About this file

This document is a Response to Clarifying Questions #2 for Request for Proposals #2025-54 issued by Clackamas County's Procurement & Contracting Services for the Conway Creek at Aschoff Road Culvert Replacement Project. The document addresses a specific question regarding the minimum subcontracting requirements, specifically the percentage of contract work that must be self-performed. The county indicates flexibility in its original requirement, stating they are willing to reduce the self-performance mandate from 51% to 40% of the contract.

The clarification comes in the context of the project's Disadvantaged Business Enterprise (DBE) participation goal, which has been increased from 7.5% to 15%, potentially impacting the design team's ability to self-perform work. The document notes that the original 51% self-performance requirement is not typically practiced by ODOT or other local agencies in Oregon for federal-aid funded projects. By providing this response, Clackamas County is offering additional clarity to potential bidders about the contract's requirements, demonstrating a willingness to adapt procurement guidelines to support broader participation and project goals.

REQUEST FOR PROPOSALS #2025-54

Conway Creek at Aschoff Road Culvert Replacement Project

RESPONSE TO CLARIFYING QUESTIONS #2

June 23, 2025

Note that these are questions submitted by interested firms to the above referenced solicitation. The below answers are for clarification purposes only and in no way alter or amend the RFP as published.

1. The RFP Section 2.3.3 Minimum Qualifications, Maximum Subcontracting indicates that at least 51% of the contract is self-performed.

Question: Is this a flexible County requirement?

Context: With the DBE participation goal increased to 15% from the typical 7.5%, this requirement offers less opportunity to self-perform the design. The 51% minimum requirement is not practiced by ODOT or other local agencies in Oregon on federal-aid funded projects.

Answer: We do have some flexibility related to the RFP’s requirement for 51% of the contract to be self-performed. We are comfortable with dropping that number to 40%.
