About this file

This document is a Question and Answer set regarding a Request for Proposals (RFP) issued by the Massachusetts Department of Conservation and Recreation (DCR) for Food and Skate Shop Concessions at multiple locations. The RFP seeks proposals for operating concessions, including food service and skate rentals, at the Steriti Rink and Kelly Rink facilities. The document addresses insurance requirements for non-profit organizations, which must provide liability coverage for their activities and any damage caused during the permit term. The RFP has a bid opening date of September 25, 2015.

The RFP specifies that third-party operators charging the public for access to the rinks are required to carry insurance, as such activities are not covered under the state's recreational use statute. DCR cannot assume the costs or risks associated with the concessions. The document also provides guidance on obtaining affordable insurance coverage through the Massachusetts Property Insurance Underwriting Association (MPIUA). All questions from interested parties must be submitted to the designated DCR email address, as responses will be posted publicly on the Comm-BUYS procurement portal.

DEPARTMENT OF CONSERVATION AND RECREATION

REQUEST FOR PROPOSALS FOR

FOOD AND SKATE SHOP CONCESSIONS -MULTIPLE LOCATIONS

RFP # DCR 2015 900 (Steriti Rink; Kelly Rink)

QUESTIONS AND ANSWERS – SET 1

The following questions were received in writing to date by the Department of Conservation and Recreation (“DCR”) from interested potential proposers during the Proposal Period of the above-mentioned Request for Proposals (“RFP”). Answers follow each question below.

Question 1:We are an all volunteer 501c3 non-profit. The last time we inquired about insurance we were told it would cost several thousand dollars. There is no way we can afford that much money every year. Our skating teachers are covered by insurance from the US Figure Skating Association of which our Learn to Skate program is affiliated. There is no food service facility in the skate rental trailer. We have never served food. … [h]ow can the insurance requirement can be resolved[?]
Answer 1:DCR has several agreements with many non-profits of various sizes that use DCR properties and have provided insurance. Consider asking your insurance agent to contact the MPIUA Mass Property Insurance Underwriting Association (https://www.mpiua.com/) and to consider with the agent what should be insured, for how long, and the value. You may be able to find something that is reasonably affordable and helps give you and DCR the assurance of coverage.
Insurance is required because you are charging the public for access to the rink and in charge of all the activities there. If a patron or visitor were injured there we require that third party activity operators carry some insurance. Once someone is charged by a third party for visiting the rink and skating it takes the visit out of the limited liability of the recreational use statute. DCR cannot assume costs or the risk of loss for the permittee. In addition we require third party permittees to have some way of repairing any damage caused during their permit term.
