The term Quoter(s) and Offeror(s) shall be considered synonymous herein. Award of a BPA will only be offered to a Contractor that is deemed responsible in accordance with RFO 9.104 and whose quote conforms to the solicitation requirements and Performance Work Schedule.

4. 52.212-2, Evaluation of Commercial Items. For this procurement, Best Value determination will be made based on the Lowest Priced, Technically Acceptable (LPTA) quote. The Government will award no more than three (3) blanket purchase agreements from this RFQ to the responsible offeror whose quote conforming to the RFQ will be most advantageous to the Government. The following factors shall be used to evaluate quotes: technical acceptability and price. Only technically acceptable quotes are eligible for award and only quotes received from Offerors that provided unit pricing for ALL line items under the

Schedule B above will be considered.

a. The following process will be followed:

(i) Quotes will be reviewed to ensure that all line items have been priced. Quoters that submitted prices for ALL line items in the Schedule B above will initially be ranked based on total evaluated price (TEP).

TEP will be determined by adding all the line item unit prices in the Bid Schedule (above) for an overall amount and then ranked lowest to highest by TEP.

(ii) If three (3) or fewer quotes are received, the Government will evaluate all quotes for technical acceptability. If more than three (3) quotes are received, the Government will evaluate the three (3) lowest ranked quotes for technical acceptability. However, the Government reserves the right to evaluate additional quotes for technical acceptability if deemed to be in the Government’s best interest. If additional quotes are evaluated for technical acceptability, they will be evaluated in the order of rank as detailed in paragraph

4a(i) above.

(iii) The technical evaluation team will evaluate the factors identified below. For the quote to be technically acceptable, the technical factors must be rated as acceptable. The failure of an Offeror to meet any or all of the technical criteria will result in a technically unacceptable rating and be ineligible for award. The technical factors will receive one of the ratings listed below:

Acceptable: Quote clearly meets the minimum requirements of the solicitation.

Unacceptable: Quote does not clearly meet the minimum requirements of the solicitation

(iv) Technical Factor. The Government will evaluate the quotes for technical acceptability, assigning ratings as described in paragraph 4a(iii) above. The failure of a quote to meet any or all of the technical criteria will result in a technically unacceptable rating and preclude award.

FACTOR 1 – Licensing. Contractor shall be licensed in the State of Texas and in accordance with the

Texas Department of Licensing and Registration.

The standard has been met when: The Contractor provides proof of licensure and current registration for the State of Texas to implement the work in accordance with the requirements of the Performance Work

Statement.

FACTOR 2 – Certifications. All Mold Technicians, Consultants or Companies shall be Texas Mold certified according to the Texas Department of Licensing and Registration, Texas Title 16, Part 4, Texas

Administrative Code, Chapter 78, Mold Assessors and Remediators, (Effective September 1, 2018).

The standard has been met when: The Contractor provides verification/proof of obtaining the required licensing and registration to ensure all Mold Technicians, Consultants or Companies are Texas Mold certified according to the Texas Department of Licensing and Registration, Texas Title 16, Part 4, Texas

Administrative Code, Chapter 78, Mold Assessors and Remediators, (Effective September 1, 2018).

(v) Price Reasonableness. The Government, using one or more of the techniques defined in RFO 12.204 and/or RFO 15.103-3 will determine if the lowest priced, technically acceptable quotes are fair and reasonable.

(vi) Interchanges. It is the Government’s intent to award without interchanges. The Government may consider, throughout the evaluation, the “correction potential” of any quotes to this BPA solicitation. The judgment of such “correctional potential” is within the sole discretion of the Government and may be held with all, some, or none of the Quoters. If any aspect of an Offeror’s quote does not meet the Government’s requirements and is not considered correctable, the offer will be ineligible for a BPA award. The

Government may determine one or a few Quoters have the highest potential to provide the best value to the

Government. The Government may conduct interchanges with those Quoters that, at the discretion of the

Contracting Officer, have the highest potential to represent the best value. These interchanges may address technical or price matters, and any required BPA documentation including any other matter in the evaluation process. Resolution of minor or clerical issues would not constitute interchanges and the

Government reserves the right to award the BPAs without the opportunity to revise quotes.

5. Mandatory Registrations. To be eligible for award, registration in System for Award Management

(SAM) must be current. Contractors that are not current go to https://www.sam.gov/ and provide mandatory information.
