About this file

This is a FACTA Affidavit of Compliance document required by the City of Austin for contractors providing services related to utility customer billing accounts. The affidavit affirms that the contractor has implemented reasonable policies and procedures to detect, prevent, and mitigate identity theft risks in accordance with the Fair and Accurate Credit Transactions Act. The document requires a duly authorized company representative to acknowledge receipt of the City's list of identity theft red flags and to certify that applicable safeguards are in place. The affidavit must be signed and notarized before a Texas notary public.

The red flags identified by the City of Austin include document alteration or forgery, inconsistencies between identification documents and customer appearance or provided information, ID information that conflicts with external databases or the Social Security Administration Death Master File, associated identity theft cases, duplicate use of Social Security numbers across accounts, incomplete personal identification information, changes to billing addresses followed by multiple account modifications, suspicious payment patterns, unexplained irregularities in previously stable accounts, sudden activity on inactive accounts, and notifications of unauthorized account changes or transactions. This compliance document serves as a contractual safeguard requirement for the Underground Utility Locating Service contract opportunity within Austin Energy's public utility service areas in Texas.
