About this file

This is an internal email correspondence regarding an AB 339 compliance check for a Request for Proposals issued by the City of Santa Monica for as-needed real estate and design consulting services. The RFP solicits qualified consultants to provide services across three distinct scopes of work: Strategic Urban Planning, Urban Design & Architectural Services; Real Estate Advisory and Financial Analysis Services; and Economic Development Services. Respondents may submit qualifications for one, two, or all three scopes based on their expertise, and the City will establish a pool of qualified as-needed consultants for each scope with individual work order tasks defined at the time of assignment. The RFP was released on March 24, 2026, with a deadline for submitting questions on April 2, 2026, and a proposal submission deadline of April 15, 2026 at 3:00 p.m. The initial contract term is three years with two optional one-year renewal periods at the City's sole discretion, with no minimum hours guaranteed and payment only for hours of service actually received. The email addresses whether the scope of work encompasses tasks within recognized employee organization classifications, with the determination that it does not require notification to bargaining groups.

Pricing is based on fully burdened hourly rates for all anticipated job classifications submitted by the proposer, with no specific budget range identified in the solicitation. Minimum vendor requirements include 15 years of demonstrated experience with prior municipal or public entity work preferred, designation of a Lead Principal/Project Director for each scope, California Secretary of State registration in good standing, and successful completion of at least three comparable assignments within the past ten years for a public agency. Proposers must comply with the Living Wage Ordinance if the contract exceeds $54,200 and maintain City of Santa Monica business licenses if physically located in or conducting business within the city. All contractors must procure and maintain comprehensive insurance coverage including Commercial General Liability ($1,000,000 minimum per occurrence), Automobile Liability ($1,000,000 per accident), Workers' Compensation with statutory limits and Employers' Liability ($1,000,000 minimum per accident), and Professional Liability ($1,000,000 per occurrence and $2,000,000 annual aggregate). Evaluation will be weighted 80 points for qualifications and experience, 15 points for cost, and 5 points for methodology, with the City reserving the right to select multiple qualified vendors.

As this appears to augment some of what we already do as well as provide guidance and what we don't, I do not believe there is a requirement to notify any of our bargaining groups.

Thank you, Sarah
