QUESTIONS WITH GOVERNMENT RESPONSES:
17. Question:
Is it acceptable to provide CPAR evaluations in lieu of Past Performance Questionnaires to fulfill the past performance requirement. Please consider in your response that CPAR and PPIRS provide as much or more information on the performance of the contractor and do not unnecessarily burden government contracting staff that have knowledge of the projects being submitted on.
Government Response:
In accordance with Section L.18, WBR 1452.215-80 – Source Evaluation and Selection Procedures: sub paragraph (b) Past Performance Evaluation - In addition to any other past performance information required under the solicitation, the Contracting Officer (C0) shall use past performance information available from the Past Performance Information Retrieval System (PPIRS.GOV) in the source selection process on offerors competing for awards in excess of $100,000, unless the CO has documented an exception from past performance consideration in accordance with FAR 15.304(c)(2)(iv).
PPIRS & CPARS do not provide all the necessary information to evaluate a contractors relevant and recent past performance in regards to the project they are competing for. The requirement for the contractor to submit past performance as stated in the solicitation, provides the CO additional information necessary to make a thorough evaluation of the contractors’ past performance. Therefore the Past Performance Questionnaire provides additional information that assists in the evaluation. Also, the CO at their discretion may use other methods to assist the evaluation.
18. Question:
It appears that the government expects subcontractors to submit experience and past performance as well under Factors 2 and 4. Is the expectation of the government that the number of projects required for the prime (5 experience, minimum of 3 Past Performance) also apply to key subcontractors?
Shoshone Powerplant Roof Replacement Amendment No. 0003
Amendment No. 0003 - 3
Government Response:
In Section M, Factor 2 states “(no more than 5)”. Factor 2, sub paragraph (2) states: If an offeror intends to utilize subcontractors to perform any of the major components of work, all of the above information must be provided for each proposed subcontractor.
19. Question:
Please verify that there are no page limitations.
Government Response:
Section M, Factor 3 - Key Personnel: (2) “Resumes are limited to 3 pages per individual”. No other page limitation is listed.
20. Question:
Section 01 56 15. Part 1.03 - If we are excavating and hit a conduit, ground mat, asbestos, etc that the USBR did not know of, will this be the contractor's responsibility? Since we will be unable to perform locates by hooking to test equipment for conduits, wires, etc as is commonly done on excavations, will the USBR provide a list and approximate locations of buried objects known? If an object (unknown to either party) is struck, will this fall under the Differing Site Conditions FAR 52.236-02? We request that the USBR revise the section that if any unknown objects or conditions are encountered will fall under Differing Site Conditions Clauses.
Government Response:
The government has identified all known buried objects. If something is encountered other than shown on the drawings the contractor may claim under the Differing Site Conditions FAR 52.236-02 clause.
21. Question:
Section 01 57 30. Part 3.01.F.2.b. Please clarify. The contractor is responsible to coordinate a Permanent Stockpile Area between the State of WY and the Federal Government? Has an area already been designated or is it the responsibility of the Contractor to negotiate the use of an area? How do we estimate the cost for this requested service?
Government Response:
The contractor shall dispose of all clean rock at the North Fork Dike stockpile site as indicated on drawing 1458-600-60003. The land at the disposal site is owned by the Bureau of Reclamation.
From the above requirement, if the area is already designated is the disposal site currently permitted? If not, please provide its estimated use date so we can incorporate that into our schedule.
Contractor shall comply with Section 01 57 30 Water Pollution Control.
22. Question:
Section 01 74 00. Part 3.01.A. What does the USBR consider the extent of “clean”. Would we anticipate it to be similar to pressure wash with 3000 psi pressure washer and not sandblasting or other extremely costly measures? Also, the cleaning requirement may conflict with the requirements of 02 82 20-11.3.01.B.2? If not, please clarify sequence of cleaning and fiber lock down desired by USBR.
Shoshone Powerplant Roof Replacement Amendment No. 0003
Amendment No. 0003 - 4
Section 01 74 00. Part 3.01.A. removes deleterious material (visible debris in Section 02 82 20, 3.01.B.2) to ensure an acceptable surface for the new roof system.
Section 02 82 20, 3.01.B.2 states that fiber lockdown is applied after removal of visible debris (deleterious material in Section 01 74 00. Part 3.01.A.) is removed.
For further clarification, deleterious material may be material such as rocks, pebbles, nails, screws, irregular concrete surface, etc. which would prove to be objectionable to the new vapor control layer installed after the fiber lockdown. In addition, pressure washing the roof surface is not advised due to the complications generated for the proper disposal of contaminated water.
23. Question:
Section 03 21 00. Part 1.03.B - Rebar drawings. The rebar consists of 2 #5's following the rock face. The best product will be to cold field bend the bars to match the rock face. Is shop fabricated rebar needed?
Subject specification section represents that the Submittal indicate approximations for reinforcing lengths, quantity and bar-bending diagrams. Drawings indicate reinforcing to be straight between points of angle transition. Final bend angles at transition locations can be performed in the field.
24. Question:
Section 03 30 00. Part 1.03.F. Does the USBR anticipate any concrete repairs beyond the pier removals? If so how will these be paid?
Government Response:
The government does not anticipate concrete repairs beyond the pier removals. If concrete repairs are required they will be paid under the Differing Site Conditions FAR 52.236-02 clause.
25. Question:
Section 31 23 90. Part 1.01.A.2. Please provide an as-built of the ground cable. Excavation around this will be by hand and we need to know it's extent to properly cost it. Or in-lieu of, an estimated length for bidding purposes.
Government Response:
The government does not have an as-built drawing of the ground cable. The estimated length of ground cable for bidding purposes will be 50 feet.
26. Question:
Section 33 46 10. Part 1.01.C.3. Please provide spec and surface prep requirements for the waterproofing.
This line is DELETED in its entirety in Revised Section 33 46 10.
27. Question:
Section 33 46 10. Part 2.05. Paver Restraint. Dimensions are unclear. Can you provide a list of possible suppliers, model numbers, etc. that you are looking for? Access to install all these strips
Shoshone Powerplant Roof Replacement Amendment No. 0003
Amendment No. 0003 - 5 will be extremely hazardous and difficult, See photo #17. Will the USBR remove any stored items below to insure safe access and working conditions?
Government Response:
Specification section referenced, will have dimensional and product material clarified in Revised Section 33 46 10.
The government will remove stored items below the area where the paver restraints will be installed. The contractor will be responsible to give sufficient notice to the government to allow for the removal of the stored items.
28. Question:
Section 33 46 10. Part 3.03.A. We are required to video the existing drain pipes until they daylight at the power house river wall. If any cleaning or obstruction removals are required Part 3.02.B.2 says that any found debris "will be cleaned at the contractor's expense". Please clarify that this only applies to roofing materials or debris generated from this contract - not pre-existing conditions. Suggest that a requirement be added to video the drain pipes prior to construction and post construction to verify the generator of the problem.
See revised Section 33 46 10 line 3.02 B.
29. Question:
Section I.14 - Will the contractor be charged for reasonable, normal electrical power obtained from the USBR? If so at what rate and how will it be monitored?
Government Response:
In accordance with Section 01 51 00 Temporary Utilities, 1.03 A., The contractor may use the existing available power at no additional cost provided use does not interfere with Government operations.
30. Question:
Section I.27 - Payment for Technical Data. Will there be 10% retainage on the entire project -except Mob and Prep? This conflicts with I.10.e which states that retainage MAY be withheld.
Government Response:
In accordance with FAR 52.232-05, the government may retain 10% for contractors failing to make progress. In regards to I.10.e refers to entire contract except Mobilization and Preparation. I.27 refers specifically to Technical Data.
31. Question:
Attachment 001 - Is there a separate Wage Rate for Roofers?
Government Response:
The Department of Labor Wage rate attached in Section J is currently “Heavy”. This is in error and the correct wage rate will be “Building” and will be attached to Amendment No. 0003.
32. Question:
Section 01 56 10 requires a PE to review and stamp that the roof is adequate. Please provide the strength and properties for the existing (1921 era) structural steel and rebar used in the roof system. Please confirm the 3000 psi concrete strength number given on drawing 12. If this data is
Shoshone Powerplant Roof Replacement Amendment No. 0003
Amendment No. 0003 - 6 not available please provide values that you would like all bidders to use so all proposals are comparable. These values are not a Means and Methods issue, but a bidding specification issue.
These values are critical to providing the USBR with an informed proposal as our entire roof removal plans depend on this engineering. If all bidders are directed to assume their own values and their proposal is accepted then it would seem that the USBR has agreed with the assumed values since they are not provided in the bidding documents and if these values are changed or provided after the fact it may cause a contract modification if it affects any time or costs.
Government Response:
The Government believes the contractor is actually referring to Section 01 53 10. Therefore the Contractor shall assume the following materials properties for the Shoshone Powerplant roof structure:
• Yield strength for concrete reinforcing steel = 33,000 psi
• Compressive strength of concrete = 2,500 psi
• Yield strength of structural steel roof members = 30,000 psi
Remaining information related to design review should be present in existing Drawings located in Specifications package."
33. Question:
Given the additions to the scope of work included in Amendment 0002, would the government consider extending the proposal due date. As it stands the additions to the scope of work are substantial, and, in our case, will require subcontractor support to adequately price. Due to the requirement to provide hardcopy proposals, we will need to mail our proposal no later than Monday to meet the deadline for proposal submissions. This is an inadequate amount of time to ensure the additional scope is bid accurately.
The Government is hereby extending the proposal due date to May 4, 2017 at 3:00 am MDT. The cut-off date and time to accept question has not been extended. Refer to Amendment 0002.
34. Question:
Please clarify the performance period discrepancy in Amendment 002. The response to question 7 and the performance period described in block 11 of the SF1442 describe a 180 day performance period. However, the revised Section F (included as attachment 2 to Amendment 0002) indicates that the performance period is 365 calendar days. Please confirm which is accurate.
Government Response:
Yes, Period of Performance has changed from 120 days to 365 days as stated in Section F. This is to provide adequate time due to this year we are having unseasonable wet weather that may prevent timely performance. The SF 1442 is a permanent document that cannot be changed.
Changes occur using the SF 30.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
