2.3 OVERVIEW, BACKGROUND and PURPOSE

Agency is soliciting proposals to award a contract to a Consultant for Services in connection with the following project (the “Project”): Development of a Disadvantaged Business Enterprise (“DBE”) Advisory Committee.

Project Background

In September of 2020 the Oregon Department of Transportation’s Office of Civil Rights (“OCR”) received funding earmarked for Disadvantaged Business Enterprise (“DBE”)

07/09/21 Page 7 of 19

Supportive Services as part of a federal reallocation that was approved by the Oregon Transportation Commission (“OTC”). OCR plans to utilize this funding to work directly with Consultant to identify and address the barriers that DBE certified firms face when competing for public sector work.

In 2016, Keen Independent Research, LLC. prepared the 2016 Availability and Disparity Study to analyze whether there is a level playing field for Minority Business Enterprises (“MBE”) and Women-owned Business Enterprises (“WBE”) in the Oregon transportation contracting industry. The 2016 Disparity Study identified a number of barriers that are impacting MBEs and WBEs in Oregon and their success competing for public sector work.

Some of the key substantial barriers faced by MBEs and WBEs as found through the 2016 Disparity Study are as follows:

• Small businesses have reported that public agency contracting processes and requirements such as minimum prequalification, bonding, and insurance levels put small businesses at a disadvantage when competing for public sector work.

• Minorities and women appear to face barriers regarding advancement to supervisory or managerial positions.

• Women account for a very small portion of the Oregon construction and engineering workforce compared to other industries.

• Barriers accessing capital affect the number of minorities and women who are able to start a business.

• Twice as many minority- and women-owned small businesses were denied loans than non- Hispanic male-owned small businesses.

• Statistically significant disparities in loan approval rates for African American-owned small businesses compared with similarly situated non-Hispanic white-owned firms.

• The mean value of approved loans for minority- and women-owned business in the Pacific region was substantially lower than non-Hispanic white male-owned firms.

• Evidence that minority- and women-owned small businesses in the Pacific region paid higher interest rates on their business loans than non-minority male-owned small businesses.

• MBEs and WBEs experience difficulties obtaining lines of credit, insurance, and loans.

• MBE and WBEs in the Oregon transportation contracting industry are disproportionately small.

Obtaining business financing, bonding, and insurance is more of a barrier to small businesses than large businesses, making it less likely that a small firm can expand or successfully pursue public sector work.

• MBE and WBEs had difficulty learning about bid opportunities, including those at ODOT and local agencies and the private sector.

07/09/21 Page 8 of 19

• MBE and WBEs are substantially more likely to report difficulty networking with Prime Contractors or customers.

• MBE and WBEs reported that size of projects is a barrier to bidding.

• Excessive paperwork involved in public sector work is a burden to small businesses.

• Public agency screening of potential contractors and engineering firms through prequalification can be a barrier to bidding.

• Language barriers.

2.4 SCOPE OF WORK

The selected Consultant shall provide professional services to facilitate development of a DBE Advisory Committee (the “Services”) with the purpose of identifying and addressing barriers that DBE certified firms face when competing for public sector work. The Services are described in more detail in Exhibit A (Statement of Work) of RFP Attachment A (Sample Contract).

All Services must be complete no later than 12 months after written Notice to Proceed (“NTP”) from Agency authorizing Services to start. Agency reserves the right to extend the Contract for an additional year, if needed.

The total amount of the Contract may not exceed $150,000.
