisions, including but not limited to school districts, on the terms, conditions and rates set forth in the cooperative purchasing agreement. Each agency or entity ordering goods or services under the contract will be responsible for all costs and expenses incurred in connection with its orders.

1. BACKGROUND
Commission is responsible for approving the Transit Investment Projects and the TIF areas, called Transit Investment Areas. A maximum of three (3) Transit Investment Projects and Transit Investment Areas can be approved in the 2027 calendar year and three (3) in the following year.
B. The Colorado Office of Economic Development & International Trade (OEDIT) is seeking to hire a qualified, economic analyst or firm with proven expertise in economic and financial analysis of tax increment financing districts to assist OEDIT and the Colorado Economic Development Commission (EDC) with the baseline growth rate Assessment and a full feasibility and “but-for” economic analysis of the proposed project with State sales tax increment revenue projections (“Economic Analysis”).
Also, the report will include an assessment of how the applicant’s Project and Area meet the criteria identified in the legislation.
C. In accordance with section 24-110-201, C.R.S., the award under this solicitation will be a cooperative purchasing agreement available for use by the State Agency issuing this solicitation and other State and local Agencies and Political Subdivisions, on the terms, conditions and rates set forth in the cooperative purchasing agreement. Each agency or entity ordering goods or services under the contract will be responsible for all costs and expenses incurred in connection with its orders.
D. The Offeror may not be performing economic analysis or other related work that will be used to complete a pre-application of a Transit Investment Area or an application of a Transit Investment Project.
2. SCOPE OF WORK/SPECIFICATIONS
A. Phase 1 - Transit Investment Area and Baseline Growth Rate Assessment
OEDIT will provide the Offeror with the information submitted by the local government applicant with their pre-application which includes the geographic boundaries of each proposed Transit Investment Area, all parcels to be included in the increment area in whole or in part, the estimated pre-development base year revenue, and data and reasoning the applicant used in to arrive at their proposed baseline growth rate and the estimate of State sales tax increment revenue for the Area.
i. The Offeror will perform economic modeling and calculate the State sales tax baseline growth rate for each proposed Transit Investment Area, considering any State sales tax increment financing already approved for the Area. This will result in an economic assessment of the baseline State sales tax growth rate for each proposed Transit Investment Area submitted to OEDIT.
ii. The Offeror will research and analyze property assessment records, inflation, regional economic forecasts, and any other information or data from the previous ten (10) calendar years that is available to identify the base year value of State sales tax revenue for each Transit Investment Area. This may include having conversations with the Department of Revenue and local governments to obtain and understand the data.
iii. The Offeror shall provide a final Assessment document for each Transit Investment Area to OEDIT with the recommended baseline growth rate for State sales tax, a summary of the data used and reasoning as to why the Offeror arrived at this baseline growth rate and how, if at all, this rate is different from the applicant’s proposed baseline growth rate.
iv. The Offeror shall be available to answer questions and provide clarifications on each baseline growth rate assessment to OEDIT, the Office of State Planning and Budgeting (OSPB) and the EDC before this Commission finalizes the Transit Investment Area’s Growth Rate. This includes attending one or two EDC meetings virtually or in-person.
B. Phase 2 - Project Application & Economic Analysis Report
Once the Baseline Growth Rate for a Transit Investment Area is approved by the EDC and accepted by the local government, the local government is eligible to submit an application for the Project.
i. The Offeror shall create an Economic Analysis report for each proposed Transit Investment Project and Area. The EDC shall use the Economic Analysis report when reviewing an application for State sales tax increment financing.
a. The Offeror may rely on the data and reasoning as it deems appropriate to evaluate forecasted economic development including the projected real estate development, growth in commercial activity, tourism, increase in the residential population, jobs or any other economic improvements that will increase State sales tax revenue that will be catalyzed, induced, supported, or facilitated by the proposed Transit Investment Project in the surrounding Transit Investment Area.
b. State sales tax revenues must be calculated on a State fiscal year basis for all fiscal years during and after the Transit Investment Project financing term. The State fiscal year is July 1st through the last day of the following June.
c. The same methodology shall be used to forecast property development and cash flows across all application evaluations.
ii. The Offeror shall submit each Economic Analysis report with the final conclusions to OEDIT and the local government that applied. Each report will include the following information:
a. An estimate of the total State sales tax increment revenue during the financing term in the proposed Transit Investment Area that can be captured and used for the Transit Investment Project.
b. An estimate of the maximum annual dollar amount of State sales tax increment revenue in the Transit Investment Area that can be collected and used for the Project.
c. A summary of the Offeror’s assumptions, calculations, and a detailed explanation of the methodology used to derive the Offeror’s final conclusions. Tables and supportive text should assist the reader through each calculation. All independent variables must be sourced.
d. An evaluation of whether and how the proposal meets the legislative criteria, as described in C.R.S. 24-46-403 (4). The State will provide information that the State departments have available to assist the Offeror with evaluating the Transit Investment Project and the Transit Investment Area through the lens of these criteria:
1) The proposed Transit Investment Project is reasonably anticipated to result in a substantial increase in transit utilization.
2) The boundaries of the proposed Transit Investment Area are only as large as necessary to accomplish the proposed Transit Investment Project goals.
3) The proposed Transit Investment Project or substantial portions of the proposed Project have been identified as part of a local plan or planning process.
4) The costs for the proposed Transit Investment Project are eligible costs per the legislation and C.R.S. section 24-46-403 (3)(c)(II).
5) The local government applicant has provided reliable economic data demonstrating that, in the absence of State sales tax increment revenue, the proposed Project is not reasonably anticipated to be developed within the foreseeable future.
6) The Project budget is based on Colorado prevailing wage rates and includes the costs necessary to utilize a certified apprentice program participant for a specified percentage of total work hours in designated trades in the construction of the Transit Investment Project.
iii. OEDIT may request the Offeror provide additional information to help the EDC make the final decisions on Transit Investment Projects or to make minor revisions to an Economic Analysis report, if there is time in the current application cycle.
iv. The Offeror will meet virtually or in-person with the EDC to provide a brief presentation and answer questions on the Economic Analysis report for each Transit Investment Project and Area either at the public hearing to review the Project applications or at a subsequent meeting or meetings.
