About this file
This is a Request for Qualifications (RFQ) issued by the West Virginia Department of Environmental Protection (WVDEP) for design-build services on the Shinnston Area Wide Drilling & Grouting project, an abandoned mine lands reclamation initiative in Harrison County, West Virginia. The project seeks to address subsidence issues resulting from pre-law coal mining operations by providing drilling and grouting services at 34 residential and non-residential structures across a 10.8-acre area. The project will be delivered through a Progressive Design-Build approach with two phases: Phase 1 encompasses design, permitting, and development of a final price proposal, while Phase 2 involves final design and construction activities. Qualified design-build entities must submit Statements of Qualifications by April 23, 2026, at 10:30 a.m. local time, with submissions required both electronically via wvOASIS and in six hard copies to WVDEP's Charleston office. No more than three responsive firms will be short-listed to proceed to the Request for Proposal stage, which will include a mandatory site walk-through, confidential individual meetings, and proposal interviews. The project procurement schedule indicates that short-listed offerors and RFP issuance will occur at a to-be-determined date, with final award notification also to be determined.
The estimated project budget is $15 million, funded through the Bipartisan Infrastructure Law, which requires compliance with Davis-Bacon Act and Build America, Buy America Act provisions. Mandatory minimum qualifications include the ability to obtain performance and payment bonds in the amount of $15 million and evidence of insurance capability meeting specified requirements: $2 million commercial general liability per occurrence, $2 million automobile liability per accident, statutory workers' compensation, and $1 million professional liability per claim and in aggregate. Short-listed offerors who submit complete responsive proposals but do not receive the design-build contract will receive a stipend of $13,750. Burns & McDonnell Engineering Company, Inc. is prohibited from participating as a team member. All submissions and resulting contracts are public documents subject to disclosure under West Virginia public records law and the Freedom of Information Act, with the exception of organizational safety information designated as confidential. Offerors are responsible for all costs associated with preparing their responses, and communications regarding the project must be directed exclusively to the WVDEP contact person, Jessica Chambers Smith, with any unauthorized contact with other WVDEP employees potentially resulting in disqualification.

SECTION 1: OWNER DESCRIPTION
1.1 General
The West Virginia Department of Environmental Protection (WVDEP) enforces state and federal environmental laws in West Virginia to help protect the air, water, and land. WVDEP’s mission is to promote a healthy environment using over 800 employees in nine different locations. More specifically, the WVDEP’s Division of Land Restoration (DLR), whose mission is to reclaim and remediate contaminated and disturbed land to a condition protective of public health and safety and suitable for productive reuse and economic development. With respect to lands impacted by coal mining operations, WVDEP is responsible for delivering projects associated with restoration and reclamation of these lands.
In response to the passing of WV Senate Bill 439, WVDEP has established a Design-Build Pilot Program aimed at delivering projects using design-build project delivery. The pilot program encompasses abandoned mine land reclamation, stream restoration, subsidence mitigation, and related activities, and seeks to apply Design Build Institute of America (DBIA) best practices in alignment with WVDEP policies and preferences.
The Shinnston Area Wide Drilling & Grouting project will be delivered under the Abandoned Mine Lands (AML) program which oversees and facilitates the resolving of public safety issues such as mine fires & subsidence, hazardous highwalls, mining-impacted water supplies, open shafts and portals, and other dangers resulting from mining before 1977.
1.2 Funding/Authority
This project will be funded with monies from the Bipartisan Infrastructure Law, which is federal funding. This will require conformance to federal funding requirements including the Davis-Bacon Act and Build America, Buy America Act at a minimum.
1.3 Procurement Website
Procurement information can be found at https://www.wvoasis.gov/. Registration guidance is provided on the website.
SECTION 2: OVERVIEW OF PROJECT
2.1 General
2.1.1 Purpose
The West Virginia Department of Environmental Protection (WVDEP) is soliciting Statements of Qualifications (SOQs) from qualified Design-Build Entities to provide Progressive Design- Build (PDB) services for the Shinnston Area Wide Drilling & Grouting project. The Owner intends to collaborate closely with the selected Design-Builder to refine the project scope, schedule, and budget in Phase 1 (Preconstruction & Design Development) before proceeding with Phase 2 (Final Design & Construction).
2.1.2 Project Overview
The Shinnston Area Wide Drilling & Grouting project is located in and around the City of Shinnston in Harrison County, West Virginia, within the West Fork River watershed. The project area has been significantly impacted by historic underground mining activities associated with the Alsted Coal Company’s pre-law mining operations in the Pittsburgh coal https://www.wvoasis.gov/ seam, last mined in 1946. These legacy underground workings have resulted in widespread subsidence throughout residential neighborhoods including Roosevelt Street, Philli Lane, East Pike Street, East Avenue, and School Street.
Numerous emergency subsidence responses have previously been conducted within the 10.8-acre area that makes up the primary project footprint. Despite these interventions, the potential for continued subsidence remains high due to the presence of documented underground voids, variable overburden depths ranging from approximately 18 to 51 feet, and remaining uncollapsed workings beneath many structures.
WVDEP’s AML Program has identified 34 structures—including private residences and select non-residential buildings—that require drilling to assess underlying mine conditions and grouting where voids are encountered. The work will address previously unmapped or partially collapsed voids, stabilize undermined ground, and mitigate ongoing public safety risks associated with historic mining.
2.2 Project Objectives
Establish a collaborative relationship between the WVDEP and the Design-Build Team in working together to meet the project objectives.
Evaluate potential innovative approaches to enhance the value and/or reduce the risk of the work to WVDEP and Design-Build Team.
Provide holistic services, including but not limited to planning, realty, permitting, design, and construction, that results in the completion of a project that optimizes improvements within the project budget and limits the likelihood that rework may be required in the future.
Maintain a safe, injury free work site.
Minimize impacts to project stakeholders through close coordination with WVDEP.
Demonstrate the advantages and disadvantages of design-build delivery.
Regular reporting of project progress for feedback to WVDEP.

ABANDONED MINE LANDS LOCAL CONCERN REPORT OSM-51 (continued)
NAME OF SITE: Shinnston Area Wide Drilling & Grouting
INFORMATION SOURCE: Steve Hincks
ADDRESS: 1000 Technology Dr.
CITY: Fairmont
TELEPHONE NUMBER: 304-993-5590
DATE: 11/5/2025
RESPONSE TO QUESTIONS BY INTERVIEWER:
This neighborhood has experienced numerous issues with subsidence along the city streets of Roosevelt Street, Philli Lane, & East Pike Street. This area includes an approximate 57,000sqft manufacturing building. This 6.7-acre neighborhood has had thirteen emergency subsidence projects completed at a total cost of more than $500,000.00. Additionally, there have also been issues with subsidence in the neighborhoods of East Ave, & School Street. This 4.1 -acre neighborhood has had 3 emergency subsidence projects completed.
This proposed project will perform drilling and grouting of the Pittsburgh coal seam in and near the Alsted and Bethlehem Coal Co., Scott Mine No. 2 mine complexes. The overburden in these areas ranges from 18.0’ to 50.9’. The average seam thickness in this area is 7.7 feet. The pre-law mining operation last took place here from 1940 - 1946. The WVGES show that the remaining coal still exists under some of the structures within the problem area. There is documentation of the mine workings and potential voids below the homes here as well.
There are 34 structures in this PAD that will be drilled and possibly grouted (if voids are found). There are also numerous storage buildings within the footprint of the project, these structures will not be drilled and grouted.
ADDITIONAL PERCEPTIONS of the PROBLEM:
The long-term plan is to continue to work in phases throughout this area of Shinnston to reclaim and stabilize additional neighborhoods from historic mining by drilling & grouting potential undermined areas.
The previous emergency subsidence projects in project area:
- East Pike Street (Pennington) Subsidence I-III, WV- 6292: 39°23’46.0"N, 80°17'6.0"W Total cost: $28,075.60.
