About this file
This is a Contractor Security Acknowledgement Form for the State of South Dakota Department of Health, Office of Medical Cannabis, requiring contractors to comply with the state's Information Technology Security Policy. The form mandates that all contractor employees who access non-public State of South Dakota technology infrastructure or information systems sign the agreement, affirming their commitment to protect state technology and information assets from unauthorized access, disclosure, modification, deletion, and usage. Contractors must adhere to all state and federal regulations regarding data confidentiality and handling, discuss any policy violations with designated state contacts, and understand that violations may result in privilege revocation or breach of contract. Access to state technology infrastructure is designated as a revocable privilege that automatically terminates upon contract completion unless otherwise agreed in writing. The contractor's authorized representative must sign the form, confirming the authority to bind the entire company and all employees to the agreement's terms.
The form requires contractors to report all policy violations promptly to the state contact and the BIT Help Desk at 605-773-4357. All personnel accessing protected health information must undergo fingerprint-based background investigations, and contractors must maintain cyber liability insurance and implement multi-factor authentication. The state retains ownership of all data tables and intellectual property created during the project. This security acknowledgement is a mandatory attachment to the Medical Cannabis Patient Registry contract (RFP 26-0904006-008), with proposal submission deadline of March 31, 2026, and contract award anticipated by July 1, 2026, for a five-year term expiring May 31, 2027.
