About this file
This document appears to be an amendment to a Request for Proposal (RFP) or Invitation for Bid (IFB) for Drugs and Pharmaceuticals issued by the State of Illinois, JPMC. The amendment addresses questions and clarifications related to the solicitation, including estimated total spend, reporting requirements, Minority-owned Business Enterprise (MBE) goals, pricing structure, background check requirements, and product lists. The solicitation is for a statewide contract to provide pharmaceutical products to various state agencies, with an estimated total spend of $600 million across 340B qualified and non-340B qualified entities. The contract term is not specified, but the vendor will be required to maintain pricing for the first six months, with the ability to adjust pricing every six months thereafter, while the discount percentage shall remain firm for the life of the contract.
The pricing structure for this solicitation requires vendors to bid using Wholesale Acquisition Cost (WAC) and Public Health Service (PHS) prices as the base, with a percent discount applied. Vendors will be required to submit a list of all available catalog pharmaceuticals, and the state has requested access to the vendor's full catalog portfolio, not just the specified product lists. The solicitation also includes requirements related to barcoding, background checks, and MBE participation, with the MBE goal set at 11% of the total contract spend.

Amendment 2 B-16903 JPMC Drugs and Pharmaceuticals
| Question 1: | Are there any estimates for what the value of the bid would be? |
| Answer: | Yes, total spend from non-340B qualified entities is estimated as $ 300,000,000.00 while total spend from 340B qualified entities is estimated as $ 300,000,000.00. |
| Question 2: | Do you have information on the reporting requirements if the bid is awarded? |
| Answer: | Contract section 1.3 and 4.27 (VSBP reporting) along with Section 7.8 in the BEP Uplan attached to the solicitation contain reporting requirements. |
| Question 3: | Is the BEP responsible for 11% of every order or sit a monthly or annual basis? |
| Answer: | The BEP goal is for the life of the contract. The BEP spend is 11% of the total contract spend, then the vendor would be satisfying the goal. |
| Question 4: | Section 1.2.13: Can you expand on the barcoding requirement listed here? How is the State going to use this information? |
| Answer: | The State is making requests in order to ensure the necessary information is available if at anytime during this contract the State would implement an automated inventory contract type system which needs to scan barcodes to maintain accurate data. |
| Question 5: | Section 2.5 Pricing: Can you please clarify that the State would indeed like the price to be bid using WAC as the base price, rather than a cost minus discount that is applied to eligible contract pricing? |
| Answer: | Yes, the WAC and PHS prices are to be considered the base price for all items available in the catalog of pharmaceuticals. The percent discount off of the final price which is the base price with the vendor mark-up added. |
| Question 6: | Section 2.5.4.: Economic Adjustment Clause. Can the State of Illinois confirm the cost freeze is the cost of goods discount vs. GPO/manufacturing pricing? |
| Answer: | The cost freeze is the base price for the first six months. The vendor and the State can adjust pricing once during every six-month period thereafter. The percent discount shall remain firm the entire length of the contract. |
| Question 7: | Background Check: Can you please clarify the intent of this section? Does this give the State of Illinois the ability to conduct a background check on any employee or any employee working in the State of Illinois? |
| Answer: | The intent of this section is to give the State of Illinois the right to conduct a criminal and driver background check of any officer, employee or agent of the vendor or its subcontracts whenever the State deems it necessary for security reasons. |
| Question 8: | Would it be possible to get the four product lists (DPH ADAP Product List, DPH STD Product List, DPH TB Product List, and DHS Product List) in an Excel file format? |
| Answer: | These lists are for informational purposes only. We want to ensure that the bidding vendors know what we will need available to order. We have the IFB worded that we are requesting access to the entire catalog portfolio not just these drugs. The State has requested the agencies for excel file formats. If available the State will publish at a later time. |
| Question 9: | Would we be sending full bottles and not as prescriptions for individuals correct? |
| Answer: | This solicitation is for wholesale pharmaceuticals and any unit of measure available for purchase from catalog items should be made available. This solicitation is not for patient-based prescriptions. |
| Question 10: | Do I submit any other documents to the agency other than the form which is in question? |
| Answer: | Yes, the Contract, the Offer, Forms A or Forms B, and the BEP Utilization Plan as well as the requested price lists and the discount percentage are all required to be submitted with a vendor’s quote. |
| Question 11: | Do I submit a list of products from the BID list that I can provide? |
| Answer: | The State is asking for a list of all available catalog pharmaceuticals. The “BID list” or lists are formularies that must be available for purchase. |
| Question 12: | Do I submit written documents from manufacturers indicating they have a relationship with my company? |
| Answer: | You certainly can but this is not required documentation. |
| Question 13: | Where do I submit the Utilization Plain Part 1: Commitment and Signature Form? |
| Answer: | This should be attached to your quote through the BidBuy system. If you have question on how to do this in the system, please call 866-455-2897. |
