1. GENERAL INFORMATION
A. INTRODUCTION
Under the umbrella of the California Health and Human Services Agency (CalHHS), the California Department of Aging (CDA) administers programs that serve older adults, adults with disabilities, family caregivers, and residents in long-term care (LTC) facilities throughout the State. These programs are funded through the federal Older Americans Act (OAA), the Older Californians Act (OCA), through the Medi-Cal program, state Special Funds, and various federal grants. Below is a summary of the major program areas under CDA’s purview.
1) CDA contracts with a network of 33 Area Agencies on Aging (AAAs), who directly manage a wide array of federal and state-funded services which provide meals; job/skills training and assistance with securing employment;
health insurance counseling; information, assistance, and navigation; various types of supportive services to assist older adults and people with disabilities to live as independently as possible; promote healthy aging and community involvement; and support family members in their vital caregiving role(s). In turn, these AAAs typically contract for the provision of Title III-B legal services with Legal Service Providers (LSPs) for the delivery of legal assistance to those that qualify under the OAA.
2) CDA contracts with a network of 11 California Caregiver Resource Centers (CRC) which serve family caregivers who are providing care to adults affected by chronic and debilitating health conditions including dementia, Alzheimer’s disease, cerebrovascular diseases, among many others.
3) CDA also contracts with 38 providers that operate the Multipurpose Senior Services Programs (MSSP) through the Medi-Cal Home and Community- Based (HCBS) Waiver for older adults.
4) CDA certifies approximately 242 Adult Day Health Care Centers for participation in the Medi-Cal funded Community Based Adult Services (CBAS) Program.
5) The Office of the State Long Term Care Ombudsman (OSLTCO) oversees 35 local LTC Ombudsman Programs (LTCOPs), that are supported by approximately 700 local LTC Ombudsman (LTCO) Representatives throughout the state. LTC Ombudsman Representatives support and empower consumers by seeking resolution to individual complaints involving LTC services. Additionally, LTCO Representatives advocate for the rights of over 8,000 LTC facility residents with the goal of ensuring their dignity, quality of life, and quality of care. The OSLTCO operates a statewide, 24-hour, toll free, CRISIS line to receive complaints and relay requests for local LTCOP services. These services are free, confidential, and available to the over 300,000 residents in LTC facilities across California.
6) To promote the Department’s goal of every Californian having the opportunity to enjoy wellness, longevity, and quality of life in strong healthy communities, CDA actively collaborates with many other State departments (and other entities) on behavioral health, transportation, housing, accessibility, emergency preparedness and response, nutrition, and wellness, fall and injury prevention, improving services to persons with dementia, reducing fraud and abuse, and many other issues.
B. PURPOSE OF THIS RFP:
CDA is soliciting proposals from qualified organizations to further develop and enhance the California Title III-B Legal Services Provider Network through the following:
1) updating, publishing, and distributing the Legal Assistance Policy and Procedures Manual,
2) creating a 2-Year Quarterly Training Curriculum for Title III-B legal services providers,
3) developing a Title-III B Legal Services Committee Charter,
4) and drafting 2-Year Quarterly Meeting Agendas for Title III-B legal services providers and the Area Agencies on Aging.
C. BACKGROUND
The OAA designates legal assistance as a priority service funded under Title III-B 42 U.S.C. § 3026(a)(2). The OAA was passed in 1965 and provides funding to states for a variety of services in the aging field.
This funding covers a wide range of aging services in five core areas.
1) elder rights,
2) caregivers,
3) nutrition,
4) health & wellness,
5) and supportive services.
In California, these supportive services are distributed through a network of local Area Agencies on Aging (AAAs). Each AAA operates within a planning and service area (PSA) to provide services to older adults. The PSAs are designated by the State Unit on Aging (SUA), which in California is the California Department of Aging (CDA). There are 33 PSAs in California. 32 cover all 58 counties, plus the City of Los Angeles as a separate PSA. AAAs provide the supportive services required under the OAA. Support is provided either directly or indirectly through contracted service providers. Legal assistance is included as a supportive service under Title III-B of the Act. Most of the AAAs in California provide this service indirectly by contracting with an outside legal aid organization.
D. AGREEMENT TERM AND SECURITY PROVISIONS:
1) If an agreement results from this RFP, the term is anticipated to be March 10, 2025, through September 30, 2025. Any agreement (and/or amendment) resulting from this RFP shall have no force or effect until it is signed by both parties and approved by the Department of General Services (DGS) if such approval is required. Performance shall start no later than on the express date set by the awarding agency and after all approvals have been obtained and the agreement is fully executed.
2) All performance under the agreement shall be completed on or before the termination date of the agreement.
3) Should the Contractor fail to commence work at the agreed upon time, the CDA reserves the right to terminate the agreement upon thirty (30) days’ written notice to the Contractor.

a) Proposal Costs - All costs and expenses incurred by each respective proposer are the sole responsibility of that respective proposer and cannot be charged to the CDA.
b) All submissions must use the provided template (RFP-2425-03 Attachment 7 – Proposer’s Rate Sheets) and include estimated pricing for all categories listed. Estimated costs must account for all work, services, products, licensing, hosting, implementation, consulting, training, maintenance, and related expenses as defined in the draft SOW and Attachment 7 – Proposer’s Rate Sheets. The proposer must guarantee the rates stated in their submitted proposal will not increase during the term of this contract.
c) Proposals should include costs to ensure documents produced through the project are ADA accessible. This includes documents and the facilitation of forums/meetings for stakeholder engagement.
5. PROPOSAL EVALUATION AND AWARD
A. DESCRIPTION OF EVALUATION PROCESS
1) At the time of proposal opening, each proposal will be checked for the presence or absence of required information in conformance with the submission requirements of this RFP.
2) The State will put each proposal through a process of evaluation to determine the responsiveness of proposing firms to the State's needs. The final selection will be made on the basis of the highest scoring proposal meeting the specifications.
3) Proposals containing false or misleading statements or providing references that do not support an attribute or condition claimed by the proposing firm may be rejected. If, in the opinion of CDA, information was intended to mislead CDA in its evaluation of the proposal, and the attribute, condition, or capability is a requirement of this RFP, it will be the basis for rejection of the proposal.
4) If there are tied bids, representatives of CDA will flip a coin to pick the winning Proposer. The coin toss will be witnessed and documented by two or more State employees and the affected bidders will be invited to witness said coin toss.
5) The evaluation process will consist of two phases.
a) In Phase One, proposals are reviewed to ensure that all documentation has been submitted in compliance with the requirements of this RFP. CDA will review all the following documents to determine that each is enclosed and properly completed. Failure to meet these administrative requirements will cause a proposal to be deemed non-responsive and therefore ineligible for the next step of the RFP evaluation process.
b) Phase Two will consist of an evaluation of the Work Plan and Work Schedule/Technical Proposal based upon the criteria and scoring method described below. It will be used to determine which of the proposals meet the minimum technical requirements.
B. REVIEW OF PROPOSAL REQUIREMENTS:
1) PHASE 1 – ADMINISTRATIVE EVALUATION
The CDA will conduct an administrative evaluation in accordance with the RFP requirements to determine a Proposer’s responsiveness and responsibility. Each proposal will be checked for completeness and/or absence of all required information and to ensure that the Proposer meets the minimum qualifications in conformance with the submission requirements.
During evaluation period, if an item is unclear, or needs further clarification, Proposers may be requested to provide additional documentation. Proposals that contain false or misleading statements may be rejected.
a) DEFINITIONS OF RESPONSIVE AND RESPONSIBLE PROPOSERS
A responsive Proposer is one who submits a proposal that meets all the submission requirements and minimum qualification requirements stated in the RFP.
A responsible Proposer is one that is trustworthy and possesses the necessary quality, fitness, and capacity to satisfactorily perform the proposed work. Proposers who are determined not to be responsible or who submit non-responsive proposals shall have the proposals rejected.
b) DETERMINING RESPONSIVE PROPOSERS
(1) Each proposal will first be reviewed to determine whether the Proposer is responsive. This includes but is not limited to, ensuring that the proposal was received by the date and time specified; contains all the required documents; meets the minimum qualifications; meets the format requirements specified; and that there is no material deviation from the terms and conditions of the proposed contract.
(2) A non-responsive proposal is one that does not meet the requirements stated in the RFP, fails to provide all required documents/attachments, or proposals that deviate substantially from requirements. A proposal that changes the terms and conditions of the RFP or the contract provisions will be considered a counterproposal and will be rejected as non-responsive.
c) DETERMINING RESPONSIBLE PROPOSERS
Responsive proposals shall be considered evidence of the Proposer’s responsibility. The CDA reserves the right to reevaluate a Proposer’s responsibility prior to award and is in no way limited to submitted proposal packages in deciding as to a Proposer’s responsibility. In determining whether a Proposer is responsible, the CDA may require Proposers to submit evidence of their qualifications at such times, and under such conditions, as it may require.
2) PHASE 2 – TECHNICAL PROPOSAL EVALUATION
The CDA will conduct an evaluation of each proposal not rejected in Phase 1 by an Evaluation Committee consisting of CDA employees. CDA reserves the right to request clarification from the proposers regarding their proposal to the extent it deems necessary.
a) RATING CRITERION GUIDELINES
(1) After studying the RFP, each panel member will review each proposal and assign points for each criterion discussed below. The reviewers will then meet either in person or by teleconference to discuss in detail the strengths, weaknesses, and ratings of each proposal.
(2) The criteria in the Sample Score Sheet of this RFP will be used by reviewers evaluating proposals submitted in response to this RFP. In addition to what is stated below, in scoring the proposal, each criterion will be rated based on completeness, responsiveness, clarity of response, and weighed in the context of its contribution to the product.
(3) Members of the evaluation committee will independently review each proposal submitted and numerically score each rating/scoring category in the Technical Requirements section.
(4) All evaluators’ scores will then be compiled and averaged to arrive at the final score for each rating/scoring category.
(5) A minimum of 50% of the available points must be achieved for each rating/scoring category. Categories are established by CDA based on information provided in RFP Sections B, Section C, Exhibit A, and Exhibit B.
Rating/Scoring Criteria Maximum Possible Points Executive Summary 10 Key Personnel 20 Work Plan and Work Schedule/ Technical Proposal
Work Samples 20 Proposer’s References 10 Cost Proposal 80 Total Possible Points 250
The CDA Evaluation Team will score the submittals based on percentages for levels of quality for each scoring criterion. The percentages will then be translated to points based upon the weight for each particular factor. For example, under “Effective Timeframes,” if a proposing firm’s response is considered “Excellent,” it will receive 9 points (0.9 x 10). The same approach will be used for all categories, except the scoring of the Cost Proposal.
