Question and Answer (Q&A) Set # 2
Item
IFB Section
Question
State’s Response
2-1
Attachment 2 – Bid Specification 2310-BS-0194616-1, Section 3.1; Attachment 3 – Bid Specification 2310-BS-0194616-2, Section 3.1: and Attachment 1 – Pricing Workbook
If the vehicle GVWR exceeds one line item (to next class) but battery capacity indicated in the next class is above that available on the product, should the product be listed under both line items for DGS to consider the appropriate line/category for the product? (I.e. battery capacity is nearly mid-way between the GVWR requirement lines).
All proposed vehicles must meet the requirements for the line item and the corresponding Bid Specification. If a proposed vehicle does not meet the minimum requirements, the vehicle will not be considered for award.
2-2
Attachment 1 – Pricing Workbook
If the vehicle being proposed has two wheelbases (e.g. corresponding to two different cab-to-axle configurations), should both wheelbases be listed in the corresponding worksheet cell.
Awarded line item vehicles may be upfitted to different configurations as long as the vehicle does not conflict with another line item awarded for this potential contract. The proposed vehicle would still need to meet the minimum requirements required for the line item with the upfitting.
2-3
Attachment 4 – Technical Questionnaire
For an intended future feature that is not yet available (perhaps a future model year) does declaring “UNAVAILABLE” preclude its future inclusion as a standard or optional feature for the life of the contract?
No, features may change in the future as long as the feature does not upgrade the vehicle to conflict with another line item awarded for this potential contract and the proposed vehicle still meets the minimum requirements required for the line item.
2-4
Attachment 4- Technical Questionnaire
The CNG Fueled line items (MD-HD Trucks worksheet Line Items 10,11,12) do not include a specific DGE fuel requirement. Is there a base line or is the CNG tank system not part of the quote?
There is no minimum requirement for fuel capacity. The manufacturer’s standard tank is acceptable.
2-5
Attachment 4-Technical Questionnaire
All line times (MD-HD Trucks worksheet Line Items 10,11,12) are conventional cab. Is there a way to add Cab Over CNG Fueled line items?
Yes, Cab Over CNG line items have been added.
See MD-HD Trucks CLIN 26, 27, 28 in Attachment 1 – Pricing Workbook - Addendum #3.
2-6
Attachment 1 – Pricing Workbook
For CLIN 19 on tab MD-HD Trucks, will you accept a vehicle with a 140kWh that meets all other requirements? The line item currently calls for a 200 kWh battery.
An additional line item for a lesser kWh battery requirement has been added.
See MD-HD Trucks CLIN 29 in Attachment 1 – Pricing Workbook – Addendum #3
2-7
Attachment 1 – Pricing Workbook and Attachment 4 – Technical Questionnaire
For CLIN 23 on tab MD-HD Trucks, the 80,000 lb. GCWR requirement can’t be met with a 4x2 tractor configuration. If the GCWR was changed to 68,000 lbs., that would allow for a compliant bid to be submitted. Will you please consider this change?
Yes, line-item requirements have been updated.
See MD-HD Trucks CLIN 24 in Attachment 1 – Pricing Workbook – Addendum #3. Please note, CLIN 23 is now CLIN 24 due to the addition of MD-HD Vans CLIN 10.
2-8
Attachment 2 – Bid Specification 2310-BS-0194616-1
The workbook on SUV's references 2320-BS-0194616-1 per the example below, but this spec reference does not exist.
All Light Duty Vehicles fall under Attachment 2 – Bid Specification 2310-BS-0194616-1. Please see Attachment 1 – Pricing Workbook, Addendum 2.
2-9
IFB, Section 1, Scope
Year Model Exemption - We have attached a letter requesting a year model exception for a NEW EV that would exceed the BID specifications. Is there a process to request this exception?
All vehicles offered must be new and the latest model available for order. There are no exceptions.
2-10
IFB Section 15, Agreement Cover Letter and Contract Provisions
What are States' net terms for payment?
Non-IT Goods General Provisions, Article 30, Required Payment Date states that payment will be made in accordance with the provisions of the California Prompt Payment Act, Government Code Section
927 et. seq. Unless expressly exempted by statute, the Act requires state agencies to pay properly submitted, undisputed invoices not more than 45 days after (i) the date of acceptance of Goods or performance of services; or (ii)receipt of an undisputed invoice, whichever is later.
2-11
IFB Section 15, Agreement Cover Letter and Contract Provisions and IFB Section 68, Receiving Inspection and Acceptance
Once we receive a purchase order from a customer for a vehicle that is readily available from inventory we are concerned about the timeline between commitment and delivery. Our concern is the carrying costs of holding vehicles until you take delivery, especially if there is up fitting needed. Can a delivery/payment timeline be established so that we know what our true costs will be as interest on vehicles accrues daily.
Payment will be made in accordance with the provisions of the California Prompt Payment Act, Government Code Section
927 et. seq. Unless expressly exempted by statute, the Act requires state agencies to pay properly submitted, undisputed invoices not more than 45 days after (i) the date of acceptance of Goods or performance of services; or (ii)receipt of an undisputed invoice, whichever is later. Inspection will commence within five working days of notification that a vehicle is ready for inspection. In the event deficiencies are detected, the vehicle will be rejected and the delivering dealer will make the necessary repairs, adjustments, or replacements. Payment and/or the commencement of a discount period (if applicable) will not begin until the defects are corrected, and the vehicle is re-inspected and accepted.
2-12
IFB Section 77, Restocking Fees
If an ordered vehicle requires third party upfitting, can we stipulate that the order can no longer be canceled once the upfitting work has started, or any work that alters the vehicle in any way?
No, the Contractor may impose a restocking fee to the ordering agency on any order cancelled after the order has been placed with the manufacturer except for cases of product defect or recall. The Contractor shall notify the ordering agency of the order placement per Section 60, Order Acknowledgment.
Re-stocking fees can be no greater than 10 percent of the price of the vehicle needing restocking. Bidder shall provide their restocking fee on Attachment 5 – Narrative Response.
2-13
IFB Section 68, Receiving Inspection and Acceptance
Inspection - where does that occur? Is this done at a state specified location or by the vendor?
Vehicles ordered for state use will be inspected by a state inspector at the dealer’s place of business or designated business site.
2-14
IFB Section 52, Options and Attachment 1 – Pricing Workbook
Line items for third party upfitting (dump body, reefer) - Should we add this information as separate line items or just list in the narrative?
Options and upfitting will be determined by ordering agencies and the Contractor at time of quote or purchase order. The available options and upfitting are not listed in the potential contract. The State requests all bidders to provide additional options (upfitting) upcharge percentage (not to exceed 10%) on Attachment A – Pricing Workbook.
2-15
IFB Section 77, Restocking Fees and Attachment 5 – Narrative Response
Restocking Fee - Can we get clarification on restocking terms and conditions. Once a manufacturer starts to fulfill an order, we are “on the hook for the vehicle” if the state cancels an order when the vehicle is in process what does the State expect in terms of the “restocking fee”?
The Contractor may impose a restocking fee to the ordering agency on any order cancelled after the order has been placed with the manufacturer except for cases of product defect or recall. The Contractor shall notify the ordering agency of the order placement per Section 60, Order Acknowledgment.
Re-stocking fees can be no greater than 10 percent of the price of the vehicle needing restocking. Bidder shall provide their restocking fee on Attachment 5 – Narrative Response

2-17
Attachment 4 – Technical Questionnaire
Our conventional cab truck (CLIN 19) can safely handle any GVWR weight between 19,500 to 26,000 pounds. We want to make it clear that our range is 19,500 to 26,000. Are we allowed to input a range in the GVWR column on the Technical Questionnaire? If not, what would be the best way to make it clear that our GVWR weight range is 19,500 to 26,000 for the vehicle?

However, please note that the resulting contracts are subject to Vehicle Manufacturer Purchasing Restrictions, State Administrative Manual (SAM) Section 4121.8. Additionally, a CARB aligned OEM vehicle bid by a responsive and responsible Bidder cannot lose an award to a non-CARB aligned OEM vehicle. |
See IFB Event ID 0000031286 – Addendum 3 Section 4 – Method of Award and Section 21 – Proposed Products.
2-21
IFB Section 28, Volume Discounts and IFB Section 4, Method of Award
Is a volume discount (IFB Section 28) mandatory and will the proposal score be affected by not offering a volume discount?
Volume discounts are not mandatory. Bidders may offer a volume discount per line item. The award will be made to the responsive and responsible Bidder with the lowest cost (including all applicable preference and incentive calculations). It is not a scored evaluation.
2-22
IFB Section 23, Pricing Structure and IFB Section 26, Sales Tax
Are State entities subject to fees besides sales tax? Some local government entities incur tire fees, registration fees, license fees, etc.

Would DGS entertain lowering the minimum of CLIN 19 or creating a line for 19,500 lbs conventional chassis cab with a 130kWh minimum battery spec to increase the competitive set or potentially clarifying this situation? |
An additional line item has been added.
See MD-HD Trucks CLIN 31 in Attachment 1 – Pricing Workbook – Addendum #3.

IFB Section 27, Promotional Pricing
Does the State support any scenarios associated with ad hoc or to be determined incentives that we may offer? For example, common during model year transition (often in Q4 of a calendar year) to provide specific incentives on remaining "in stock" end of model year inventory. If we have a contract with the State, is it possible to share (and thus have displayed/communicated with potential State buyers) ad hoc incentives that may become available at a later date?
Yes, the State supports ad hoc or to be determined incentives. Incentives that are offered for an extended period would be best processed as a price adjustment. However, limited-term or limited-quantity incentives are handled differently. Upon receiving notification from the Contractor, the Contract Administrator will inform the State Fleet Managers of the available incentives. It is the Contractor's responsibility to provide all relevant details regarding the promotion or incentives being offered.

IFB Section 34, Authorized Dealer
Are we allowed to respond to certain line items where we are not technically the authorized dealer?
If the Bidder is not the Original Equipment Manufacturer (OEM) of the vehicle being proposed, the Bidder must provide, on OEM company letterhead and signed by an authorized OEM representative, documentation identifying the Bidder as an authorized OEM dealer.
