This Request for Proposal (RFP #26-0904006-008) is issued by the State of South Dakota Department of Health, Office of Medical Cannabis, seeking a comprehensive web-based software system to support medical cannabis program operations. All components must comply with South Dakota Codified Law 34-20G and ARSD 44:90, support HIPAA-compliant data sharing through FHIR-based APIs, and integrate with the state's Seed to Sale tracking software. The system must include role-based access controls, support Windows desktop/laptop/tablet devices, produce and consume CSV and XML files, provide real-time data validation and reporting, and accommodate application status tracking with document validation features. Key procedural dates include a letter of intent deadline of February 2, 2026, written inquiry deadline of February 23, 2026, proposal submission deadline of March 31, 2026 at 5:00 PM CST, proposal evaluation beginning April 15, 2026, technical reviews through April 30, 2026, demonstrations through May 15, 2026, proposal revisions by May 30, 2026, and anticipated award decision by July 1, 2026. The contract term is five years with no renewal options specified. No site visits are required, though the State may schedule presentations and demonstrations at the offeror's expense after proposal submission. Site visits, if required, will also be at the offeror's expense.
Pricing shall be submitted separately from technical proposals, with offerors required to provide three distinct cost proposals: one for vendor-hosted solutions, one for state on-premises hosting, and one for state cloud-hosted solutions on Microsoft Azure or state-preferred platforms. All costs must include staffing, travel, software licensing, hardware, maintenance, training, and implementation expenses for the five-year period. The State currently operates under an existing contract expiring May 31, 2027, indicating potential incumbent involvement. The RFP does not specify set-asides or disadvantaged enterprise requirements. Vendors must maintain cyber liability insurance with unspecified limits, professional liability insurance of at least $1 million, business automobile liability insurance of at least $1 million per accident, and workers' compensation insurance. All vendor personnel with access to protected health information must undergo fingerprint-based background investigations conducted by the State. The vendor must comply with comprehensive IT security requirements including web application vulnerability scanning, encryption standards (AES-256 minimum), multi-factor authentication, and annual risk assessments. The State retains ownership of all data tables and intellectual property created during the project. Offerors must demonstrate experience with at least two similar successful implementations and provide three references from governmental agencies. All proposal materials must be submitted via Secured File Transfer Protocol (SFTP), and proposals must be signed by legally authorized representatives.
