About this file

Summary

This is a Questions and Answers document issued by the Florida Department of Financial Services, Office of Insurance Regulation, in response to inquiries submitted by potential respondents regarding RFP 2627-02 for a multi-state market conduct examination of the National Council on Compensation Insurance, Inc. The examination will be conducted pursuant to sections 624.3161 and 766.315(5)(e), Florida Statutes. The RFP solicitation requires qualified contractors to conduct comprehensive market conduct examinations including drafting data calls, creating examination programs, coordinating with NCCI, conducting field work, reviewing preliminary advisories, conducting exit conferences, and preparing draft examination reports. Responses were due October 19, 2026, at 3:15 p.m. Eastern Time. The anticipated notice of intent to award is November 2, 2026, with a contract start date of November 9, 2026. The contract will terminate no later than June 30, 2027, with an estimated examination completion date of November 30, 2027, which may be extended by up to one year by written agreement. Following examination completion, the contractor must remain available on a fee-for-service basis at the same hourly rates for one year to provide additional services as needed. The evaluation is weighted 90 points for technical response and 10 points for cost.

The document addresses 15 key questions submitted by potential respondents regarding contractual obligations, data security requirements, insurance coverage, liability limitations, personnel approval processes, and compliance demonstrations. Notable clarifications include confirmation that indemnification obligations are as provided in the Scope of Services Agreement, that contractors must demonstrate compliance with Attachment 5 Data Security Requirements prior to providing services, and that the liability cap in Attachment 2, section 7.f applies to all claims including indemnity and data breach claims. The Office clarified that contractors using commercial cloud services for examination work papers are not classified as Cloud Service Providers and that security controls equivalent to or exceeding NIST Cybersecurity Framework Version 1.1 are acceptable, including ISO/IEC 27001:2022 or CIS Critical Security Controls v8. The anticipated contract completion date is November 30, 2027, with post-examination availability obligations extending one year from that date unless subsequently amended.
