(i) Solicitation Provisions

52.212-2 Evaluation-Commercial Products and Commercial Services

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

The Government will organize the quotes based on the price from lowest to highest and will evaluate the technical approach of the two lowest priced offerors first. If the two lowest priced offerors are technically acceptable, then the lowest offer represents the best value for the Government, and the evaluation process ceases at this point. If one of the offerors is technically inacceptable, then the next lowest offeror will have their technical approach evaluated, and this will continue until the government has two technically acceptable offerors or runs out of offers to evaluate. At that point, award shall be made to the lowest priced technically acceptable offeror without further consideration to any other offers.

The Government intends to make award based on the initial quote submissions without conducting interchanges. Therefore, each offer should contain the Offeror’s best terms from a price and technical standpoint.

However, the Government reserves the right to hold interchanges if, during the evaluation, it is determined to be in the best interest of the Government. Interchanges are fluid interaction(s) between the CO and the contractors that may address any aspect of the quote and may or may not be documented in real time. However, the Government reserves the right to conduct interchanges using Interchange Notices (IN). Offeror responses to INs will be considered in making the award selection decision. Interchanges may be conducted with one, some or all offerors as the Government is not required to conduct interchanges with any or all contractors responding to this

RFQ.

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
